This being the date set, continued hearing was had on the Improvement Resolution No.I790 for the construction of a sewer along Chalfant Street from Walsh Street to a point 10 feet East of the Wiest lin-? of Lot 150 in Replat of Park Place 2nd., Plat. In the above matter the Board decides to continue hearing on same until June 8th., 1927, at 7-15 P. P. This being the date set, hearings were had on the following Vacation Resolutions; Vacation Resolution No.1800 for the vacation of the alley West of Ylin Street from the South line of Foote Street to the North line of the Ist. alley South of Foote Street. Vacation Resolution No.I80I for the vacation of the alley North of Bartlett Street from West line of Main Street to the East line of the Ist. alley West of Main Street. Vacation Resolution No.1809 for the vacation of alleys in • LaSalle Park and Summit Place third plat. Vacation Resolution No.I8I0 for the vacation of alleys in Lincoln Park. In all of the above vacation resolutions, no remonstrators appeared and no wkitten remonstrance was filed and the Board being fully advised in the premises, decides to sustain all former action taken on said vacation resolutions', and declares same in all things ratified, confirmed and approved and the alleys vacated. The Board now orders that a list or roll shall be prepared of all property and of all valuable interests therein sought to be taken or to be injuriously affected, which list shall also describe the property beneficially affected. This being the date set, continued hearing was had on Vacation! Resolution No. 1765 for the vacation of Tutt Street from East line Of Carroll Street to a point 82.5 feet N. W. of t#e S. E. corner of Lot 12 in William Anderson's Subdivision, In the above named Vacation resolution, the Board being fully advised in the premises, decides to rescind all former action taken on said vacation resolution No,I765 and declares same null and void and the proceedings closed. This being the date set, continued hearing was had on the widening of Kline Street from Calvert Street to Ewing Avenue tinder Condemnation Resolution No.1799. In the above matter, property owners appeared and asked the Board to make Mien Street a hundred foot street instead of an eighty foot street, to correspond with the new Twyckenham Drive of one hundred feet. There were eight property owners present in favor of the hundred foot street while one only favored the eighty foot street. After hearing all persons interested in said widening, the Board decides to rescind all action taken on said Condemnation Resolution and declares same null and void and the proceedings closed. • This being the date set, hearings were hdd on the following Assessment i-olls: Assessment roll for the construction of grade and walk on the East side of Eddy Street from Bronson Street to the Grand Trunk Western R. R., under Improvement Resolution No.1599. Eston Bal contractor, $1092.36. Assessment roll for the construction of grad-6 and walk on the North side of Prast Street from Johnson Street to the 2nd., alley west of Johnson; Street under Improvement Resolution No.I758. Amou#t due Eston Ball contractor, 248.00/ In both of the above named assessment rolls, no remonstrators appeared and no written remonstrance was filed and the Board, being fully advised in the premises, finds that the benefits to the several lots and parcels of land which have been assessed for said improvements, are equal to the MX set opposite said lots and parcels - of land on said primary rolls, and therefore, declares said rolls ratified, confirmed and approved i and the proceedings closed. Board now orders said assessment rolls delivered to the Department of Finance. This being the date set, hearing vas had on the assessment roll .1 for the grade, curb and walk on Dayton Street from Robinson Street to the My -line off Y.S. Robinson's 2nd., plat under Improvement resolution No.1566, Amount due J. A. Wray, filed plans, specifications and estimates and the Board adopted a resolution for the construction of -a local sewer along Avondale Road from Twyckenham Drive to Redgedale load; ALSO Hidgedale Road from Twyckenham Drive to Ridgedale Road under Improvement Resolution No.I848, In the above matter, the Twyckenham Land and Investment Co., sole owners of property above described, waived all objections on and in defense to any defect in said proceedings and to any violation in.procedure for the construction of improvements according to law. The Tvveyckenham Land and Investment Co., filed an easement for the construction of said sewer. Easement as follows: "In consideration of the city of South Bend making an effort to sewer the following described land and the right to tap in and use the sewers and the benefits to be derived therefrom, the Twyckenham band and Investment Co., a Delaware Ci Corporation, with office in the ty of South Bend, St. Joseph County, Indiana, does hereby grant to the City of South Bend, Indiana, the right to lay, maintain, operate and repair certain sewers as shown on the attached blue print. jThis grant of easement on the part of the Twyckenham Land and Investmnn Co., will not preclude the City from assessing the .land of said Company when a seaer k has been constructed along the line of said easement, as other lands are assessed as provided by statute and no deduction, rebate, or concession will be claimed or asked by said company in consideration of the grant of this easement, Said sewers shall be laid along and through the above described real estate as though said strip of land had been dedicated to the public as streets and highways and for the purpose of laying, operating, maintaining and repairing said ewers, the said City of South Bend shall have the right to �o upon said described s real estate and make such sxcavations as may be necessary and proper, but all such excavations shall be refilled and ground leveled when work of.laying, repairing or maintaining has been completed. Board approved same in the amount of 4,381.00. The Board approved the Petition of the Colpeart Realty Co., for 59 Boulevard Lights, on Division Street Gladstone, Edison, Albert and Sheridan Streets same to be turned on August Ist., 1927. The olpeart Realty Co., agree to pay for i the installation and fixtures and the city will maintain said lights. In the matter of condemnation Resolution No.I793 for the opening'' of Bulla Street from Portage Avenue to MLedora Street, the Board finds capons investigati�lon that the district as described in the resolution for this condemnation No.I793, is 1 not properly bounded and thereupon decides to rescind all former action taken on said condemnation resolution, adopted April 5th., 1927, and declares same null and void. Improvement Resolution No.I846 for the construction of grade, curb and walk on Johnson Street from Hamilton Street to Wilson Street.(See files for copy of resolution.) Improvement Resolution No.I847 for the construction of grade, curb and walk on Main Street from Woodside Street to Dean Avenue. ( See files for c'opyj of resolution.) j In all of the above named resolutions, the Board hereby orders that on the Ist., day of June, 1927, at 7-I5 P. M., this Board will meet at it's offic' in the City Hall to hear and receive remonstrances from all persons whose property is liable to be assessed for said improvements and will decide whether the benefits j to the property liable to be assessed for said improvement will be equal to the estimated cost of same. Board further orders that notices of said hearings be published in the South Bend News Times and Tribune on the I3th., day of May and on the 20th.., (� day of May, 1927, and that notices be mailed to property owners according to lane. After hearing all persons interested in said assessment roll and giving due consideration to all verbal and written remonstrances, the Board instructs the engineer to modify said roll in the foll owing'respects: I. Deduct from area of benefited district, areas for all streets and all in plats filed with the Board as of May 25th. , I927. 2. Deduct from area of benefited district, a forty foot width for Ernspe' ger Street from Ewing Avenue to the Southern boundary line of said benefited district. 3. Deduct from area of benefited district, a forty foot width for Donmoy? er Street from the east line of the Twyckenham Land & Investment Co.Ts.property to Ernsperger Street. t. 4. Make any other adjustments within._.:-- benefited district relating to to areas that heretofore were erroneously computed. uniformily 5. In the ab oVe matter, the Board hereby orders that on the 22nd. , day of June, 1927, this Board will meet in the office at the Pity Hall at 7-I5 P. M., to hear and receive remonstrances from all persons whose property is liable to be affected by said proceedings.
