Kise 4.00 The Board adopted a con.demhdtion resolution for tre use of. the City as an easement through sufficient lend for the construction of a. trunk sever and \ 4Dtwelve for the further purpose of securing a permanent easement through a ttrip of land (I2) feet in width, six (6) feet on either side of the center line, to be used in' r.-laintaining said trunk sewer, under Condemnation resolution No.I769. In the above natter, the Board hereby orders that on the 26th., day of January I927, in their office in the City HAll at 7-I5 P. M-'., this Board will. meet to hear and receive remonstrances from all persons whose property will be affected by said resolution. Board further orders that .notices of said hearing _ shall be published on the 7th. , day of January and on the I4th. , day of January I927, in the South Bend News Times and Tribune. Upon the recommendation of •"Tr. Ernest Young, architect, rthe Board awarded the contract for the interior alterations in the.City Nall to-Goheen,. contractor, at -his low bid of I3,049.39. Witnesseth, that .the Contractor and the Owher, for the consideration hereinafter named, agree as follows: Article I: The contractor agrees to provide all the materials and to perform all the work shown on the df;awin s m and described in the specifications, Co. #3021 December, I926, General Fontract specifications, interior Alterations City Hall, South. Bend, Indiana, specifications sheets I to6 inclusive, prepared by Ernest 20`50 Thursday, January 6th. I927. fa. The Contractor agrees to do every thing required by the General Conditions of the contract included with Specifications as aforementioned, the Drawings and the specifications, instruction and Notice as. above mentioned. Article II: The Contractor agrees that the work under this contract shall be substantially completed as fast as the progress of the work will permit, all bran.ces of work under this contract being entirely completed on or before February 5th., I927. The Contractor is to pay or allot-; the owner, as agreed liquidated damages, the sum of Five Dollars (5.00) for each day after February5th,, I927, Stineays and Holidays not included, that the work remains uncompleted. Article III. The Owner agrees to pay the Contractor in current funds for. the performance of the contract One Thousand forty nine and 39/100 F,049.39) Dollars; subject to additions ar.d deductions as- "provided . in the General onditions of the Specifications, wit1h out affecting the validity of the Bond, and to rake payments on account thereof upon the Architect's certificates ns follows: Eighty-five percent (85<,) of the Architect's estimate of the value of labor and materials incorporated in the work at substantial completion. The balance, fifteen percent (I5 ) remains ig shall be payable v_,hen the final certificate is issued or not later than thirty (30j days after dirial completion. Article IV. The contrPetor and the owner egree that the General Conditions, the Drawings, specifications, Instructions and Wotice, as aforementioned, together with this Agreement, form the contract and that they are as fully a part of this agreement as if hereto attached or herein repeated.
