Elmer Street South Bend, IN 46628 PHONE 574/235-9251 FAX 574/ 235-9171 RE: Alley Vacation — First East/West Alley North of Prast St., 14' in Width and 125' Long from East Right of Way of Elmer St. and West Right of Way of North/South Alley between Prast St. to the South and Lincolnway West to the North (Preliminary Review) Dear Tv1r. and Mrs. Preston: At its March 13, 2018 Board of Public Works meeting, the Board reviewed comments by the Engineering Division, Area Plan Commission, Community Investment, Fire Department, Police Department, and the Solid Waste Division regarding the above alley vacation. The following comments and recommendations were submitted. The Fire Department stated per IC 36-7-3-13, the vacation would make access to, the lands of the aggrieved person by means of public way difficult or inconvenient. The closest hydrant is 178 feet across the alley to be vacated. The next nearest hydrants are 590', 581', and 545'to get to the structures at the cross of the alleys. The Fire Department is concerned that their fire hose will not reach in the case of a fire, Community Investment stated the vacation would meet all of the criteria of IC 36-7-3-13 regarding vacations, but recommended approval on the condition that it's accepted by the property owner at 902 N. Elmer Street. Area Plan and Engineering gave a favorable recommendation based on the criteria of IC 36-7-3-13. Therefore, the Board of Public Works gave no recommendation, but recommended that the attached comments be forwarded to the Common Council for the vacation of this alley. Please contact Donna Hanson at (574) 235-9254 prior to pieldng up your radius map. You will need a radius rnap showing properties within 150' of the proposed vacation for your petition to the Common Council. It is the staff's opinion that: (1) The vacation would not hinder the growth or orderly development of the unit or neighborhood in which it is located or to which it is contiguous, The alley is a mid -block alley connecting Elmer to the north/south alley. It does not continue east to Huey Street. Therefore, it is not a critical circulation link in the neighborhood. (2) The vacation would not make access to the lands of the aggrieved person by means of public way difficult or inconvenient. The owner to the north (ID# 18-2031-1043) shares access to this alley. Vacation of the alley would provide an additional 7' to that owner, continuing to provide access to Elmer. In addition, that property will continue to have access to the north/south alley. (3) The vacation would not hinder the public's access to a church, school, or other public building or place. No church, school or other public building or place is accessed by either the alley. (4) The vacation would not hinder the use of a public way by the neighborhood in which it is located or to which it is contiguous.
