The undersigned Contractor, being duly sworn upon his/her/its oath, affirms under the penalties of perjury
that:
1. Contractor has not, nor has any other member, representative, or agent of the firm,
company, corporation or partnership represented by him, entered into any combination, collusion
or agreement with any person relative to the price to be bid by anyone at such letting nor to
prevent any person from bidding nor to induce anyone to refrain from bidding, and that this bid is
made without reference to any other bid and without any agreement, understanding or
combination with any other person in reference to such bidding. Contractor further says that no
person or persons, firms, or corporation has, have or will receive directly or indirectly, any rebate,
fee, gift, commission or thing of value on account of such sale; and
2. Contractor certifies by submission of this proposal that neither contractor nor any of its
principals are presently debarred, suspended, proposed for debarment, declared ineligible, or
voluntarily excluded from participation in this transaction by any Federal department or agency;
and
3. Contractor has not, nor has any successor to, nor an affiliate of, Contractor, engaged in
investment activities in Iran.
a. For purposes of this Certification, "Iran" means the government of Iran and any
agency or instrumentality of Iran, or as otherwise defined at Ind. Code § 5-22-16.5-5,
as amended from time -to -time.
b. As provided by Ind. Code § 5-22-16.5-8, as amended from time -to -time, a Contractor
is engaged in investment activities in Iran if either:
i. Contractor, its successor or its affiliate, provides goods or services of twenty
million dollars ($20,000,000) or more in value in the energy sector of Iran; or
ii. Contractor, its successor or its affiliate, is a financial institution that extends
twenty million dollars ($20,000,000) or more in credit to another person for
forty-five (45) days or more, if that person will (i) use the credit to provides
goods and services in the energy sector in Iran; and (ii) at the time the
financial institution extends credit, is a person identified on list published by
the Indiana Department of Administration.
4. Contractor does not knowingly employ or contract with an unauthorized alien, nor retain
any employee or contract with a person that the Contractor subsequently learns is an
unauthorized alien. Contractor agrees that helshelit shall enroll in and verify the work eligibility

status of all of Contractor's newly hired employees through the E-Verify Program as defined by
I.C. 22-5-1.7-3. Contractor's documentation of enrollment and participation in the E-Verify
Program is included and attached as part of this bid/quote; and
5. Contractor shall require his/her/its subcontractors performing work under this public
contract to certify that the subcontractors do not knowingly employ or contract with an
unauthorized alien, nor retain any employee or contract with a person that the subcontractor
subsequently learns is an unauthorized alien, and that the subcontractor has enrolled in and is
participating in the E-Verify Program, The Contractor agrees to maintain this certification
throughout the term of the contract with the City of South Bend, and understands that the City
may terminate the contract for default if the Contractor fails to cure a breach of this provision no
later than thirty (30) days after being notified by the City.
6. Persons, partnerships, corporations, associations, or joint venturers awarded a contract
by the City of South Bend through its agencies, boards, or commissions shall not discriminate
against any employee or applicant for employment in the performance of a City contract with
respect to hire, tenure, terms, conditions, or privileges of employment, or any matter directly or
indirectly related to employment because of race, sex, religion, color, national origin, ancestry,
age, gender expression, gender identity, sexual orientation or disability that does not affect that
persons ability to perform the work.
In awarding contracts for the purchase of work, labor, services, supplies, equipment, materials, or
any combination of the foregoing including, but not limited to, public works contracts awarded
under public bidding laws or other contracts in which public bids are not required by law, the City,
its agencies, boards, or commissions may consider the Contractor's good faith efforts to obtain
participation by those Contractors certified by the State of Indiana as a Minority Business ("MBE")
or as a Women's Business Enterprise ("WBE") as a factor in determining the lowest,
responsible, responsive bidder.
In no event shall persons or entities seeking the award of a City contract be required to award a
subcontract to an MBEIWBE; however, it may not unlawfully discriminate against said
WBEIMBE. A finding of a discriminatory practice by the City's MBENVBE Utilization Board shall
prohibit that person or entity from being awarded a City contract for a period of one (1) year from
the date of such determination, and such determination may also be grounds for terminating the
contact for which the discriminatory practice or noncompliance pertains.
7. The undersigned contractor agrees that the following nondiscrimination commitment shall
be made a part of any contract which it may henceforth enter into with the City of South Bend,
Indiana or any of its agencies, boards or commissions.
Contractor agrees not to discriminate against or intimidate any employee or applicant for
employment in the performance of this contract with privileges of employment, or any matter
directly or indirectly related to employment, because of race, religion, color, sex, gender
expression, gender identity, sexual orientation, handicap, national origin or ancestry. Breach of
this provision may be regarded as material breach of contract.
I, the undersigned bidder or agent as contractor on a public works project, understand my
statutory obligations to the use of steel products or foundry products made in the United States
(I.C. 5-16-8-1). 1 hereby certify that I and all subcontractors employed by me for this project will
use steel products or foundry products made in the United States on this project if awarded.
understand I have an affirmative duty to notify the City in my bid that my proposal does not
include the use of steel products or foundry products made in the United States. I understand it is
my sole obligation and responsibility to provide a justification to the City, subject to review and
approval, why the cost of United States made steel or foundry products is unreasonable. Prior to
award and upon submission of bid which does not use steel products or foundry products made
in the United States, the City, through its director of public works, shall make a determination if

The Contractor and Surety are bound to the Owner in the amount set forth above, for the payment of which the Conti -actor

The Surety hereby waives any notice of an agreement between the Owner and Contractor to extend the time in which the Owner
may accept the bid. Waiver of notice by the Surety shall not apply to any extension exceeding sixty (60) days in the aggregate
beyond the time for acceptance of bids specified in the bid documents, and the Owner and Contractor shall obtain the Surety's
consent for an extension beyond sixty (60) days.
If this Bond is issued in connection with a subcontractor's bid to a Contractor, the term Contractor in this Bond shall be

2.01 Special Provisions, Section XIII, Prosecution and Progress, Item B:
1. REVISE paragraph No. 1 to read as follows: `The project will have a completion date
of September 21, 2018 for all work. The contract time will start when the Notice to
Proceed is delivered and signed.
2.02 Special Provisions, Section XVI, Liquidated Damages, Item B:
1. REVISE paragraph No. 2 to read as follows: "If the Contractor shall fail to complete
the work within the Contract Time, or extension of time granted by the Owner, then
the Contractor will pay to the Owner the amount for liquidated damages a sum of
five hundred dollars ($500.00) for each calendar day that the Contractor does not
meet the completion requirements stipulated in the Contract Documents. A
separate liquidated damages sum of five hundred dollars ($500.00) for each
calendar day to meet the requirements for the utility cuts in Main Street as noted in
Section XX, Maintenance of Traffic. For all other work in the Right -of -Way,
everything but the surface treatment needs to be completed in that time."
2.03 Special Provisions, Section XX, Maintenance of Traffic, Item B:
1. ADD paragraph No. 6: The Contractor shall provide two (2) "Sidewalk Closed signs,
R9-9; two (2) "Sidewalk Closed, Use Other Side" signs, 139-10; four (4) "Road Closed"
signs, R11-2; one (1) "Road Work Ahead Sign", XW20-1, two (2) "Detour" signs, M4-9L,
two (2) "Detour" signs, M4-9L, Construction Barrels placed every 25 feet, and seven
Barricade Type III-B per Indiana Manual on Uniform Traffic Control Devices
installation locations per "Maintenance of Traffic Detail" on Plan Sheet CO-100
Demolition Plan. This work is to have a maximum closure of 5 days for water
connections and street repair from the utility cuts in Main Street.
2.04 ADD Special Provisions, Section XX, Video Inspection
1. Item A: Prevailing Specifications: 2018, INDOT Standard Specifications
2. Item B: Additions
1. Sanitary Sewer Laterals shall be inspected using high resolution, high sensitivity,
and waterproof color video camera/recording equipment.
2. The camera/recording equipment shall be specifically designed for continuous
viewing/recording of detailed images of the interior wail of pipes and transitions of
the specified sizes. The equipment shall have the capability of viewing a minimum of
100 ft into the pipes and shall be designed to include sufficient lighting to view the
entire periphery of the pipe. The equipment shall have appropriate attachments to
maintain a position in the center of the pipe and an electronic counter to
continuously record the location of the equipment in the pipe. The recording

equipment shall record video of a quality and in a format acceptable to the
Engineer/Landscape Architect. A color video printer shall be included in the
equipment for printing observations during inspection.
3. The Engineer/Landscape Architect will determine the runs of the Sanitary Sewer
Laterals to be inspected. Video inspection shall be conducted prior to new
connections being installed.
4. Damage discovered by the video inspection will be addressed by Alternates 7 or 8.
Damage shall include but is not limited to: crushed or partially crushed pipe that
impedes the progress of the camera, blockages, vertical pipe sags filled with water to
a depth of d/2 or greater, 90' connections, connector separations, cracks or splits in
the pipes. All repaired sections shall be video reinspected prior to acceptance. A copy
of the video inspection shall be submitted to the Engineer/Landscape Architect.
2.05 Special Provisions, Section ill, Alternates, Item B:
1. ADD paragraph No. 3: Alternate #9 - Limestone Fines
a. Description. The work shall include all material, equipment, and labor required to
install limestone fines in lieu of crushed oyster shells in the Bocce area as indicated

1.) AlI residents affected by CIPP activities shall be notified in writing at least 24 hours prior
to any service disruption affecting their service connection. Maintenance of service usage
shall be provided throughout the duration of the project.
2.) Cleaning, video inspection and recording, and inspection of existing sewer shall be
conducted prior to installation of the CIPP. Remove all debris, solids, roots, and other
deposits from within the pipe that will interfere with the installation of the CIPP. Provide
a dumpsite for such debris removed during the cleaning operations. Any damage done to
the sewer pipe during cleaning or installation operations shall be the responsibility of the
party performing such work.
3.) The City Engineer shall be notified of line obstructions, offset joints, collapsed pipe, or any
other condition that will prevent the insertion of the tube or significantly reduce the
capacity of the sewer.
4.) Protruding laterals or services (if found) shall be trimmed flush with the inside of the main
sewer wall prior to lining. Trimming shall not cause damage to the lateral or service
beyond the inside face of the twain sewer.
5.) A maintenance of traffic plan shall be submitted to the City Engineer for review and
approval 72 hours before the commencement of CIPP work.
4-3.11 (6) TELEVISIONINSPECTION
1.) Provide television equipment capable of properly documenting the conditions as found
within the pipe in a digital video format (DVD). Lighting for the camera shall illuminate
the entire periphery of the sewer. The camera shall be radial view type capable of viewing
3601 within the pipe and shall provide an unobstructed view of the full pipe.
2.) The video inspection shall begin with a clear identification of the televising location,
upstream and downstream manhole designation, and pipe diameter, The DVDs shall
provide an accurate length measurement of the entire segment and of the distance to each
lateral connection. Pan all lateral connections on both the pre- and post -televising
recording.
3.) Reverse televising set-ups shall be utilized when line obstructions prevent full segment
televising from the initial set-up direction.
4.) Both a pre -lining and post -lining DVD shall be submitted to the City Engineer for approval.
The DVDs shall be clearly and properly labeled. Inspection for individual sewer segments
(manhole to manhole) shall be boolanarked. Pre -lining and Post -lining DVDs and
inspection reports shall be submitted to the City Engineer within seven (7) days of
inspection.

4-3.11 (e) COOL DOWN
Cool down may be accomplished by the introduction of cool water or air into the installation
standpipe to replace water or pressurized air being relieved from the manhole. Cool the
hardened pipe to a temperature below 100' F before relieving the static head. A minimum
period of post -cure shall be maintained under a static head to provide a minimum hoop tension
on the tube felt. Care shall be taken in the release of the static head so that a vacuum will not
be developed.
4-3.11(0 END SEALS
Install hydrophilic end seals to provide a water -tight connection at all pipe and manhole
connections. End Seals shall be installed per manufacturer's recommendations.
4-3.11 W FINISH
1.) The finished lining shall be continuous over the entire length of an insertion run between
two manholes and be as free as commercially practical from visual defects such as foreign
inclusions, dry spots, pinholes, and delamination. The lining shall be homogeneous,
impervious, and free of any leakage from the surrounding ground to the inside of the lined
pipe.
2.) During the warranty .period, any defects which will affect the integrity or strength of the
liner, collect solids, or reduce hydraulic flow capabilities of the product shall be repaired.
4-3.11 0) REINSTATE LATERALS AND SERVICES
1.) Accurate location of the lateral and service connections shall be made by inspection of the
pre -installation video recording.
2.) Upon completion of the main Iine CIPP installation and the approved
infiltration/exfiltration testing, immediately proceed with the reinstatement of the lateral
sewers. Reinstatement of lateral sewers shall be completed within 12 hours of service
disruption.
3.) After the liner has been installed, all existing active lateral sewers and services shall be
reinstated unless otherwise indicated by the City Engineer. The reinstatement of laterals
and services shall be done without excavation. Reinstatement of laterals and services will
be accomplished from the interior of the pipeline by means of a television camera directed
cutting device or by direct personnel entry when feasible. All cut lateral and service
connections shall be brushed to ensure they are free of burrs, frayed edges, or any
restriction preventing free flow of wastewater. Laterals shall be reinstated to a minimum
of 90% of their original diameter and no more than 100% of their minimum diameter. The
CIPP liner shall be tightly sealed at the cut openings with no gaps. All coupons cut from
the liner as a result of reopening the lateral connections shall be retrieved from the sewer
and accounted for.

From time to, time the South Bend Board of Public Works finds it necessary to reject a Ibid because it does
not comply with statutory requirements. In preparing your bid, please use the following checklist in order
to make sure that your bid is done in the proper man,ner.
Proper bid security included. The bidder has the option of providing either a Certified Check
V or Bid Bond.
Bid prepared on the City of South Bend Contractor's Bid for Public Work Form, completely
executed.
Contractor's Non -Collusion and Non-Debairment Affidavit, Certification Regarding Investments
with Iran, Employment Eligibility Verification, Noin-Dis,crimilnation Commitment, and
V Certification of use of United States Steel Products or Foundry Products.
Proof of MBEANBE Participation Goal Form [MWBE-1.0]. If minimum participation goal is not
met, also provide Evidence of Good Faith Efforts Form [MWBE-2.0] and MBE/WBE Contacted
V Form [M,WBE-2.1].
Acknowledge Receipt of 3 Addendum(s) included with the bid.
V All required additional information is included with the bid.
Proposal statements and other affidavits all signed by the proper party with name either
printed or typed underneath signature.

SECTION I EXPERIENCE QUESTIONNAIRE
1. Attach information regarding projects your organization has completed for the period of one (1) year
prior to the date of the current bid.
2. Attach a listing of public works projects currently in process of construction by your organization.
3. Attach information regarding any failure to complete any work awarded to you and the location thereof.
4. Attach references from private firms for which you have performed work.
SECTION 11 PLAN AND EQUIPMENT QUESTIONNAIRE
1. Attach an explanation of your plan or layout for performing proposed work. (Examples could include a
narrative of when you could begin work, complete the project, number of workers, etc. and any other
information which you believe would enable the City of South Bend to consider your bid.)
2. Attach a listing of the names and addresses of all subcontractors (i.e. persons or firms outside your
own firm who have performed part of the work) that you have used on public works projects during the
past five (5) years along with a brief description of the work done by each subcontractor.
3. If you intend to sublet any portion of the work, attach the name and address of each subcontractor,
equipment to be used by the subcontractor, and whether you will require a bond. However, if you are
unable to currently provide a listing, please understand a listing must be provided prior to contract
approval. Until the completion of the proposed project, you are under a continuing obligation to
immediately notify the City of South Bend in the event that you subsequently determine that you will
use a subcontractor on the proposed project.
4. Attach a listing of equipment you have available to use for the proposed project.
We have or have access to all equipment necessary to complete the project
5. Have you entered into contracts or received offers for all materials which substantiate the prices used
in preparing your proposal? If not, attach an explanation for the rationale used which would
corroborate the prices listed.
SECTION III CONTRACTOR'S FINANCIAL STATEMENT
Attachment of bidder's financial statement is mandatory. Any bid submitted without said financial
statement as required by statute shall thereby be rendered invalid. The financial statement provided
hereunder to the City of South Bend awarding the contract must be specific enough in detail so that said
City of South Bend can make a proper determination of the bidder's capability for completing the project if
awarded.
