Mishawaka Ave and 914, 918 S. 21 st Street Zone Map Amendment Bill No. 18-03- Special Exception for Property 915 27th Street Bill No. 18-03- Special Exception for Property 2602 Mishawaka Ave. Committee Chair Oliver Davis called to order the Zoning and Annexation Committee meeting at 4:34 p.m. He introduced members of the Committee and proceeded to give the floor to the presenters. Update- Future Request to Rezone City Owned Properties- Chris Dressel, DCI Chris Dressel, Senior Planner for the Department of Community Investment with offices on the 14th floor of the County-City Building, stated, I am happy to be here to give you a brief update. I am here with Tim Corcoran and we are looking at the petitioning of rezoning properties through the Area Plan Commission next month. 455 County-City Building•227 W.Jefferson Boulevard•South Bend,Indiana 46601 Phone 574-235-9221 •Fax 574-235-9173•TDD 574-235-5567•www.SouthBendIN.gov JENNIFER M.COFFMAN BIANCA L.TIRADO JOSEPH R.MOLNAR CHIEF DEPUTY/DIRECTOR OF DEPUTY/DIRECTOR OF POLICY ORDINANCE VIOLATION CLERK OPERATIONS Tim Corcoran, Director of Planning with offices on the 14th floor of the County-City Building, referenced the picture on the screen (available in the City Clerk's Office). He stated, We have a General Business plot located nearby as well as one (1) single house that still remains on this block. The little bit of blue is a telecom facility. This used to be called Fred's Transmission. We in DCI commonly refer to it as Transmission Block. Dan likes to call it the grassy knoll. Other people have called it the housing block. Right now,the area is completely a parking lot that was used for the VA Center. There is also the old Gates Auto Service center. JPR is nearby as well as other parking lots. The main thing we are looking to do is, as it is all City-owned property, clean up the uses in the area. As you can see, it is a little bit disparate right now. It was rezoned to CBD for the Barehands deal. We are not rezoning the telecom property. We just want to make sure we incentivize the types of projects we would like to see in the area given the Mixed-Use nature across the street as well as heading towards Lafayette. At the moment,there are no particular projects in mind but given the way things are going, we hope this might spur on some ideas. Committeemember Jo M. Broden asked, Are these Redevelopment Commission-owned properties? Mr. Corcoran replied, Yes,that is correct. Committeemember Broden followed up, Where does this fall with regard to assistance or not for the disposition process? Mr. Corcoran replied, We haven't gone forward with the disposition process yet. We will be doing that based on what will be the new appraised value after the rezoning. Bill No. 04-18- 2104, 2108, 2112 E. Mishawaka Ave and 914,918 S. 21st Street Zone Map Amendment Angela Smith, Deputy Director of the Area Plan Commission with offices on the 11th floor of the County-City Building, stated, The petition before you is for the proposed Fire Station on Mishawaka Avenue. It acquired several properties in the area. The ones along Mishawaka Avenue were currently zoned MU,Mixed-Use District,but there were some properties zoned SF-2, Single- Family and Two (2)-Family. In order to look at the project as a cohesive event, they brought the whole thing into a rezone to MU, Mixed-Use District, and are seeking the special exception approval for the Fire Station. The site has currently been cleared and it is a vacant site right now. I will not the petitioner speak a bit more about the site plan for the Fire Station but, in general, it meets the requirements of the MU, Mixed-Use District, the one (1) recently adopted by the Council. There were a couple variations. Primarily to move the building a little bit south so there was enough room for the trucks to exit safely onto Mishawaka Avenue with a clear sight area. This comes to you from the Area Plan Commission with a favorable recommendation. Rezoning the sight to MU, Mixed-Use, will allow a consistent zoning district for a harmonious development of the site. Approval of the special exception use for the Fire Station will allow the City to improve its public safety services to the community. 2 Todd Skwarcan, Assistant Fire Chief for the South Bend Fire Department with offices located at 1222 S. Michigan Street, stated, Thank you, Council, for your continued support of this project. As many of you know, it has been a long time coming. It has been a hard-fought and well-fought collaborative process. We've had many partners in the City and we thank all of them. We are opening bids tomorrow at the Board of Public Works meeting. As has been discussed, a couple main goals of the building were to provide modern facilities for our firefighters. This is a proposed 10,000 square foot facility. Our current station on the Avenue was built in 1926 and is not suitable for a mixed gender workforce not to mention its ability to house modern fire apparatus. The old one (1) only had a single bay so it lacked the ability for us to put other equipment in that facility. With this new structure we will be able to house Engine Nine(9),an ambulance and our boat truck. Immediately to the south of the site, there is a neighbor that wanted to stay in their home. Chief Cox has met personally with that property owner and the neighbor had a couple requests of the City. One (1) being the removal of a tree that was on the southeast of the property and the other was the addition of a white vinyl fence. We are fine with those two (2) concerns and we worked well with that neighbor. Councilmember Dr. David Varner asked, Is 10,000 square feet the new standard? Asst. Chief Skwarcan replied, Not necessarily. It is larger to ensure the housing of our boat and trailer. Councilmember Broden asked, So was that neighbor that remained in their home offered to sell? Asst. Chief Skwarcan replied, Yes and we did enter negotiations. There were there (3) owners of five (5)properties and we did engage in some negations but in the end they were not comfortable with moving. Their offer they received from us was comparable to the other offers we gave. Councilmember Sharon L. McBride asked, What time is the Board of Public Works meeting tomorrow? Asst. Chief Skwarcan replied, That will be tomorrow at 9:30 a.m. on the 13th floor of the County- City Building. Councilmember Broden stated, I would just like to commend all involved with this process. This has been great. Committee Chair Davis then opened the floor to members of the public wishing to speak in favor of or in opposition to the legislation. There were none. He then turned the floor back to the Committee for further comment or main motion. Committeemember Gavin Ferlic made a motion to send Bill No. 04-18 to the full Council with a favorable recommendation. Committeemember Broden seconded the motion which carried unanimously by a voice vote of four(4) ayes. Bill No. 18-03- Special Exception for Property 915 271h Street 3 Committeemember Gavin Ferlic made a motion to continue Bill No. 18-03 to the March 26th, 2018 Common Council meeting. Committeemember Broden seconded the motion which carried unanimously by a voice vote of four(4) ayes. Bill No. 18-03- Special Exception for Property 2602 Mishawaka Ave. Angela Smith, Deputy Director of the Area Plan Commission with offices on the 11 th floor of the County-City Building, stated,The petitioner is seeking a special exception use to allow for a drive- thru window in a LB, Local Business District. The building is proposed to be a Biggby Coffee. The building used to be a bank but the way the ordinance is written they need to seek a special exception because it is in the lower zoning classification for commercial use. This comes to you from the Area Board of Zoning Appeals with a favorable recommendation. Kirk Smith, 325 Enterprise Drive, Breckenridge, MI, stated, This is a pretty straight forward project. It is the repurposing of a bank with a drive-thru window for Biggby Coffee. It is a great use and great neighborhood. Committee Chair Davis then opened the floor to members of the public wishing to speak in favor of or in opposition to this legislation. Dan Buckenmeyer,Director of Business Development with offices on the 14th floor of the County- City Building, stated, I wanted to take the opportunity to share DCI's support behind it. Committee Chair Davis then turned the floor back to the Committee for further comment or main motion. Committeemember Ferlic made a motion to send Bill No. 18-03 to the full Council with a favorable recommendation. Committeemember Broden seconded the motion which carried unanimously by a voice vote of four(4) ayes.
