Upon the advise of City 11,ttOrney, Iden S. Romig, the Board
adopted the following resolution:
"Y.MFREAS there is ro r pending in the T'istrict Court of the
United States for the District of Indiana, Indianapolis Division, as cause in equity e
equity entitled "Postal Telegraph -Cable Company vs. The City of South Bend,
numbered 834 and filed on the 25th., day of September, I924, concerning the
complainantts pole line in City Hall Court in the City of South Bend, Indiana,
and
';"THFFFAS, said cause is set for tr ,. 3 on June 2nd. , I925, and
'11HFRFAS, the Postal Telegraph -Cable Co., has agreed to dismiss
the case without prejudice and nay the court costs,
Now, then, IT IS H'-RFBY RF'SOTV7D by the Board of Public 11',.'orks
of the City of South Bondi, Indiana.,' that, the _o ;der of the Board of Public
Works of the City of S uth B nd, signed by L. B. Slaughter, President, dated
Ray 27th.., 1924, and aadressed to the Postal Telegraph -Cable Co., `'outh Bend,
Indiana, directing the removal of the poles from. City Hall Court, and the like
subsequent orders of June I6th., I924 and June I7th., I924, are hereby rescinded
and revoked and that the company be held to no liability for its failure to
comply wits the terms of said order.
