In the above matters, no remonstrators appeared and no remonstrance
were filed. The Board therefore finds tge benefits to property liable to be as-
sessed for said improvement are equal to the estimated cost of same, and said
resolutions are hereby in all things ratified, confirmed and approved, i

In -"the above matters the Board finds that the benefits to property
liable to be assessed for said improvement are equal to estimated cost of same
and said resolutions are hereby in all things ratified; confirmed and approved.
Date for -receiving, opening and considering sealed proposals fixed
as Way 4, 1926 at 10:00 A.111. Notices thereof were ordered published on the 19th
day of April and on the 26th day of April, 1926.
Hearing had on modification of°contract between t4p,C,ity of South
Bend and the South°Bend Motor Bus Company. (See page 86A for Petition filed 14ar23,I.926)
In the°above matter no remonstrators appeared and no written remon-
strances were filea. The Board therefore declares said resolution, filed"arch

Hearing had on Resolution-�;` 1632 for grade, curb and walk in Lincoln
Park Addition.
In the above matter no remonstrators appeared and no written remon-
strances werefiled. The Board finds that the benefits to property liable to be

fore declares said resolution in all things ratified:, confirmed and approved.
Date set for receiving, opening and considering sealed proposals
as April 27, 1926.
Hearing had on Assessment Roll for Pipe Sewer on Sunnymede Avenue
under Improvement Resolution `1580. Same continued until April 28, 1926,
Engineer filed plans and specifications an, Board adopted the fol-
lowing resolutions:
Improvement Resolution #1637, for widening and paving of Miami
Street from North line of Indiana Avenue to South line of Bowman Street.
Improvement Resolution �`1640, for grade, curb and walk. on 24th
Street from iTcirth line of Jefferson Boulevard to 3iorth line of Washington Ave-
nue. mprovement Resolution 7r164I, for grade, curb and walk on Washing-
ton Avenue fr6m 22nd Street of 24th Street.
Board hereby orders that notices of said resolutions be published
on the 23rd day of April and can the 30th day of April, 1926. Board at its office
in the City Hall at 7:15 2.1,I. on May 129 1926, will hear and receive all persons
interested in or affected by said proceedings.

ment on O'Brien Street, under Improvement Resolution "1573. Boar& signed and
approved same in the amount of �589.19.
City Engineer filed Asuessmeilt Roll for set -back lines on Division
Street, under Condemnation Resolution y-97.
In the above matter, the Board hereby orders that notices of said

"The South Bend Yotor. Bus Company respectfully represents there heretofore,
on January I2th., I92I, O dXnaA87 was passed by the Common Council of the City
of South Bend and approvea by the blyor of said City. That said ordinance ratifi-
ed and confirmed a contract and amendment thereto graihting this petitioner
permission any` authority to operate busses on certain streets in the City of South
Bend. That subsequent to the approval of said ordinance the third route described
in said contract, which ran into the Southeast part of the.City >of South Bend was
abandoned by and with the acquiesence and consent of the municipal authorities
of the City of South Bend, but without formal amendment of the contract or amend-
ment of the ordinance. That subsequent to such abandonment the City of South Bend
through this Board and by ordinance duly adopted, granted permission and authority
to the Chi cagorp South Bend and Northern Indiana Railway Company to maintain and
operate motor busses in said southeast portion of said city. Said petitioner
would fatther.show that police regulations and orders have heretofore been made
requiring the encircling by all busses of the block in said city bibunded by Yaln,
Lafayette and Washington Streets and Jefferson Boulevard. That in conformity with
such orders this petitioner has been for sometime operating its busses around said
block. Said petitioner further reppectfully represents that -the inhanbitants of
that portion of the city bounding Division Street and lying Vest of Olive Street
desire bus service as far west as Iowa. Street on Division Street, and said petition-
er represents that the extension of its Division Street route from its present
Western Terminus at Olive Street to Iowa Street will be a public utility and a
general benefit.
11herefore this petitioner prays that the terms of the :contract now existing
between the petitioner and said city be modified with this petition.

"Resolved by the Board of Public vrks of the City of South Bend, Indiana,
that the following is the exact form of contract which will consid ;red and adopted
in the matter of t_ie petition pf the South Bend Motor Bus Company heretofore filed
praying for the modification of certain provisions of the contract now existing
between said city and said compazW, which existing contract was confirmed and rati-
fied. by ordinance Number 2I37 of said city, approved January I2th., I92I."
CONTRACT.
"This agreement, made and entered into this I4th., day of April 1926, by
and between the City of South Bend by and through its Board of Public Ifforks, herein
Nter called first party, and the South Bend Ij-otor Bus Company, a corporation,
_k ereinafter, called second party, 'r'ITTTESSJTH:
That the consent, permission and authority are hereby given and granted by
firrst party to and vested in second party, its successors and assigns, to operate
its commercial vehicles commonly knoLm as motor busses, for the purpose of carrying
passengers, _or the period hereinafter specified, over the following streets and
routes in the City of South Bend, Indiana.
I. On '°'oath Main Street between Washington and Division Street; on Division
Street between main and Iowa Streets; on Lafayette Street between Division and
Washington Streets; on Washington between Lafayette and Main Streets.
2. On South Main Street between Washington Street and Jefferson Boulevard;
on Jefferson Boulevard between La,in Street and Lafayette; on Lafw,7ette between
idashington and Sample Streets; on West Sample Street between Lafayette and Franklin
Streets; on Franklin Street between Sample Street and Indiana Avenue; on Indiana
Avenue between Franklin and Kemble Avenue; on Kemble Avenue between Indiana and
Ewing Avenues; on 4ashington Street between Lafayette and Main Streets.
Said second party agrees to operate its said vehicles over said streets and
I' routes regularly and in accordance with a regular time schedule adequate to the
I convenience and necessity of the inhabitants of said city; second party further
agrees not to pick up any passengers at intersections of any of said streets with
the Chicago, South Bend and Northern Indiana Railway Company's tracks, except
f at the downtown starting points; second party also agrees to comply with the pro-
visions and regmirements of any ordinance now or hereafter in force in said city

regulating such traffic.
First party further grants the right to second party to erect and maintain
suitable signs along said streets and routes, advertising its stopes and schedules.
I subject to regulation by the Board of Public Works of said City.

No �icense permit or franchise shall be granted by first party to any
person, copartnership or corporation to render a similiar service over the same or
substantially the same routes, during the life of this contract, unless public con-
venience and necessity require such additional service and then ohly after a public
hearing of all parties interested.
This contract shall be operative until January 12th., 1931, and in
addition to such period the said South Bend Motor Bus Company shall have the right
to an additional term of ten years on the same terms and dondttions, provided the
said company performs its part of this agreement in a manner satisfactory to said
City. The right to such additional term shall be exercised by.the said South Bend
motor Bus Company filing i,rritten notice thereof with the said Board of 'Works not
-more than one year nor less than six months prior to January IM., 1931.
This contract shall supercede the existing contract between the -parties
hereto which was ratified and confrimed by an ordinance duly enacted by the Common
Council of said City and approved January 12th., 1921.
This contract shall be in full force and effect from and after its
approval and confirmation by ordinance passed by the Common Council and approved by the
11'ayor of the city.

party has caused its name to be signed hereto and its corporate seal affixed by
its Presidentl duly authorized thereto, the day and year first above written.
