Board met in special session at 7:15 P.TL All members present, Hearing had on Vacation Resolution No. 108 for -the Vacation of Brook In the above matte remonstrators appeared but no written remonstrance was filed. Atty, May representing property -owners and Atty. John Yeagley representing New York Central Railroad Company appeared and resolution modified as follows, -- Commencing at a point 260 feet west of the west line of Miami Street running on the north line of Book Street; thence south crossing Brook Street to the north line of the right of way -of the New Ygrk Central Railway Company; thence west o the liorth line of the New Yo;k Central Railwag right of way and the south line of Brook Street 109 feet to the east line of K:?�eighbaum Park as conveyed to�the City oT-L�outt Bend, Indiana, running thence no rth on the east line of said Park to the port line of Brook Street to the place of beginningg and as modified resolution is in all things ratified, confirmed and approved. u3 The Board now orders that a list or roll be prepared of all owners or holders ofmpropbrty and of valuable interests therein sought to be taken or to be injuriously affected which list or roll shall also describe the property beneficially affected. ` Hearing had on roll of awards of damages and assessments of benefits for the 0ening of Harriett Street from Mishawaka Avenue to North line of Grand Trunk Testers R ilroad Company under Imcation Resolution No. 96. In the above matter no remonstratora appeared and no written remon- strance was filed. The Board therefore declare the above roll filed December 23rd., 1925. Addition under Vacation Resolution No. 103, In the above matter remonstrators appeared and no written remonstrance was filed. The Board therefore declare the above roll filed December 16th., 1925 in all things ratified, confirmed and approved and the proceedings closed. ( S.ee files for copy of roll:) Partial estimate for sewer on King Street from Portage Avenue to a point 100 feet west of the west line of Anderson Avenue, under Improvement Resolution No. 155d allowed to John Lugaresi for the amount of 01,481.81 i - The City Engineer submitted thevlist of property owners -in the matter of t i e appropriation of certain property under Condemnation B.esolution N . 95 for the �ningyof Streets and alleys in Charles Weidlgr's 2nd. A�ditiion and°Studebaker's lace A.1jition, inn Which list includes the names'of the owners and holders of property and its interests therein sought to be taken or beneficially or injuriously affected, and the description of the several pieces•of property which is affected by the said appropriation proceedings. h Thereupon the Board proceeded to award the damages sustained and to assess the benefits accruing to each piece of property upon said list. It was thereupon, upon motion duly made and seconded and unanimously adopted, resolved that said list,.together with the amounts of benefits and damages and net benefits and net damages therein set forth as to the several parcels of land be adopted and that the respective amount of benefits contained in said list be and are hereby assessed against the several tracts of land as specicially set forth in said list and that the respe ctive amounts of damages contained in the said list be and are hereby awarded to the several tracts of land as specicially set forth in said list, and that net benefits or net.damages, as the case may be as to the respective tracts of land, contained in said list are hereby awarded or assessed, as the case may be as to the said several tracts of land. The Board hereby further sets off the benefits and damages each against the other where both benefits and damages are assessed, against the same piece of proper ;tract of land or interests, and hereby fixes the said respective net benefits,as the amount that shall be paid by the respective owners as benefits, and further hereby fixes them respective net damagew as to the several tracts as the amount that shall be paid to the owners of the respective tracts as damages. It was thereupon, upon motion duly made and seconded and'unanimously adopted, resolved that.said list, together with the amounts of benefits and damages and net benefits and net damages therein set forth as to the several parcels of land be adopted and that the respective amounts of benefits contained in s aid list be and are hereby assessed against the several tracts of land as specifically set forth in said list and that the respective amounts of damages contained in the said list be and are hereby awarded to the several tracts of land as specifically set forth in aid list, and that net benefits and net damages, as the case may be as to the respective tracts of land, contained in said list are hereby awarded or assessed, as the case may be as to the said several tracts of land-. Fuchs and Katherine Wundetlich, ( Insert see files for resolutions.). City Controller:- -Please release $100,00 withheld from amount due j Jgbn Lugaresi on contract for laying sewer on Swigart Street from Indiana Avenue to I Railroad. Renewal certificates on following bolds approved: - Harvey L. Hager and The Aetna Casualty and Surety Company. Jacob Hawblitzel and The Aetna Casualty and Surety Company Reliable Plumbing and heating Co. and The Aetna Caslsiity Co, Louis S. Niezgodski and American Surety Company of New York. Arthur V. I.1reyers and Masschusetts Bonding & Insurance Co, Comm Communication received fromW. D. Teeple in re Street Department and Engineering Department garage. ( Insert see files.) Approved.
