SPECIAL MEETING--"FEBRUARY 11, 1941
A special meeting of the Board of Works and Safety was called for the "purpose of
offering certain street car rails for sale at auction basis and on the conditions as
set forth in the regular meeting of.the.Board cn Monday, February loth, 1941,
The special meeting was called to order at 10*00 A. M. and after Mr. Samuel Fiewell,
Attorney for J. D. Gross, one of the bidders, whose bids of February 10th had been
rejected, made a statement of protest to the Board, which protest, as made, was reject-
ed b the Board, and the Board offered the rails for sale, reserving for itself, the
righ to reject all bids.
The two bidders, J. D. Gross and the Hurwich'Iron Co., deposited certified checks
in the amount of 015n0.00 each with the Board before the bids were taken. Thereafter,
the rails were offered and the bids were made as follows:
Rails already taken up by the City, amounting to about seven ton,'now stored at
f714 Niles Ave., to be picked up by the purchaser at this location.

The Board in closing the bids on each classification, indicated it would state its
decision as to the acceptance of each such bid, after further consideration.
When the bidding closed., the Board then conferred and determined to accept bids
as follows:

Rails already taken up by the City and stored on Niles Ave. 21.00
Proposal ##5 14,50
These are the bids of Mr. Samuel Hurwich.
The Board upon the request of Samuel Fie:vell, Attorney, the certified check de-
posited by J. D. Gross, in the amount of $1500.00 was returned to the said attorney.
The check of the Hurwich Iron Co., was,retained in the possession and custody of Harry
Driggs, City Controller.
There being no further business to come before the Board, the meeting adjourned at
12:40 P. M.

pertaining to his department were discussed.

The Engineering Department reported that the grade had been established

Country
Club Lane in the Morris Country Club Addition.
An excavation bond in the amount of $1000.00 was received for

DEDICATION
Whereas the following described plat with dedication of streets
and alleys
indicat-
ed thereon, is now presented to the Board:
The plat of Belleville Gardens, an addition to the City of South
Bend, has
been
approved by the Board of Works of the City of South Bend, Indiana,
on the 15th
day of
April 1940 and was recorded on Record #14, Page B, in the records
of St. Joseph
County,
.
State`of Indiana, on the 22nd day of April 1940.
Block lettered F in said addition has been subdivided into 26 lots, numbered 128
to 153 inclusive. The set back line on Evergreen Lane and Lombardy Drive, with re-
ference to lots 128 and 153 inclusive, shall not be less than 30 feet from the front
property line to the main wall of dwellings erected thereon; the set back line on
Sample Street, with reference'to lots 140 and 141, shall not be less than 10 feet from
• the South line of Sample Street to the main wall of dwellings erected thereon; the set
back line on I+iedow Lane, with reference to lots 128 and 153, shall not be less than
10 feet from the North line of Meadow Lane to the main wall of dwellings erected thereon
all -of which is indicated on the plat.
The following easements, as indicated on the plat, are hereby dedicated for use of
gas mains, electric light and power, telephone and other public utility wires and lines;
A strip of land 8 feet in width, the center line of which is the East boundry line
of lots 141 to 153 inclusive in Block F, and the West boundary line of lots 128 to 140
incluisive in Block F, extending from the South line of Sample Street to the North
line of Meadow Lane.
• A strip of land 8 feet in width, the center line of ifnich is the South boundary
of lots 139 and 142 in Block F and the North boundary of lots 138 and 143 in Block F,
extending from the East line of Evergreen Lane to the Jest line of Lombardy Drive.
The streets in said Block F, as indicated on the plat, are hereby dedicated to the
public for public use.
IN NITNESS -7JHEREGF, Garden Homes, Incorporated, owners of the above described real
estate, has caused this instrument of dedication to be executed in its corporate name
by its President, and its corporate seal to be hereto attached, attested by its
Secretary, this 19th day of February, 1941.

ELECTRIC DEPARTME11T: A petition asking for a street light at the corner of St. Joseph
and Ewing Ave., was turned over to the ElectPic Superintendent, Mr. Qualls for investi-
gation and report.
TRAFFIC C0111ISSION: Mr. eons of the American Trust Co., appeared before the Board to
scuss .e matterf of moving the large clock in front of the bank, on the northwest
corner of Michigan and Washington Sts. fir. Emmons advised the Board the bank had made
arrangements to have the clock moved and the work would be taken care of as rapidly
as possible.
There being no further business to come before the Board, the meeting adjourned at

STREET DEPARTT,LENT: On motion duly made and seconded, the following resolution was
adopted, that Poor. Willi arms, City Engineer and IrIr. Z::iudzins'ki, Street Commissioner, be
authorized to examine into the cost of -iurchasing a suitable boiler for the asphalt
plant, and be authorized on agreement to make such purchase.
Mr. Zmudzinski presented the report of the Street Department from February 1, 1941
to February 28, 1941, which report was ordered filed.
Mr. Zmudzinski turned over to the Board $1.0.24 received from the sale of scrap it
It was the decision of the Board that Mr. Herman Glaser be authorized to repair
