A regular meeting of the Board:of Public Works was held on Monday, Dece-mber 4, 1939
at 9:00 A.M. All members were present. Minutes of the previous regular.meeting and of
the special meeting held on November 28, 1939, were read and approved. Claims of the
following suppliers in the amount of $614.60 were approved and ordered paid:

STREET LIGHTING: A petition for
a street
light at the corner of Wall and
35th Streets
was received by the Board and referred
to
Mr. walls for investigation and
report,
An excavation bond for J. B. Fleck & Sons as principal and Eagle Indemnity Company
as surety was approved by the Board.
Due to inability to obtain ff.P.A. payrolls, the "oard authorized trahsit,payable ou
of the Special W.P.A. Fund, to Indianapolis for C. E. Williams, December 1 and 2, 1939,
to contact the State W.P.A. Auditor and obtain a release of future payrolls so that the
amount of $6.75 fund due the city from the Trustee can be calculated.
f The engineer reported that a satisfactory arrangement had been worked out on this
trip.
A contract was entered into between the Board of Public "dorks and Alex S. Langel,
Portage Township Trustee for the contribution by the Trustee of $6.75 per man per month
for each man employed on W.P.A. projects sponsored by the city who is taken from the
relief rolls of Portage Township, said contract to begin January 1, 1940 and terminate
December 31, 1940. The contract is as follows:

To YI-SHIP, OF ST. JOSEPH COUNTY, STATE OF INDIANA.
THIS AGREEMENT entered into this 4th day of December, 1939, by and between the Boar
of Public 01orks and Safety of the municipal city of South Bend, Indiana, for and on be-
half of said municipal City, and hereinafter referred to as Party of the first part, and
Portage Township, St. Joseph County, Indiana, hereinafter referred to as Party of the
second part, WITNESSETH, That:
• �yWHEREAS, the party of the first part is now the sponsor of projects now filed with
the orks ProgressAaministration, and by them approved, and may become sponsor of other
projects not yet approved, which projects contemplate the resurfacing, regraveling and
relaying of certain streets, alleys and sidewalks, the construction and reconstruction
of certain sewers and drainage projects, filing and classifying of records and other pro
jects, in all methods and manner approved or to be approved by the municipal city of
South Bend and the Federal Government, and
WHEREAS, the projects are or will be of such a large character that they can be mad
to furnish employment for a large number of citizens of South Bend and Portage Township,
providing; funds are available to pay the sponsor's share of certain ;projects in the form
• of materials, tools and equipment necessary to induce the Works Progress Administration
of the Federal Government to provide for the payment of the payrolls, and
79EREAS, the party of the first part is unable to pay the amount necessary to pro
vide for the employment of sufficient men to properly carry out said projects, and
WHEREAS, it is found expedient and desirable to contract with the party of the
second part for the purpose of obtaining men to work upon said projects, for which pur-
pose the second party shall pay the sponsor e consideration hereinafter set forth for
each man so employed upon said projects, and for the further purpose that said party of
the second part may find employment for a large number of people now on relief in Porta
Township, and
`fFHEREAS, the second party now has on direct relief in Portage Township, Indiana,
approximately 802 employable men who can be transferred and put to work upon the above
mentioned projects, and thereby be taken from the direct relief rolls of:said Township,
and
WIMREAS, all of the projects being sponsored by the City of South Bend, Indiana,
and all of the work done b, the men taken from the relief rolls of Portage Township, on
said projects will be performed within the boundaries of Portage Township, St. Joseph
County, Indiana, and
NHEREAS, it is the desire of both parties to this contract that the respective ob-
ligations of each party shall be strictly set forth,
IT IS, THEREFORE, MUTUALLY AGREED:
1. That the party of the second part shall become a contributor to the sponsorts
share of the projects being performed by the Works Progress Adminstration, and being
sponsored by the municipal city of South Bend, and in consideration of said party of the
second part becoming a contributor to said sponsorts share of the projects, the party of
the first part agrees that said first party shall:
A. Furnish the equipment now owned by the city of South Bend and necessary to the
earring on of the details of said projects.
B. Furnish the engineering, supervision and other necessary information to Jay out
the particular work for the employees.
C. To furnish on the projects above described materials to the arl-ount of the-balanc
appropriated in the 1940 budget of the municipal city of South Bend for storks Progress
Administration projects, including the amount ebb be furnished by the second party under
the terms of this contract.
Party of the second part agrees that in consideration of the employment of such menl
as he may certify to said projects, from relief rolls of said`i'olvnship, that he �Pri ll furn sh
money for the purchase of materials, tools, equipment and anything else necessary to
provide the sponsorts share of said projects, in an amount equivalent to $6.75 per month
per man so certified by him, and employed on said projects as herein set forth.
It is mutually agreed that the amount of money for materials, equipment, tools and
other -supplies to be furnished by the part= of the second part shall be limited to' and
in direct line with the number of employees furnished to said projects and used thereon
by authority of the party of the second part, at the rate specified above.
It is a greed that a monthly audit of employees of the Works Progress Administra-
tion, who have been taken from the relief rolls of Portage Township, shall be made under
the direction of the first party and that money due to said first party by reason of the
amount shown in said audit and verified by the second party, shall be due and payable on
the tenth of the month following a submission_ cf a verified statement to the second part;.
It is agreed that this contract for and on behalf of said Board of Public Works and
Safety acting for and on behalf of the municipal city of South Bend, shall be subject to
and dependent upon the ratification of the Common Council of the municipal city of South
Bend, and by the Advisory Board of Portage Township, St. Joseph County, Indiana.
The duration of this contract is based upon a continuance by the Works Progress
Administration along the lines and upon the plans now in operation at the time of this
contract.
Party of the second part reserves the right to cancel or change this contract if a
when the present Works Progress Administration set-up is modified or changed, and in no
event shall this contract continue beyond December 31st, 1940. This contract shall be
in full force and effect subject to the exceptions herein provided, from and after
January lst, 1940.
This agreement executed by and between the parties this 4th day of December, 1939.

MEETING -- DECEIVIBER 11, 1939
The Clerk of the Board reported that he had received bids from three companies for
a stoker for the Electrical Department and that the, b-id of Sari Berman of 292.50 was the
lowest and best bid. A motion was made, seconded and unanimously carried that one #D60
Conco Stoker completely installed be purchased from Sara. Berman at the quoted price of
$292.50, the electric wiring and pit construction being done by the electrical departmer
On motion duly made, seconded and unanimously carried the Board authorized the
purchase and installation of the following scale; for the Weights & Measures Department!
One code #12202 twenty ton Fairbanks Morse Truck Scale, type R, for platform
thirty-four feet by ten feet (341x10 t ), equipped for dial-printomatic.
One C-25 Fairbanks dial, graduation fifty thousand lbs. by ten lbs.; double face
for dial; equipment for printomatic; one lot of steel for concrete deck construe-
tion; six feet of added extension levers; one set of blueprints showing extention;
The lever system for the scale will be set by the City E gineer, Scale Inspector
and A. L. Henson, dial to be installed by Fairbanks -horse Scae Engineer at regular
F-Iff rates. The City Engineer will advise exact amount of extenbion needed. This ex-
tension to be charged for at $4.08 per foot (minimum charge $16.32 for first four feet
or less) _The price of this scale is $1293.68 less credit by old scale traded in of $75.
or $1218 68.

STREET DEPARTMENT: Anton Zmudzinski was present and matters pertaining to his d
were discussed.,
Mr. Zm.udzinski reported that the Street Departua?ent had discontinued use of the
Raniewski d-unip as of today.
