SPECIAL MEETING--OCTOBER 14, 1939
A special meeting of the Board of Public Works was held gt 9.-00 A.M. on Saturday,
October 1.4, 1939, for the purpose of examining proposed types of bede'to be used in
collection of garbage under the contract entered into on the 18th day of August, 1939,
with Victor W. DeFrees.
The contractor submitted diagrams and cuts of Marion Steel Refuse Bodies manufac-
tured by the Marion Metal Products Company of Marion, Ohio. After due consideration,
the Board approved this body as being satisfactory under the terms of the contract and
and specifications of said contract of August 182 1939.
The purpose of the meeting having been accomplished, the meeting adjourned at
9 :30 A.M.

The Board of `dorks received the following petitions and communications which were
referred to it by the Common Council of South Bend relative to proposed changes of
• schedules of the N rthern Indiana Railway Company, Inc., to -wit: from Dr. G. H. dross,
Secretary of the River Park Business miens Association; the Fifth District Democratic
& Civic Club; nineteen members of Post 50 and Auxiliary Post 50 American Lel3ion, and
United Automobile Workers of America, Local No. 5. The resolutions will be taken into
consideration at the time of any negotiations or conferences with the northern Indiana
Railway, Inc. relative to schedules. el
A letter was received from the United Automobile Workers of America, Local No. 51
relative to the condition of the sidewalk on SouthFranklin Street south of the railroad
between Broadway and Indiana Avenue in front of the old Russ Blueing Company factory.
The matter was referred to the Street Department for investigation and report.
• The Board approved the plan for proposed driveway on South Main Street to Sears,
Roebuck & Company parking lot, subject to the recommendations of the Traffic Engineer.
A duplicate plan shall be prepared and filed with the Engineering Department in making
request for permit.
The following contract between the City of South Bend by its Board of public Works
and the St. Joseph Heating Company was entered into for the heating of the City Hall
after January 1, 1940:
CONTRACT FOR STEAM HEATING
THIS AGREEMENT, made at South Bend, Indiana, this 16th day of Gctober, 1939" by and
between the ST. JOSEPH DATING COMPANY, party of the first part, hereinafter called the
Company, and BOARD OF PUBLIC ORKS, CITY OF SOUTH BEND of SouthBend, Indiana, party of
the second part, hereinafter called the Purchaser.
For and in consideration of mutual covenants herein contained, the parties hereto
agree that, provided the Purchaser shall observe the provisions of this agreement, the
Company will furnish steam, during the heating season of each year at the service valve
located on the Purchaser's premises at 214 N. Fain Street for a period of one.year from
the date of first delivery of steam hereunder, and thereafter fox' periods of one year,
until receipt by either party, from the other of thirty days written notice to discon-
tinue service, and the Purchaser agrees to take and pay for monthly, during such heating
season, all the steam that he may require for heating purposes during said heating
season, which begins the first day of October, or earlier, as the weather may demand,
and continues until the first day of June, or later, as the weather may demand, at the
regular rates per thousand pounds of condensation, as shown on the back of'this agreemen
and cn file at -the office of the Company, PROVIDED HOWEVER:
The Purchaser agrees to pay the Company each of the eight months from October 1st
to June lst a sum not less than Thirty-seven and 92/100 Dollars ($37.92) per month.
No obligation shall rest on the Company to furnish steam continuously throughout th
entire twelve months of the year; this contract contemplates the furnishing of steam onl
during the heaving season described above.
From the curb the Purchaser shall install and maintain his own heaving system, ac�1
cording to the Rules and Regulations of the Company. The Company will, however, cbnstru(�t
for and charge the Purchaser such portion of the service as extends from the curb to thell
inside wall of the basement, which charge must be paid before delivery of steam. ii
The Company will place a meter, as provided in the Rules and Regulations, which is
accepted as the standard of measurement and charge under this contract, t#e ownership of
which shall remain with the Company.
It is agreed that should the supply of steam be interrupted by strike, accident or
any other reason beyond the control of the Company, the P,rchaser will not hold the Com
parry liable for any damages arising from the failure of the Company to supply steam.
The Company reserves the right to at any time discontinue service for non-payment
of bills when due or violation of the Rules and Regulations. Such discontinuance shall
not invalidate any of the covenants of the Purchaser.
It is agreed that the Company, or its agent, shall have access to the premises of
the Purchaser at all reasonable and proper hours to inspect the meter and other heating
apparatus, as permitted by the Rules and Regulations.
As p part of the consideration for making this agreement and by affixing their sig-
natures thereto, the parties mutually agree that each and all of the Rules and Regula-
tions and Rates printed on the back hereof are g part of this agreement, the same as if
written in the body of it, and shall at all times be read and construed as a part of
this agreement.
This agreement, although signed, is subject to the approval of the Vice -President o
General Manager of the Company, and shall not be binding upon the Co-^pany until endorsed
with his approval and, as approved shall constitute a ccntract which shall not be varied
or waived by representations or promises of any agent, solicitor or other person.

its Board of Public Works and Safety and Leo P Rieder:

THIS AGREEMENT, made and entered into at the City of South Bend, Indiana, this 16th
day of October, 1939, by and between Leo P. Rieder, of the City of SouthBend, St.Joseph
County, State of Indiana, hereinafter referred to as the Lessor, and the Civil City of
SouthBend, Indiana, by and through its Board of PublieWorks and Safety, hereinafter re-
ferred to as the Lessee, WITNESSETH:
That -the lessor has this day leased and rented to the lessee for a term of six
months beginning with the first day of October, 1930, and ending -with the first day of
April, 1940, the following described real estate in the City of SouthBend, St.Joseph
County, State of Indiana, to -wit:

Beginning at the easterly line of Niles Avenue in the City of
South Bend at a point distant north 18 degrees west 577 feet from
the point of intersection of the easterly line of said Niles Avenue`
with the"northerly boundary of Crescent Avenue in the City of South
Bend; -thence easterly at right angles with Niles Avenue north 72
degrees east 382 feet more or less to the west line of a 14 foot
alley on the west side of Cedar Heights Addition to the City of
South Bend; thence north with the west line of said a11e y to a point
150 feet south of the south line of Corby Street; thence west on a
line parallel with Corby Street to a point 200 feet east of the west
• line of Niles Avenue; thence south parallel with the east line of
Niles Avenue a distance of 350 feet; thence west at right angles with
said line to the east line of Niles Avenue a distance of 200 feet;
thence southerly along the east line of Niles Avenue to the place of
beginning, located in Section 1, Township #37 North, Range #2 East.

The said lessee agrees to pay as rent for said real estate for said period the sum
of Twelve Hundred Dollars ($1200.00) in manner following: Two Hundred Dollars ( 200.00)
Der month on the first day of each and every calendar month beginning on October 1,1939.
The lessee shall use said premises for the purpose of crushing brick, mixing -gravel
storing materials and for any and all other purposes it may so desire. To this end, it
may construct at its own expense sheds, repair shops and hoppers or any other buildings
it so desires and may likewise construct and run a railroad siding onto the seal demised
premises.
The lessor shall not be liable for injuries or damages suffered by any one by reaso:
of anything which might occur on the premmises or by reason of any of the acts of the
lessee, its agents or assigns.
It is further agreed by and between the lessor and lessee that as a part of the con
sideration of this lease the lessor hereby grants and gives to the lessee the right and
option to renew this lease for a like period of six m>nths beginning at the expiration
of the six months herein granted and the further right, privilege and authority to renew
the said lease for six month periods at the end of the 12th and 18th and 24th months, bu
in no event shall the lease and its options cover a period from the date of this lease is
excess of thirty (30) calendar months, all of which shall run consecutively. All of
the said options herein extended shall be under the same terms and conditions as con-
tained in the first six month period herein granted. Notice of the exercise of option
to renew as herein granted must be given in writing to the less or on or before thirty
( 30) days from the expiration of the first six month period and on or before thirty (30)
days from the expiration of all option renewal periods.
In 'fitness 1lihereof, the parties to this agreement have hereunto set their hands and
seals the day and date above first written.

Lessee
The above lease covers a tract of land on Niles Avenue known as the "Abandoned Hoff-
man Gravel Pit" and the property was leased for the purpose of storing materials used by
• N.P.A. at the cost of $200.00 per month. The lease was entered into for a period of six
months with an option to extend the sane upon the city giving thirty days written notice;
STREET DEPARTMENT: Mr. Zmudzinski was present and matters pertaining to his department
were aiscussed. Mr. Zmudzinski reported that one of the W.P.A. employees was involved iz
an accident causing, considerable damage to one of the trucks used for N.P.A. purposes.
Meeting adjourned at 12:00 Noon.
