Regular meeting of the Board of PL1blic Works was held on Monday, July 31, 1939, at
9:00 A.M. All members were present. Minutes of the previous meeting were read and ap-
proved. Bayrolls of the Street, Sewer and Cemetery Departments in the amount of
�8,632.75 and claims of the following suppliers in the amount of $3,262.46 were approve(

• This being the date set for public hearing of IIrTPROVEI1iENT RESOLUTION NO. 2502, and
there being no remonstrators or objectors to said resolution, the same is now adopted
without amendment. TheEngineer filed estimates and the clerk is instructed to advertis
for bids to be received at 10:00 A.I,.I. on August 14, 1939, which advertisements shall ru
in the South Bend Tribune on the 2nd and 8th days of August, 1939.

The following letter was received from Stanley Piers relative to the Garbage Con-
tract, which was awarded to him on July 26, 1939:

The contract for garbage having been already let to Stanley Piers and he having
failed to comply by procuring bond and being unable to procure bond, as indicated by
the above letter, theClerk of the Board is authorized to re -advertise for bids on the
garbage contract in accordance with specifications adopted by this Board on July 3,1939
said publication to be made in the South Bend Tribune on the lst and 8th days of August
1939, respectively, bids to be received at 9:00 o'clock, A.M. on the 14th day of August
1939.
The Board instructed the City Controller to surrender the $500.00 check upon pay
went of 925.00 by 11,1r. Piers tp pay for the cost of advertising occasioned by his failur
to s7ure proper bond.
The Board approved plans submitted by Harry Barnes, Contractor, for the Reliance
Mortgage and Finance Company. The plan is for a proposed driveway for the property at
the northeast corner of I.Tain Street and Western Avenue.
/The Plat of Dixie Grove Subdivision, having been approved by the City Plan Corm.is-
sion, was referred to the Board by Harry H. Vogler, representing Chas. W. Cole. Upon
motion duly carried, the plat was approved. This plat comprises and is described as
follows:
DEDICATION OF PLAT
Dixie Grove Subdivision is laid out on the following described real estate situate
in St. Joseph County, in the State of Indiana, to -wit:
Beginning 6n the South line of the Northeast Quarter of the Northwest Quarter
of Section No. 24, Township No. 38 North, Range No. 2 East, at a point 669.24
feet East of the West line of the East one-half of the Northwest Quarter of
said Secticn No. 24; thence North parallel with the alest line of the East one-
half of the Northwest Quarter of said Section 24, 1,128.9 feet, which point is
194.9 feet South of the North line of said Section No. 24; thence East parallel
with the North line of said Section No. 24,.669.95 feet to the North and South
center line of said Section No. 24; thence south along the North and South
center line of said Section Into. 24, 1,127.57 feet to the South line of the North-
east Quarter of the Northwest quarter of said Section No. 24; thence West along
the South line of the Northeast Quarter of the northwest Quarter of Section 24;
669.0 feet to the place of beginning,
The lots in said subdivision are numbered from 1 to 56 inclusive.
An easement is reserved over the rear four feet of each of said lots for the use
of public utilities.
The set back line shall be not less than 25 feet as indicated on the plat.
The streets ins aid addition, as indicated on the plat, are hereby dedicated to
the public for public use.

A letter was received from Mr. Smith, Recr. of the Northern Indiana Railway Compan
together with a copy of a letter from Mr. 01aterson to Mr. Smith relative to the extensi
of South 1.1ichigan Street busline to Kern Road. The Clerk of the Board was instructed
to send a copy of both letters to Mr. Wilford Walz, who represents the petitioners.
Copies of the letters are as follows:

"Dear i-,Tr. Williams:
"I acknowledge the receipt of your letter of the 22nd instant relative
to a petition for the extension of the South Michigan Street but service to
the Kern Road.
"As soon as I received your letter I requested Mr. 01aterson to make a
survey of this territory and I are enclosing herewith a copy of his reply which
is self explematory.
"To comply with the request of the petitions would dean an investment in
new buses of practically Y15,000.00. The territory is so thinly populated
that the revenue derived from the extension would not begin to pay the cost
of the operators' wages alone, to say nothing of the other costs of operation
and the interest on the investment required to furnisht he service.
"Under the circumstances, I do not feel I would be justified in recommending
the extension to the court having jurisdiction of the property.

"With reference to extension of bus line from South I,iichigan Street.
"A survey shows that it is four -fifths of a mile fron Donmoyer Street to
the south city limits of South Bend. It is two miles from the city limits to
Kern Road. This would mean an extension of two and four -fifths miles to pro-
vide service to that point.
"From a distance beyond three short blocks south of Donmoyer Street, to
which point our present operation gives good service, there are ten houses
located west of T:Iichigan Street to the city limits. There are sixteen houses
located east of 1-ilichigan Street. With one exception these homes are all
located on 1ichigan Street.
"Therefore, you can readily see that there would not be a sufficient
population to 4ustify any extension of this line.

STREET LIGHTING:: A petition for a street light at the intersection of Dubail and
Catalpa was received and referred to the Electrical Department for investigation and
report.
STREET DEPARTI1ENT: Mr -.Zrntdzln:ski was present and matters pertaining to his department
were discussed.
ENGINEERING DEPARTMENT:
petition was received by the Board for the pavement of Leon Court from Catalpa
Avenue to Kemble Avenue with' concrete at a cost of .1.34 per front foot. This petition
was referred to the Engineering Department for the preparation of plans and specificatio
. CEMETERY DEPARTTIEIdT: tir. McNabb was present and matters pertaining to his department
were discussed.
Contractor's bond of William Huffine with Colim.bia Casualty Company as surety was
approved and ordered filed.

This agreement made and entered into by and between Reed Brothers of the City of
Mishawaka, Indiana, by and through I. C. Reed, as party of the first part,

of the second part, Witnesseth:
"Whereas, party of the first part is the owner of certain articles of road construc-
tion equipment, more particularly hereinafter described, and desires to rent same
to second party for use in road construction work, and,
Whereas, party of the second part being engaged in certain road construction work
within the City of SouthBend, Indiana, desires to lease said equipment,
Now, Therefore, it is stipulated and agreed that first party will lease to second
party the following described road construction equipment for which second party
• will pay to first party monthly rental as hereinafter stipulated, the equipment
being described as follows, together with the agreed rental, to -wit:
