SPECIAL MEETING--JUNE 8, 1939--Continued
NOW, THEREFORE,, BE IT RESOLVED, that pursuant to the statutes of Indiana in such
cases made and provided, said Board of Public Works and Safety does now affix the time
at which said contract shall be finally adopted as the 26th day of June, 1939, at the
hour of la:00 A.M. at the office of the Board of Public Works and Safety at the City
Hall in the city of South Bend, Indiana, at which time and place'a public hearing shall
be had, and any taxpaver in the city may appear and file protest against any or all of
the p ovisions of said contract*
BBE IT FURTHER RESOLVED That Raymond R. Smith, Receiver for the Northern India
na
Railway, Inc., at their own expense, shall cause a full and complete text of said con-
tract to be published as required by law with notice of the time and place of said
hearing in the South Bend Tribune, a newspaper of general eircuilation printed in. the
English`°` -language in the city of South Bend, Indiana; said notice to be published once
at least one week prior to June 26, 1939, and said R. H. Smith, Receiver of Northern
Indiana Railway, Inc. and Northern Indiana Railway, Inc. shall likewise past a copy of
said contract and notice of said time and place of said hearing in ten public places in
the city of South Bend, Indiana.

This being the date set for public hearing of a proposed contract between the City
of South Bend and the Chicago, South Shore and South Bend Railroad for authority to
construct a spur track crossing the westerly and of an alley north of and parallel to
Colfax Avenue at its intersection with the southerly end of LaSalle Court, and Chicago,
South Shore andSouth Bend Railroad having filed proof of publication of notice of said
hearing in the South Bend Tribune on the 1st day of June and the South Bend Ifirror on
the 2nd day of June, 1939, and having filed further proof of posting of said notice in
tan public places in the city of SouthBend on the 2nd day of June, 1939, and the matter
• now being set for hearing and no citizens appearing and no remonstrates having been
filed against any provisions of said contract, it is now moved, seconded and duly carriE
that said contract be entered into in the form proposed on the 29th day of May, 1939,

SOUTH BEND, INDIANA.. DIRECTING EXECUTION OF C ONTRACT ';KITH CHICAGO
SOUTH SHORE AND SOUTH BEND RAILROAD
WHEREAS, on the 29th day of May, 1939, the Board of Public (forks and Safety of the
City of South Bend, in St. Joseph County, Indiana, at a meeting of said Board of Public
Works and Safety, did determine the exact form in which a franchise, grant`dhd contract.
to and with Chicago South Shore and South Bend Railroad, to locate, construct, maintain
and operate an industrial spur railroad track across an a lley in said City,. was to be
finally adopted, and fixed the 19th day of June, 1939, at the hour of nine'ofelock,A.M.
at the regular meeting 'place of said Board of. Public Works and Safety in the _ Cit#` Hall
in said City of South Bend as the time and place at which said franchise, grant azd •
contract was to be finally considered by said Board of PublieWorks and Safety; and
AREAS, proof of publication of the full and complete text of the said proposed
franchise, grant and contract in the South Bend Tribune, on the lst day of June, 1939,
and in the South Bend Mirror on the 2nd,day of June, 1939, being two newspapers of gener
al circulation printed in the English language insaid City of South Bend, St.Joseph
County, Indiana, and proof of the posting of notice of the full and complete text of
said proposed franchise, grant and contract in more than ten public places within the
said City of South Bend, on the 2nd day of June, 1939, have been duly made, and all the
terms and provisions of the statutes of the State of Indiana have been fully complied
with; and
WHEREAS, at this meeting of the Board of Public Works and Safety of the City of •
South Bend, held on the 19th day of June, 1939, cor encing at the hour of nine o'clock,
A.M., a public hearing was had on said franchise, grant and.contract; and no taxpayer
of the City of South Bend has appeared and filed protest against any of the provisions
of said franchise, grant and contract; 9
IT IS THEREFORE, now on motion made and seconded,
RESOLVED, that the Board of Public Works and Safety of the City of South Bend, now
enter into, make and execute the said franchise, grant and contract to and with the
Chicago South Shore and South Bend Railroad in the manner and form proposed by this
Board of Public Works and Safety at its meeting on the 29th day of May, 1939, as it ap-
pears in the records of said meeting.
Adopted this-19th day of. June, 1939.

vThe following deed was accepted and was recorded in accordance with t he minutes of
the meeting of February 6, 1939;
✓Deed of George F. Goss and Zora B. Goss, husband and wife to the City of SouthBend
for the following described real estate: to -wit:
Twenty-seven (27) feet off e.f and from the entire east end of a
tract of land described as follows:
A tract or parcel of land bounded by a line running as follows: •
viz Beginning at a point in the North and South center line of
Section numbered Thirty-three (33) Township Numbered Thirty-eight
(38) North of Range Numbered Two (2) East, distant South Nineteen
Hundred and Sixteen (1916) feet from'a stone in the cebter of said
Section, thence East Six Hundred and Twenty-seven (627) feet, -
thence South Eighty-nine (89) feet, thence West Six Hundred and
Twenty-seven (627) feet to said North and South center line of said
Section Numbered Thirty-three (33), thence North Eighty-nine (89)
feet to the place of beginning, containing one and one-fourth (14)
acres, more or less.
The above conveyance is made for the purpose of widening of Illinois •
Street in the City of South Bend, Indiana.
which Quit -Claim Deed was recorded in Book No. 312 at page 222 and is Document No.62569
in the Records of the Recorder of St.Joseph County, Indiana, and is Document No.. 712 in
the Records of the Board of P,,blic Works and Safety of the city of South Bend, Indiana.
/Jarvis L. Gamble of 214 W. Navarre Street presented a claim to the Board of Public
Works for damages resulting from alleged defect in sidewalk and curb at 307 South
Franklin Street. The matter was referred to the City Attorney.
STREET LIGHTING: Mr. Qualls was present and matters pertaining to his department were � •
discussezi. Mr. Qualls was instructed to prepare an analysis of the street lighting
system and also to assemble information needed in advertising for bids on t he contract

CEMETERY DEPARTMENT: Lisle F. McNabb was present and_was_authorized to attend a
convention at Lafayette, Indiana, on the 28th day of Junes 1939. Matters pertaining
to his department were discussed.
REPAIRS TO FIRE DEPARTid:ENT: Chief DeVleeschower was present and was requested to make up
total bids for repairs on each individual station on work.required on each station to be
made up in separate estimates and submitted to the Board.
STREET DEPARTMENT: Mr. Zmudzinski was present and matters pertaining to his department
were discussed. Mr. Zmudzinski reported that his department was having much difficulty
cleaning streets because of the number of cars parked on the streets after midnight. He
requested the Board to ask the Police Department to more strictly enforce the ordinance
provided.This matter will be referred to the Police Department.
Mr. Zmudzinski also reported that a 1927 Fordson tractor, Motor No. 2420 kad been
junked because the block was cracked beyond repair. The wheels were used for the
Gilliam grader and the balance of the tractor was sold for junk for $7.50 to J.K.Ellis
and a check for that amount was turned over to the Clerk of theBoard.
Mr. Zmudzinski was authorized to purchase an air compressor for $100.00.
Mr. Zmudzinski turned over to the Board $402.50 received from the sale of oil for
oiling streets, which was turned over to theController to pay ffr the oil.
TheBoard approved a plan for driveway for the Superior Laundry on Lincoln Nay West
as submitted by Mr. Roy. Eger, representing the Asphalt Products Company, the contracting
company which will do the work.

ficate on Contractorts bond of McVittie H. Kerr wawere approved and ordered filed.
/ Continuation Certificate on Franchise Bond of Indiana Bell Telephone Company was
received, apt oved and ordered filed.
