All members were present. Minutes of the previous meeting were -read and approved and payroll of the Street Department in the amount "' of was approved. Claim of L. Van Paris in the amount of $225.00 was Approved and ordered paid. ,/ Mr. Smith and Mr. Waterson of the Northern Inc�i;ana Railway Company, Inc. appeared � before the Board and presented an agreement for the substitution of -buses for street- cars on the South Michigan Street line. This agreement was taken under consideration. j '/A group of property owners on West Sample Street in the vicinity of the 3000 bloek� and the 800 block South Dundee Street presented a petition to the Board asking the Board to stop Mr. A. Beisbeck from farming and raising livestock on the premises at 3106 W�st Sample Street. The matter was referred to the City Attorney for investigatiola. CEMTERY DEPARTMENT: Mr. McNabb was present and requested permission to purchase oil � or use on the roads at the City Cemetery. Mr. 'YoNabb was requested to obtain estimate on the cost of oil and dowflakes and report to the Board at the next meeting. /The City Attorney reported that he had investigated the complaint made by 11r. Walk Ir concerning the situation at the dump near his residence and had checked law on the matter. He reported that he had written to Mr. Walker stating what the city could do. /A petition for the establishment of grade fort he east and west alley between Donald Street and Bowman Street and from Sampson Street east to Hoke Street was re- ferred to the City Engineer. i The following agreement was entered into between the Board of Works and Reed Brothers: This agreement made and entered into by and between Reed Brothers of the City of Mishawaka.. Indiana, by and through I. C. Reed, as party of the first part, and, The City of SouthBend, Indiana, by and through its Board of P14blic Works, as party of the second part, Witnesseth: Whereas, party of the first part is the owner of certain articles of road construction equipment, more particularly hereinafter described, and de- sires to lease sane to the second party for use in road construction work, and, Whereas, party of the second part being engaged in certain road construc- tion work within the City of South Bend, Indiana, desires to lease said equipment, NOVI, THEREFORE, it is stipulated and agreed that first party will lease to second party the following described road construction equipment for which party of the second part will pay to first party monthly rental as hereinafter stipulated, the equipment, together with the agreed monthly rental, being des critred as follows, to -wit: 1. 134 road forms and stakes being 1340 ft. Rental per month ------- $134.00 It is stipulated and agreed that the effective date of this contract shall be as of the date that said equipment shall be taken from the yard of the first party in the City of Mishawaka, Indiana, which said date is the 26th day of April, 1939; that this contract shall date from said date and remain effective until said articles so rented or leased have all been returned to the yard of first party in the City of Mishawaka, Indiana. It is further agreed that first party shall not be liable or accountable to second party or employees of the second party using said equipment or for any resulting injuries or damages occasioned by the use of said equipment; that this provision shall cover such time as the equipment is being transported to and from the yard of first party. It is further agreed that second party will keep said equipment in good repair replacing any and all parts that may become lost or damaged with new parts or used parts which party of the first part may agree shall be used; that said equipment will be returned to first party in as good condition as received, wear and tear excepted; that all equipment will be thoroughly cleaned; that the forms will be thoroughly greased wit}a a heavy or thick coating of grease and re- placed within the yard in the same manner as received; that all articles will be replaced within the yard of the first party as directed by first party or duly acting agent. It is further agreed that rental shall continue upon said equipment for so long a time as the articles shall remain away from the yard of the first party at the above designated price; that rental payments for said equipment will be made in the name Reed Brothers and directed to the office of the said Reed Brothers at 2022 North Main Street, City of Mishawaka, Indiana. Dausman of the Indiana Bell' -Telephone Company submitted prints of a proposed underground conduit construction on Prairie Avenue from Scott Street to Gertrude Street and also an extension on Gertrude Street from Prairie to the city. limits. Mr. Qualls submitted a report recommending the granting of permission to do this work. The proposed construction was approved by the Board. Mr. Dausman was instructed to obtain his permits from the building, Department. ✓Mr. Clyde E. Williams filed primary assessment roll, showing awards and damages and assessment of benefits in the matter of Vacation of Alley North of North Side Boulevard from Louise Street to Roberts Avenue. In the above named assessment roll, the Board hereby orders that it will meet in the City Hall at 9:00 A.M. on May 29, 1939, to hear and receive remonstrances from all persons interested in -or affected by said Vacation Resolution No. 2500, and the Board further orders that notices of said hearing be advertised in two newspapers in South Bend on May 19 and May 26, 1939, and that notices together with the amount of damages awarded and benefits assessed be addressed to the property owners according to law. NET DMIAGES NET BENEFITS 00.00 00.00 The following notice with regard to all purchases made in the future was approved y the Board, which directed the Clerk to address a copy to all department heads: /With the thought that centralized purchasing is the most economical and efficient method of procuring the supplies, materials, and equipment needed, a requisition from has bedn devised to be used in connection with all purchases. OAll purchases are to be made thru the clerk of the Board of Public Works and Safely, who is charged with the responsibility of approving purchases as to appro- priation balance.. v`This new requisition is made in quadruplicate. The original copy (white) is sent or delivered to the vendor, a second copy (blue) is also delivered to the vendor Who must obtain the signature of the person taking delivery of the purchase. This signec'�Tlue copy must accompany the regular claim. The third copy.(pink) is.to be kept by the clerk for his records and for checking outstanding invoices. The fourth copy (yellow) is to be returned to the department head for his records. b'In order that each department head might maintain in his own office a record of his budgetary expenditures, all claims must be signed in the space so provided by all department heads. This procedure will enable each official to complete his requi-sition form copy as to price of purchase which is not always on requisition at the time it is issued. YIt is suggested that each official check his records monthly with the clerk of the Board of Public Works and Safety for their correctness. The clerk of the Board is charged with maintaining a current.record, of the budgetary expenditure of all departments under the jurisdiction of the Board of Public Works and Safety. 4In cases of emergency we believe the clerk or some one in his office can be reached by phone to obtain a requisition number. This requisition can then be completed later so that this emergency purchase can go through the regular channels. L;We insist that proper team work between the departments and the office of the Board will guarantee that the City lives within its means and does not spend more than has been budgeted for supplies, materials and equipment. REPAIRS T4 FIRE DEPARTMENTS: LChief DeVleeschower reported that several of the fire stations need new eave troughs He was instructed to obtain bids on the repair of the eave troughs and present them to the Board at the next regular.meeting.
