1-4EETING--A.PRIL 3, 1939
Regular meeting of the Board of Public Works was held on 'Monday, April 3, 1939, at
9:15 A.M. All members were present. Yinutes of the previous meeting were read and ap-
proved.
CEMETERY DEPARTMENT:
Lisle F. Vicluabb, Sexton, was present and made his -report for the month of I-Jarch,
1939, which showed total receipts of 191.00. Mr. McNabb obta'-reed an estrrate on the
amount of paint required to Paint the fence around the City Cemetery. 163 gallons of
paint will be needed. If red -lead at A04.12 a gallon and steel coating at 1.82 a gallon
are used, the cost will be $1263.76; if the fence is merely cleaned and coated: with
aluminum paint atn2.42 a gallon, the cost Will be>394.46 for material only. No action
was taken by the 1-'oard.
IEIr. McNabb was authorized to purchase 100 lbs of grass seed and 100 lbs. of fertili

gard-ng.the railroad crossing on Western Avenue west of 1 alnut Street. Since the report
did no•�, include-recorLyAendati ons, final action of the Board was withheld until a later
date.
✓ The following deed was accepted and was recorded in accordance with the minutes of

the meeting of February 6, 1939:
Deed of Mae E. Huff Arrowsmith, widow and of full age, and survivor of ?Mary E.
Huff, deceased, of Grange County, in the State of Florida, for the following
real estate, to -grit:
A parcel of land bounded b-- a line runn n� as follows, to-:vit: Beginning
at a point six hundred (600) feet east of a point in the north and south
center line of SectionThirty-three (33), Township Thirty-eight (38) North,
Range Two (2) East, distant south one thousand seven hundred fifty-five
(1755) feet from a stone in the center of said Section; thence south one
• hundred sixty-one (161) feet; thence east twenty-seven (27) feet; thence
north one hundred sixty-one (161) feet; thence west twenty-seven (27) feet
to the place of beginning; and being the east twenty-seven (27) feet of
grantor's land.
T_1is deed is executed to convey to the City ofSouth Bend said land for street
p,.rposes for the`,Uuse of the r�ublic, heretofore designated on the proposed .plat
as I'Jayfield Road, and which the grantor now understands is to be known as
Illinois Street.
I-Aary E. Huff, who held the title to the above described property as a joint
tenant with the grantor, was grantor's mother. The said Liar y E. Huff de-
parted this life on the 25th day of February, 1�)29.

No. 56999 in the Records of the Recorder of St, Joseph county, Indiana, and is
Document No. 705 in the records of the Board of Public +iJorks of-1the city of South

City_ Hall shall be closed on Good Friday from fronoon until 3:00

The Engineer presented evidence to tie Board taat=1arr7T i,11icodemu s, a plumber, had
not complied with the ordinance in t=,e construction of a sewer connection at 912 Leland
Avenue. The following letter was sent to I;�r. Nicodemus b1T registeredmail
• "on the 31st day of ITlarch, 1939, you obtained Permit No. 30753 to install a
sewer connection at the residence at 912 Leland Avenue.
"Under the rules and regulations of the engineer you were instructed to install �
not less than a six-inch connection which instructi6ns and order were stamped
upon the per�it which you obtained.
"We have been informed that instead of complying witht his order, that you in-
stalled a five -inch connection at this address. This is a violation of the ordinanc .
The ordinance provides that upon failure to comply with this order, the Engineer
shall cause the connection to be changed and suit shall be brought against you
and your bonding company to recover the cost of changing the improper connection
and to recover reasonable attorney fees and court costs; it also provides that
you may be charged with a violation of the city ordinance and fined for your
failure to comply therewith.
"Unless the five -inch connection which you installed at the above address is
corrected by the installation of not less than a six-inch connection on or be-
fore the loth day of April, 1939, we shall proceed under the ordinance to change
the connection which you installed and bring an action on the bond and also
prosecute you for violation of the c rdinance.
• "Kindly govern yourself accordingly."
Carbon copy was sent to the Laven insurance Agency.

STREE,rP DEPARTI.IENT :
ir. Zmudzinski was present and matters pertaining to his department were dis-
cussed.
Gordon D. Keller of 1026 Emerson Avenue reported to the Board that the property
west of his residence is being used as a dumping ground. He requested that something
be done to discontinue this practise. The Clerk of the Board.was instructed to nct,;Lfy
the Street Department and the Chief of Police.
/Excavation bond in favor of Mel. S. Niemier was approved by the Board.

/ he :Westinghouse lamp contract with Il cCaffery Company, Inc. was returned fully
signed. This contract is on file in the office of the Board.

/The Engineer was authorized to investigate the possibility of procuring a 1JVPA
project for caintin�-g the cemetery fence with INPA paying for the cost of paint estimate
by the O'Brien Varni-sh Company and submitted to the Board nrevlouslJr.
STREET DEPARTMENT:
�Ir. Zmudzinsk_i was present and matters pertaining to his department were dis-
cussed. Tarr. Zmudzinski reported '"to the Board_ that "Nio Dusr_ning" signs had been erected
on the property w1h1ch had been called to his attention.
✓ DeWitt Ingleright appearted before the 3oard and requested a re -spread of delin-
quent assessments. on Lot 2 in Tuxedo mark First Addition. In the opinion of the City
Attorney no Iegal`rzeans are available for distribution of assessments against property
on Vich the assessments have become delinquent.
Mr. L. Harmon appeared before the Bo€rd regarding a complaint he had filed pre-
viously against the city. .for damages incurred to his car by a manhole cover on South
Main 'Street. The matter was referred to the City Attorney,; for further consideration.
Mr. William Busse of the Krearno Bai>ery appeared and requested (:permission to erect
a flagpole in front of t1ae ba'_ er-; between the sidewalk and curb. Permission was not
granted. He was advised to place the pole within his own property; line or on the roof
of the building.
/A petition was received from forty-six citizens requesting= the erection of a scree
light over the railroad crossing- at Lon -ley Avenue, between College and Brookfield
Streets. The matter was referred to the Electrical Department.
v A hearing of interested parties was had relative to the changing of the Bendix
busline from Linden Avenue to ;Washington Street. Ina_snuch as the Board received an
additional _petition recuesting that this change be not made, the clatter was tabled for
future consideration.
✓Continuation certificate coverin- contractor's bond in favor of Frank Sailer
was approved by the Board.
J Upon motion duly made and unanimously carried, the Board approved a contract with
the ,,,r'n.ite Consolidated, Inc. for the rental of one Rex 27E concrete mixer at the rental
of A200.00 ner month, which contract is as follows:
