TdIEETING--MARCH 2O, 1939
Regular" meeting of the Board of Public 4vorks was held on Monday, March 21, 1939, at
9:15 A.M. All members were present. Minutes of the previous meeting were read and ap-
proved. Claims of the following suppliers in the amount of il,I11,475.52 were approved and
ordered paid:

This being the date set for hearingon Vacation Resolution No. 2500, same being
between Louise Street and Roberts Street and between Lot #48 and Lots

t49, 50 and 51, Baker-McHenryts Addition, there being no objectors, and no objections
having been filed, and the Board being advised of this fact, Vacation Resolution.was ap-
proved and referred to the Engineering Department for the purpose of making up final
estimate,of benefita and damages.
The hours of the telephone operator. were discussed and the clerk of the Board was
instructed to notify her that her hours shall be from eight until five with one hour for
lunch and from eight until twelve on Saturdays.
✓TIr. Qualls of the Electrical departnent was present and matters pertaining to his
departTgent were discussed.

ceived and was ordered filed. Because of new legislation, it is impossible to erect any
new street ligThts.
The Board's attention was called to a letter received by the Idlayor from the State
Highway Commission outlining; various rules and regulations in obtaining permits to work
on city streets maintained by the Co=-'Lssion. The Engineer was authorized to advise the
various departments that are effecte"d.
'The
matter of signs being erected between the sidej�allc and curb was discussed.
Mr. Eloomaw was present.

✓Tir. Zmu�inski was present and was authorized to order one one of sweeper broom fibre
from the A. Steiert & Son Company at Ilatfield, Pa. at 9-3/4 cent per pound delivered.
VContinuat'.on Certificate covering excavation bond in favor of Robert L. Thorpe was
approved by the Board.
CEMETERY DEPARTIJENT :
Mr. Lisle McNabb was present and made a report of his receipts for the months of
January and February, 1939.

A special meeting of the Board of Public `�lo�=ks was held on Thursda;r, �,Iarch 23, 1939,
at 2:00 P.I.1. Mir. Beamer was absent.
The following concerns were notified verbally that the Board of 'tdorks and Safety
would receive waled roposals for the reioval of the streetcar rails on Sa:rple Street
between Chapin and Walnut Streets at 2:00 P.I,I. today: Hurwich Iron and I:etal Company,
The Main Iron and Salvage Company, TYZay Schneider and Sam Berman.
The proposal of Sam Berman was the only one submitted, It is as follows:
"We hereby submit our bid of (�55.00) per ton on the street car rails, on
Sample Street between Chapin and Walnut Streets. Rails to be removed by
purchaser.
"We assure cooperation with the INPA, in this work.

The following agreement was entered into between the Board -of Works and Safety and
Sam Berman:

THIS AGREMENT made and entered into between the - -
Municipal City of South Bend, Indiana, by its Board of Public Idorks
and Safety ..and Sam Berman
W ITNESSETH: That
KHMIEAS, the City of..South Bend is the owner of the iron
rails now constituting the street car tracks on'Sample Street between
Chapin and Walnuts Streets, and
NHEIRL'A5, said City is desirous of removing said tracks and
disposing of said rails, and
V�MRFFAS, said street is to be repaved by the TI orks Progress
Administration, and it is necessary to remove said rails before said
repaving can be accomplished,
IT IS, TITTREFORE, agreed by and between the parties that
Sari Berman hereby purchases
from the City, said rails for the consideration of 250.00 ,
the receipt of which is hereby acknowledged,aad it is --:understood and
agreed by and between the parties that said rails=will be removed by
SM1 Berman under the
supervision of and in accordance with the instructions of the City of
South Bend, and will be removed at such time as will accommodate and not
interfere with the work being done by the Works Progress Administration
in repaving said Sample Street. In the event Sari Berman
fails to remove said rails
without interference with the_vork of repaving said street, then the City
may, at its discretion, remove said rails and as compensation for said
removal, re-sell.the same or such part thereof as it may be required to
remove, to any one that it sees fit and in such event, Sam Bermm
shall have no claim a.-ainst the
City of South Bend for any damages or breach of contract as the result of
such removal and re -sale.
