MEETING, JANUARY 23, 1939--JANU1iRY 30, 1939
Regular meeting of the Board of Public Works was held on Monday, January 23,
1 39, at 9:15 A.M. All members were present. Mlinutes of the previous meeting were
read and approved. Claims for payroll in the amount of d�473.50 and of McClave Printing
Company in the amount of 015.50 were approved and ordered paid.
This beng the date set for hear Ing of final assess;r�ent roll on Vacation Resolution
No. 2499, which has to do with the vacation of Wayne Street from St. Louis Blvd. West
and also alleys in Howard Pare w1nich had not been' previously vacated, and no remonstranc's
having been filed and no one having appeared in opposition to said assessment roll, said,
assessment roll is now approved and conf irnied and damages and benefits are finally r
assessed as stated therein.
✓1,1r. Zrnudzinski, the Street Coinmissioner, was present and discussed with the Board
the possibility of purchasI_ng pushcarts for the pur-pose of cleaning streets. He was
advised by the Board to ascertain prices on these carts. in:C'. Z rudz inski filed an in-
ventory of all tool equipment in his department as of January 16, 1939, as had been
previously requested by the Board.
/Mr. Qualls was present and discussed the lighting situation in the underpass at
Western and Walnut Streets. He said these lighter are regulated by an electrically con-
trolled clock which furnishes power at that point from oyli� hOlir after§un,set and Until
one hour before unrise. These lights are tied in witht ere general lighting system.
/lilt. McNabb, City Cerletery Sexton, was present and was authorizes= to investiL;ate
grave ten7:-, size 14x21 and to purchase covering from such
the prices of covering a
dealer as can furnish the best price, taking into consideration quality and material.

Dorothy Street to the west line of the alley east was referred to the City Ban Depart-
ment for investigation and report.
'JA petition for vacation of the alley between Lots 48, 49, 50 and 51 in Baker and
McHenry's Addition to the city of South rend was referred to the City Plan Department for
investigation and report.

on a piece of property east of t'_Le Grand Truk right-of-way on Lincobway East, the
following letter was addressed to '.fir. Noble:

"Dear Mr. Noble:-
"lle have investigated the request which you made in your letter of
January 17, 1939, with reference to a quit -claim deed on apiece of
property east of the Grand Trunk right-of-way on Lincolnwair East.
"Investig,at cn has been - ade by the !�-^v'neerrs office and we are
willing to made whatever record or conveyance is necessary in order to
clear 'your title. I am, not in a positicn at t1nis time to say who could
make a conveyance on behalf cf the City. I sugrvest -�rcu check the law
on that matter to satisfy yourself and prepare the instrurient and sub-
mit it to me and we ,rill see that the proper instrument is executed by
the proper perscns and the record is made."

The Street Commissioner was authorized to Nut on such additional men as is
necessary to meet the emergency created by the snowstorm of January 29 and 30 for the
removal of snow from t he city streets and was also instructed to work_ three shifts of*
drivers on his trucks for the purpose of snow removal.
Mr. Yloomaw submitted a report on zoning concerning a lot owned by the 0. A. Clark
Estate at the southeast corner of the intersection of U.S. highway 31 North and Peashw.ay
which report was ordered placed on file.
/Attorne�r 1�1. A. Slick submitted a sketch for driveway openings in front of his
property on Lincolnway East. The plain was referred to the Engineering Department for in
vestigation and report. 11r. Slick was requested to report to the Board at the next
regular meeting.
'Tjr. Qualls submitted a summary of the street 111-ht-.1g costs for the year 1938. A
breakdown of this year's sumrlary covers the number of lights in service, the type of
illumination, construction and rate of each; also the amount, of surplus funds anticipate
at the close of this fiscal year.
/LVIr. Qualls submitted a report on a petition for a street light at the intersection
of Elwood and Johnson Streets and Hr. Qualls' recommendation is that there is a light
now at the middle of the block between Elwood and Humboldt on Johnson and at the inter
section of Broomfield and Elwood and O'Brien and Elwood and that the; petition for in-
stallation of this light be rejected. Based upon the recor:ffnendation Q-f- Mr. Qualls, the
Board rejected the petition for a light at the intersection of Elwood. and Johnson.
A petition for re -allot ment of assessments on Improvement Assessment #2154--Fair-
view Avenue Local Sewer was considered by the Board. The action taken by theBcard is
set forth in the following; letter addressed to J. V. Garland, Vice President of the
Twyckenham Land Investment Company:

"The Board has sought the opinion_ of the City Attorney in this matter and it is
his opinion that in view of the fact that the p-roperty was not platted when the
assessments were 1Made, that the enti be assess_nent is a lien a-ainst the entire
property- and cannot, at this time, be allocated to different lots or to individual
Y,=ortions of the entire tract and that the only way to clear the property of the
lien is to pay the entire assessment.
"If you can furnish us any law to the contrary which will satisfy the City
Attorney that his opinion is not correct, vie will be glad to re -consider it.

for a quit -claim deed on a piece of property located east of Lincolnway East and north
of the Grand Trunk right -of-vra0 I e-bers of the Bcard were of the opinion that steps
should be taken to clear the title to the property in question and the City Attorney
was advised to take whatever steps are necessary to obtain this end.
