AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY
LOCATED BETWEEN 3466 AND 17210 DOUGLAS ROAD AND SOUTH OF
17210 AND 17242 DOUGLAS ROAD AND APPROXIMATELY 1,000 FEET
EAST OF S.R. 23, COUNCILMANIC DISTRICT 4 IN THE CITY OF SOUTH
BEND, INDIANA
STATEMENT OF PURPOSE AND INTENT
The current zoning is "CB" Community Business District and "SF1" Single Family
and Two Family District and the proposed zoning for the property is "CB"
Community Business District to allow for all permitted uses in "CB" Community
Business District.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City
of South Bend, Indiana as follows:
SECTION 1. Ordinance No. 9495-04, is amended, which ordinance is commonly
known as the Zoning Ordinance of the City of South Bend, Indiana, be and the
same hereby is amended in order that the zoning classification of the following
described real estate in the City of South Bend, St. Joseph County, State of
Indiana:

and amended by adding written commitments as on file with the City Clerks office
(attached to the ordinance) and changing Section II to read as follows, after Mayor insert;

Hartman's Douglas Road Trust and Snelson's Douglas Road Trust ("Owners") agree that tl~~ --------
following conditions be made subj ect to their rezoning petition # 40-07 submitted on June 6, 2007
to the South Bend Common Council and Area Plan Commission of St. Joseph County.
1) Petitioners agree that there shall be no vehicular or pedestrian ingress or egress to or from
the Real Estate being rezoned, the "Real estate" to Elkins or McErlain Streets.
2) Petitioners agree that there shall be a cross access easement from their Real Estate to
neighboring lots #24-2023-0548 and #24-2023-054801.
3) Petitioner respectfully requests that the entire site be rezoned to CB Commercial Business
zoning in order to meet the needs of the contingent purchaser and for purposes of developing a more
cohesive site plan.
4) Petitioners agree to restrict the controlled uses, as listed in petition #40-07 "Commitment
Regarding Use and Development of Real Estate" and recorded on October 21, 2005, from locating
on the southern 260 feet of described Real Estate.
5) Petitioners agree to restrict the controlled uses on the remainder of the Real Estate as listed
in petition #40-07 "Commitment Regarding Use and Development of Real Estate" and recorded on
October 21, 2005, with the following exceptions which petitioner asks be allowed to be developed
on the site.

6) Further, the Petitioners agree to construct and maintain an earthen mound on the southern
property line where no mound currently exists, but if existing mound is removed, then a new earth
mound shall be constructed and maintained 30 feet from the southern wetlands on the southern
property line in its place. The new mound will measure at 10 feet tall and will have a width of 30
feet from the southern wetland on the southern border of the property. The top of the mount will
have a flat 10 foot wide portion planted with White Pine evergreen trees 6 feet in height, planted in
a zig zag pattern 15 feet on center. 'This mound would be installed within 90 days of the
commencement of construction of the first building on the site. The trees will be replaced, as.
necessary.
7) No structure, building or sign exceeding 24 feet in height shall be constructed or placed on
the southern 150 feet of the Real Estate. Lighting on the southern side of any structure within the
southern 150 feet of the Real Estate shall be of cut off type. Example attached showing cut-off type
and mound as Exhibit A. A11 parking lot lighting will comply with dark skys recommendations and
be constructed so as to not allow any direct rays of light to be seen from the lens in the lighting
fixture or the bulb itself from any presently developed adjacent residential property on the south side
of McErlain Street. Lighting on the western side of any structure adjacent to Elkins Street shall be
of cut off type shown on Exhibit A

Dear Council Members:
I hereby Certify that the above referenced ordinance of Hartman's Douglas Road Trust Agreement and Snelson's Douglas Road
Trust Agreement was legally advertised on Thursday, July 5, 2007 and that the Area Plan Commission at its public hearing on
Tuesday, August 21, 2007 took the following action:
Upon a motion by Gerry Phipps, being seconded by Robert Hawley and carried, the proposed ordinance and site
development plan of Hartman's Douglas Road Trust Agreement and Snelson's Douglas Road Trust Agreement to
zone from CB Community Business District and SF1 Single Family and Two Family District to CB Community
Business District, property located between 3466 and 17210 Douglas Road and south of 17210 and 17242
Douglas Road and approximately 1,000 feet east of S.R. 23, City of South Bend, as tabled is sent to the Common
Council with a favorable recommendation subject to the following written commitments: 1) No access to
McErlain Street or Elkins Street, 2) A cross access easement be provided to the western adjoining lots; Tax ID's
24-2023-0548 and 24-2023-054801. 3) The southern 180 feet of the site be restricted to OB Office Buffer uses
and development standards. 4) No controlled uses allowed with the development. Prior to September of 2005,
the southwest portion of this site was zoned SF1, with the northeastern portion zoned OB. In September of 2005,
the OB zoning was successfully petitioned to CB. The SF1 district essentially remained in place, with written
commitments to protect the residential properties to the south. The land uses to the south of the petition area
have not changed since the rezoning in 2005. The commission also recognizes the expansion of the commercial
area along Douglas Road. However, the Commission feels by limiting the southern 180 feet of the development
to OB Office Buffer uses and development standards, along with the required residential buffer yard and

Requested Action:
The petitioner is requesting a zone change from CB Community Business District and SF1 Single
Family and Two Family District to CB Community Business District to allow uses permitted in
the CB Community Business District..
Land Uses and Zoning:
On site: On site is vacant property zoned CB Community Business District and SF1
Single Family and Two Family District.
North: To the north across Douglas Road is the Memorial Home Care building zoned
CB Community Business District.
East: To the east are two buildings used for dance and photography zoned LB Local
Business District.
South: To the south are residential lots zoned R Single Family District and vacant land
zoned SF1 Single Family and Two Family District.
West: To the west are single family houses and woods zoned R Single Family District.
District uses and development standards:
The "CB" Community Business District is established to provide a location for high volume and
high intensity commercial uses. Activities in this district are often large space users which may
include limited amounts of outdoor sales or outdoor operations.
Site plan description:
The site is approximately 12.13 acres. The site plan shows six (6) proposed retail buildings,
totaling approximately 110,000 square feet. Those building will cover 21% of the site. Four (4)
smaller retail buildings are located on the northern part of the site. Two (2) large retail buildings,
accounting for approximately 91,000 square feet of the total development, are located on the
southern portion of the site. Parking and drives consist of 55% of the site. With the remaining
24% of the site consisting of landscaping and open space. The development consists of 492
parking spaces, including 10 handicap accessible spaces. The site has one (1) access point off of
Douglas Road. A residential buffer yard is required along the western and southern property
lines.
Zoning and land use history & trends:
A portion of this site went through a previous rezoning in September of 2005 from SF1 Single
Family and Two family District and OB Office Buffer to CB Community Business, with written
commitments.
Traffic and transportation considerations:
Douglas Road is proposed to be widened from two to four lanes. Elkins Street is a narrow two
lane road. No access is being proposed from this street.
Utilities:
The site will be served by municipal sewer and water.

2. Current conditions and character:
The site is currently vacant land. The area is commercial in character.
3. Most desirable use:
The most desirable use for the site would be commercial or office uses.
4. Conservation of property values:
The surrounding residential properties values to the south may be effected.
5. Responsible development and growth:
It is responsible development and growth to allow the expansion of existing commercial nodes,
while maintaining a buffer to protect adjacent residential areas.
Recommendation:
Based on information available prior to the public hearing, the staff recommends that the petition
be sent to the Common Council with a favorable recommendation subject to written
commitments: 1) No access to McErlain Street or Elkins Street. 2) The southern 180 feet of the
site be restricted to OB Office Buffer uses and development standards. 3) No controlled uses
allowed with the development.
Analysis:
Prior to September of 2005, the southwest portion of this site was zoned SF1, with the
northeastern portion zoned OB. In September of 2005, the OB zoning was successfully
petitioned to CB. The SF1 district essential remained in place, with written commitments to
protect the residential properties to the south. The land uses to the south of the petition area have
not changed since the rezoning in 2005. .The staff also recognizes the expansion of the
commercial area along Douglas Road. However, the staff feels by limiting the southern 180 feet
of the development to OB Office Buffer uses and development standards, along with the required
residential buffer yard and landscaping, the surrounding residential areas should be adequately
buffered, while at the same time providing appropriately zoned -property for commercial
development.
