HomeMy WebLinkAbout05/25/1937 Board of Public Works Special Meeting Minutes301 A special meeting of the Board of Public Works was held on Tuesday, May 25, 1937) at 10:00 A. M. All members were present. The purpose of this special meeting was to determine whether the Board would consider entering into a contract with the Northern Indiana Railway, Inc. for the elimination of street cars on Portage Avenue and the substitution of buses. It was regularly moved, seconded and carried that this matter would be considered. Mr. R. R. Smith, Receiver of the Northern Indiana Railway, Inc., having exhibited evidence of legal publication of an Agreement under consideration for the elimination of street cars on Portage Avenue from Keller Street to Navarre Street; thence East on Navarre Street to Michigan Street; thence south on Michigan Street to LaSalle Avenue, which is as follows: AGREUVIENT This Agreement made and entered into this 25th day of May, 1937, by and between the City of South Bend, Indiana, by and through its Board of Public Works and Safety, hereinafter called the first party, and the Northern Indiana Railway, Inc., a corporation organized under the laws of the State of Indiana, and Raymond • R. Smith, Receiver of said Northern Indiana Railway, Inc., their successors and assigns, hereinafter called parties of the second part, VVITNESSETH: That Whereas, the parties of the second part now have and own an indeterminate permit to operate, as a part of their street railway system in said City of South Bend, a. local street car service for the carriage of passengers for hire over the following route, viz: On Portage Avenue from its intersection with Keller Street, south- easterly to its intersection with Navarre Street; thence Easton Navarre Street to its intersection with Michigan Street; thence south on Michigan Street to its intersection with LaSalle Avenue; and said parties of the second part now have street railway tracks laid. in said streets and are operating street cars over the same and along said route for the carriage of passengers for hire, and have the indeterminate right to continue to • operate street cars over and upon said streets; And Whereas, said party of the first Dart is about to relay the pavement on said Portage Avenue, and has requested the parties of the second part to remove their said street railway tracks not only from said Avenue, but from all the streets and avenues first above described; and has requested them to remove their railway tracks from said streets, and in place of said service to install and • operate automobile or motor busses for the carriage of passengers for hire, and said parties of the second part are willing to comply with said requests in consideration that said City grants to them the right to operate motor busses over said streets and into the same general territory for the carriage of passengers for hire. Therefore, consent, permission and authority are hereby granted and given by the party of the first part, to and vested in the parties of the second (part, their successors and assigns, subject to the conditions hereinafter speci- fied, to operate vehicles, commonly known as motor busses, for the purpose of carrying passengers for hire, from the date of this agreement, over the following route in said City of South Bend, to -wit: I Starting on Portage Avenue at its intersection with Keller Street; thence southeasterly on Portage Avenue to its intersection with Navarre Street; thence East on Navarre Street to its intersection with Michigan Street; thence south on Michigan Street to its inter- section with Washington Street; thence west on Washington Street to its intersection with Main Street; thence North on Main Street to its intersection with Navarre Street; thence west and northwesterly 302 over said Navarre Street and Portage Avenue to said Elwood Avenue. The said second parties agree to operate motor busses over said route with a regular time schedule, adequate to the convenience and necessity of the users ■ of said service, at the same rate of fare now being charged by the parties of the second part on other motor bus routes in said city, to -wit, a ten cent cash fare, • and three tokens for twenty-five cents (each token giving a passenger the right to one ride or trip on a bus), together with the right of one transfer to either street cars or other busses operated by the parties of the second part. The party of the first part further grants the right to the parties of the second part to erect and maintain suitable signs along.said streets and routes, advertising its stops and schedules, which right shall be subject to reasonable . regulation by the Board of Public,Works and Safety of said City. The party of the first part intends to repave said Portage Avenue, and 11 it further grants to the parties of the second part the right until such time as said improvement is completed, to operate its said motor busses over such streets and avenues of said City as they may select and which lead into the same general section of the City as is now served by said Portage Avenue street car line. The narties hereto further agree that this contract shall not be binding I i and. effective until and unless the same is approved by ordinance of the Common Council of said City, end by order of the St. Joseph Circuit Court. And the parties of the second part agree that upon its final and complete execution and approval as aforesaid, they will remove the street car tracks from the streets first above mentioned so as to permit the making of said improvement. • IN WITNESS WHEREOF, the first party has hereunto caused its name to be signed by the members of its Board of Public Works and Safety, and the second party, Northern Indiana Railway, Inc. by its President and Secretary, and said Receiver has also affixed his name. The above Agreement having been duly considered, it was regularly moved, seconded and carried that the Board of Public Works enter into this Agreement, subject to approval of the Common Council and agreement was accordingly signed by the proper officials. 303 The purpose of the meeting having been accomplished, adjournment' was had at 10:30 A. M. • BOARD OF PUBLIC WORKS ATTEST: Clerk MEETING June 1, 1937 Regular meeting of the Board of Public Works was held on Tuesday, June 1, 1937 at 10:45 A. M. Mr. Woodward was absent. Co. 6.54 Hamilton Body Shop 18.25 Business Systems, Inc. .35 Motor Service & Parts, Inc. 2.76 Scherman-Schaus-Freeman Co. 3.55 South Bend Auto Products 8.35 South Bend Foundry Co. 78.00 ✓ This being the date set, hearing was had on the Assessment Roll showing awards of damages and the assessment of benefits in the matter of vacation of alley north of Sample Street from the alley west of LaFayette Boulevard to the west line of Garst's Addition, and 2nd alley west of LaFayette Boulevard from the south line of Tutt Street projected west to Sample Street, same being Vacation Resolution No. 2488. In the above -named assessment roll no remonstrators appeared and no written remonstrances were filed. The Clerk of the Board submitted proofs of delivery of notices and same were found to be sufficient. The Board, therefore, finds that the several lots and parcels of land have been benefitted and damaged in the amounts shown on said roll. The Board, therefore, decides to take final action on said Assessment Roll and declares same in all things ratified, confirmed and approved without modification and proceedings closed and the alley vacated. A Resolution was referred to the Board by the City Council pertaining to the rerouting of bus service of Portage Avenue line, reading as follows: • RESOLUTION Pertaining to the rerouting of the new Bus Service on the Portage Avenue line as well as the Notre Dame and Madison Street Car Lines. WHEREAS, the City has requested that the Northern Indiana Railway Company eliminate it's present Street Car Service, and that a modern Bus Service be provided in it's stead, and WHEREAS, with the elimination of the Street Cars, the presenttracks will be removed from the streets now having the Street Car right of way, i.e., on Portage Avenue, Navarre Street, and North Michigan Street from Navarre to LaSalle, and S WHEREAS, the tracks on North Michigan Street between LaSalle and Washington are now being used by the Portage, Madison, and Notre Dame lines, but with the elimination of the old St. Marys and the Portage Avenue lines, the north bound Madison Street and Notre Dame Street Cars will be the only Street Cars that will use these tracks, and WHEREAS, the Street Car right of way on North Michigan Street between LaSalle and Washington is in a very bad condition and also has an obsolete switch which was used for the St. Marys line thereby creating a traffic hazard that should be removed by the rerouting of the northbound Madison Street and Notre Dame Street Cars, in which case North Michigan Street could then be reconditioned all the way to Washington Street instead of just to LaSalle Avenue. THEREFORE BE IT RESOLVED, that the Northern Indiana Railway Company be requested
