Irl. All members were present.' 11inutes of meeting of January 13th were read and 'approved. Claims in the amount of $777.68, from the following suppliers, were approved and ordered paid. Neer, Street Commissioner, for W.P.A. activities and expense for, the month of November 1935 was submitted to the Board as requested. Report is now on file in the office of the Board of Public Works. It was regularly moved by Pr. Hunter, seconded by Mr. Woodward%%and. carried that Warranty Deed be accepted on behalf of the Board of Public Works, of -which the following is a copy, on condition that it be approved by the Common Council and that the grant stipulated is made by the Government. It is also with the understanding that if grant is not made by the Government or the Deed is not approved by the Common Council that the Board of Public Works in that event will reject this Deed. WARRANTY DEED THIS INDENTURE WITNESSETH, That BENDIX A-71IATION CORPORATION, a Delaware corporation, of St. Joseph County, State of Indiana, TO CONVEYS PYD WARRANTS MUNICIPAL CITY OF SOUTH BEND, of St. Jose U1.00) County, in the State of Indiana, its successors and assigns, for the sum of One Dollar and other good and valuable consideration, the following real estate in St. Joseph County, in the State of Indiana, to -wit: The Northwest quarter (Nw4) of Section Thirty-three (33), Township Thirty-eight (38) North, Range Two (2) East. The Northeast quarter (NEI-) of Section Thirty-two (32), Township Thirty-eight (38) North, Range Two (2) East. All that part of the Northwest quarter (Nw4) of the Southeast quarter (SE-1) of said Section Thirty- two (32) , which lies North of Lincoln flay Test, formerly the IVIlichigan Road. All that part of the Southwest quarter (SW4) of said Section Thirty-two (32), lying North of Lincoln Way West, formerly the IJlichigan Road. All that -part of the East half of the Northwest Quarter (A?l } of said Section Thirty-two (32) , lying North of Lincoln Way West, formerly the 1 ichigan Road, and East of Nasturtium Road excepting from said last described tract a parcel bounded by a line run- ning as follows: Beginning at the intersection of the center line of said Nasturtium Road and the South line of the Northeast quarter (NE-1) of the Northwest quarter (N'-1) of said Section Thirty-two (32) ; thence East on said South line to a point Five Hundred Thir- ty-one and Sixty-five Hundreths (531.65) feet East of the Southwest corner of said Northeast Quarter (NE-1) of the Northwest quarter (NWI) of said Section Thirttwo (32); thence North One Hundred Sixty- five �165) feet; thence West to the center of the said Nasturtium Road; thence Southerly along the center line of said Nasturtium Road to the place of beginning. This conveyance is made upon the condition that the property hereby and herein conveyed is to be occupied by the Grantee for the sole purpose of establishing, constructing, improving;, equipping, maintaining, controlling, leasing and regulating a municipal airport, landing field, and other navigation facilities for the use of aeroplanes and other air craft end such other purposes as permitted under the statutes of the State of Indiana governing airports; and this conveyance is made subject to an easement of ingress and egress and right of user for the benefit of the grantor herein, its successors and inter -related companies (but not for commercial transportation of passengers or freight) for the purpose of taking.off and landing aeroplanes, and any, and all craft navigating the air, and, the passengers therein or thereon. With the understanding, however, that when the vendor's lien herein reserved is fully paid and satisfied, and when the vendor, its successors or inter -related companies shall discontinue making a reasonable use of the said airport, then upon the happening of said events, the limitation upon the use as above stated, and the reservation of the easement as above stated shall end and terminate, and thereafter be of no effect. Subject to all taxes and assessments for public improvement. The vendor, Bendix Aviation Corporation, reserves a vendor's lien upon the real estate and. property conveyed by this deed to. secure the payment of the balance of the purchase price in the principal sum of Two Hundred Fifty Thousand Dollars.. (p250,000.00), of which One Hundred Thousand ($100,000.00) is payable five (5) sears from the date hereof, and Thirty Thousand (30,000.00) Dollars thereof is payable at the end of each year after said five (5) year period until the totel purchase price of Two Hundred Fifty Thousand Dollars ($250,000.00) is paid, together with interest thereon until the last payment is made at the rate of One Thousand Dollars ( 1, 000.00 ) per annum, payable annually after the date hereof; and if default be made in the . payment of any one of the installments of principal or interest aforesaid, at the time when the same becomes due and payable, then at the election of the vendor said principal sum, together with accrued interest thereon, shall at once become due and payable. And covenant for itself, its successors and assigns that it is lawfully seized of the premises, has good right to convey the same and guarantees the quiet possession thereof, that the same are free from all incumbrance and that it will Warrant and Defend the title to the same against all lawful claims. Notary Public CEMETARY DEPARTIMNT: Matters pertaining to the work of the Cemetery Department were discussed with Sexton Longenecker. STREET DEPARTIE-NT: 17r. Weer reported that the buttons on the various street corners had been removed, in accordance with recent instructions from the Board. Mr. Weer suggested that fifteen or twenty of these be reserved for future use and that the remaining number be bored in the center and used for traffic sign bases - the 'dater Works to be requested to do the work. This ma.tt,:�r was referred to Mr. Woodward. Lp tter of Police Garage, which was condemned by the State Fire 11'arshal on account of unsatisfactory roof and other repairs needed, was discussed and it was decided to comply with the request of the 1ie.rshal. • 0 0 • 0 97 Report of James H. Fierce of the work done in 1935, in which he stated that approximately,4,249 loads of garbage had been removed from the City of South Bend during the year, was ordered placed on file.
