HomeMy WebLinkAbout11/12/1935 Board of Public Works Special Meeting Minutesnm MEETING NOVEMBER ll, 1935 Regular meeting of the Board of Public Works was held on Monday, November 11, 1935 at 10:30 A. M. All members were present. Minutes of previous meeting were read and approved. Claims in the amount of $157.50, from the following suppliers, were approved and ordered paid, also payrolls of the various departments amounting to 4,491.61. Indiana & Mich. Electric Co. $98.83 Business Systems Inc. $5.25 Indiana & Mich. Electric Co. 1.00 Gafill Oil Company 1.50 Schuyler Rose 2.70 G. E. Meyer & Son, Inc. 5.52 The South Bend Supply Co. 42.70 William A. Bertsch, Attorney for the owners of property at 1501 Western Avenue, appeared before the Board and complained about the grade of the sidewalk and that the present grade as established damaged the property and expressed a .desire for invest- igation and consideration. The matter was referred to Mr. Anderson of the Engineering Department who agreed to visit the property in company with Mr. Bertsch and report to the Board at a later date. A letter from Yxs. Chauncey Fassett of the Morningside Hotel to the Mayor was read to the Board, wherein she protested against the opening of the gates at the Cemetery which had been ordered closed. This letter was ordered placed on file. A letter from Mrs. James H. Hirsch to the Mayor, in which she expressed -her appreciation of the manner in which the City Cemetery is being operated at the present time, is being placed on file. A Petition signed by fourteen residents in the vicinity of Esther and Hildreth Streets, requesting a street light at the southeast and southwest corner of this intersection, was referred to Mr. Qualls of the Electrical Department for investigation and recommendation. Mr. Qualls placed before the Board communication from the Indiana &Michigan Electric Company in which they set forth the fact that the New York Central Railroad Company have been maintaining crossing light at Indiana. Avenue and Clyde Street and that due to elevation at this point this light was no longer needed. From the stand- point of the City the Electrical Department report that this light is very necessary but Mr. Qualls recommended that instead of the 6000 lumen lamp there be installed at this point a 4000 lumen lamp which will add $37.20 annually to the street lighting bill. The Board decided upon regular motion that it will be satisfactory to install this light but gave Mr. Qualls instructions to turn out lights at other points in the City to this extent. A Petition signed by two property owners on North Duey Street, requesting the construction of a sewer from South Bend Avenue to about 550 ft. north, was referred to the Engineering Department for investigation and recommendation. This being the date set for hearing of the final roll of benefits and damages in reference to Vacation Resolution No. 2478, same being the vacation of Cherry Street' lying between the north -line and the south line of the main line of the New York Central right-of-way and it being Armistice Day the Board continues the hearing until Tuesday, November 12th at 2:00 P. M. The meeting adjourned at 11:00 A. M. �1 -1 1 1__ 1lv �.. _ 11 Board of Public Works ATTEST: Clerk SPECIAL MEETING November 12, 1935 Special meeting of the Board of Public works was held at 2:00 P. M. Tuesday, November 12, 1935. This being the date set for the continued hearing of the final roll of benefits and damages on Vacation Resolution No. 2478, same being vacation of Cherry Street lying between the north line and the south line of the main line of the New York Centre right-of-way, there having been several remonstrators appearing personally since the previous continued hearing who were under the impression that at the time Cherry Street was closed it was to have been established that a pedestrian crossing was to be main- tained, appeared to register their protests and to file notice that the crossing would damage the sale of their property and reduce the value. The Board, after carefully considering this matter, decided to postpone final action until a special meeting of the Board called for Thursday morning, November 14th, at 10:00 A. M. and in the meantime to give such publicity in the newspapers as possible 40 0- 0 0 to inform the residents of this special meeting, so that remonstrances may be filed and heard at that time. MEETING- November 14, 1935 Special meeting of the Board of Public Works was held Thursday, November 14, 1935, • at 10:00 A. M. All members we're present. This being the date set, hearing was had on the Assessment Roll showing awards and ,damages and the assessment of benefits in the matter of vacation of Cherry Street from the north to the south line of the New York Central right-of-way, same being Vacation Resolution #2478. C� 9 0 In the above named Assessment Roll no remonstrators appeared and no written remonstrances were filed. The Clerk of the Board submitted proofs of delivery of notices and same were found to be sufficient. A letter from the Malleable Steel Range Manufacturing Company setting forth the fact that it was their understanding when Charry Street was closed at the elevation that a passage way for Pedestrians would be provided which was fully considered by the Board, but the matter of closing Cherry Street, as covered by the above named Vacation Resolution, being a matter of contract on which was based the elevation project, no. further consideration could be given to such. The Board, therefore, finds that the several lots and parcels of land, having been benefitted and damaged in the amounts as shown on said Roll and decides to take final action on said Assessment Roll and declares same in all things ratified, confirmed and approved without modification and the proceedings closed and said part of Cherry Street covered.by the above named Vacation and all proceedings had with reference to said Vacation are hereby sustained.
