MEETING APRIL,29,1935.
Regu;ar,meet,ing of the Board of Public Works was held on Monday April29,, 1935
at 11.30.A.M.All members were present. ,
Chas Cole and Wm Moore Engineers, -Appeared before the Board and brought to its
attention,as Mr Cole stated he had several ;devious Boards.that there is no definite
plan set up to be followed in which to collect benefits resulting from condemnation
proceedings and that there are a good many of them delinquenteAfter some discussion
Mr Cole was invited to consult With City attorney Hunter in an effort to find a
remedy and make some plans for future procedure.
Replying to letter written by city attorney Hunter to G.A . #Farabaugh,attorney
for the N.Y.C,R.R.the following letter was received and read to the Board and
ordered placed on file,
Dear Mr.Hunter:
-Receipt is acknowledged of petition of property owners in the 'vicinity
of Leer Street -crossing with the New York Central Linestrelative to certain noises
claimed to be unnecessary in the operation of New York Central trains across this
crossing.I have refered the matter to the general counsel for the New York Central
at Chicago.
The peculiar thing about this situ6tion is.that every time a suit is'
brought against the New York Central for damages,occasioned by collision, between
a train"and a automobile or a pedestriantat one of these trossings in the eastern
part of South Bendsthe complaint always alleges and proof is attempted to be made
that the engineer on the New York Central train involved in the accident did not
blow his whistle.and now the property owners complain that there is to much whistle
blowing.,This whistle blowing is compelled by an Indiana statutetwhich provdes,as
I recallthat the whistle on every train approaching a crossing shall be blown
three timesthe first of which blasts's.hall be at least 1300 feet away from the
crossing,,'
However.as I said beforej will take this matter up with the general
counsel in Chicago.

A petition for the construction of a sewer on Scholum St signed by five.petitioners
The matter was refered to -the Engineering Dept for investigation.
A proposed contract with the linde Air Products Co of Chicago for supplying oxygen
and Acetylene to the various departments of the city of South Bend was discussed
land referred to the city Attorney,
The -following communcation from the Pennsylvania R-Powas read,
Board of Works,
South Bend Ind,
(Gentleman:
On November 11,1930,your Board approved a plan which was submitted
providing for the replacement of our present pile and frame bridge No.180.92
1just south of Ewing avenue with 72" reinforced concrete pipe.
We no contemplate makeing replacement at this point and would like
to use 68"x 74" oval reinforced pipe instead of the 72" pipe as originally
intended.
Will you please give us your approval to substitute oval pipe for the 721,
round pipe.Print showing the approval to which I refer is attached.

After considering the matter the Board decided not to permit the subititution and
instructed the secretary to write`them the following letter.

Dear Sir:
Your letter of April 24th was read to the,:Board of Public Works at its
ineeting monday April 29.It was decided that substitution requested be not approved
'It is pointed out to you in this connection that where Bowman creek crosses So
i chigan St the culvert opening is about 75 square feet and that runs full at times
0 we do not consider the pipe you suggest as aaquate.

Mr Ernest Kizer representing the Gafill Oil Co appeared before the Board and
requested a permit to erect a small building for storing tow bars at LaFayette &
3ample Sts.The Board authorized this permit to ex-oire July lst 1935.
Plaims in the amount of 2968.80 were allowed also Street Sewer,and cemetery Dept
-fay rolls in the amount of 4182.61.
Excavation Bond in favor of Anthony KuJawski & Son in the Maryland Casualty Co
iof Baltimore was Approved.
• Contractors Bond of Oscar A.Heinrich was released at the request of the Fide lity—
& Deposit Co of Chicago.
