1METTING APRIL15.,1935.
Regular meetin of the Board of Putile Works was held at 11:45.A.M.on
Monday April 15$1.935.All members were-epresent.
Minutes of meeting of April 8,were read and approved.
Claims in the amount of 3376;58.were approved.
Electric Dept,Mr Qualls present.
Mr Qualls and Mr Anderson reported the result of their investigation of the
Gary lighting system.Mr Qualls recommended and Mr Anderson a eed that the co
eontractas proposed by the Indiana and Michigen.Eleetric Co,Ts as low as the
city can expect to secure and that it is much more favorable than the contract
under which Gary operates,andrecommended its adoption.asoutlined.It- as -moved
by Mr Hunter and seconed by Mr Woodward that the contract be signed subject r:
to the approval of the common council to date January lst 1935. n
The following is the contract as outlined.
THIS AGREEMENT,made'and entered into this day of 1935,between t
the city of South Bend,a municipal corporation of the State of Indiana,by and
through its Board of Public Works,party of the first part,hereinafter referred
to as the City,and Indiana and Michigan Electric Company,party of the second
part ,hereinafter referred to as the Contractor,pursuant to a resolution of the
Board of -Public Wotks passed at a meeting held on day of 19359
WITNESSETH
That the parties hereto each in consideration of the agreementson the part
of the other herein contained have mutually agreed and hereby mutually agree as
follows::,--
1.The Contractor shall provide and maintain
(a) A street lighting system 3n the city of SouthBe-iid,jndian&
consisting of not less than one Thousand and Forty-one (1041)street lamps
supplied from the OVERHEAD DISTRIBUTION SYSTEM of the Contractor:Such over lamps
shall be as folloes;
1- 10000 Lumen incandescent,pendent fixture,dust proof bot lrefractor,
mast armveonstruction.
60 - 6000 Lumen incandescent lamps,pendent fixture,dust proof bowl
refractor,mast arm construction.
654 - 4000 Lumen incandescent lamps pendent fixture,dust proof bowel
refractor,mast arm construction.
75 - 2500lumen incandescent lamps,pendent fixture,dust proof bowl
refractor, bracket or mast arm construction.
251 1 1000 Lumen incandescent lamps,radial refleetor,bracket construction
(b) A street lighting system in the city, of South Bend,Indiana.,
consisting of not less than One Thousand Five Hundred Fifty -Six (1556)street
lamps supplied from underground distribution systems of the Contractor.Such
underground lamps shall be as follows:-

I - 50 Watt Special Traffic Indicators.
1.05 - 4-60 'Watt Post. Type Traffic Directors.

II.Special Park or Bridge Lighting Units.

I. 10000 Lumen submarine units.

All property_rused in performance of this contract shall be and remain the �
properity of the Contractor except in cases where the title to any property used
in the performance of this contract is vested in some other person,firm or
corporation.

The Contractor shall, at its coat furnish'all lamp renewals and light
• all lamps herein provided for by electricity for.a period of (5,)` - years from and
after the first dap,of January,1935,at noon.`
All lamps herein provided for are described according to the rating
of the manufacturers thereof.Such lamps shall be'so maintained and operated by
the Contractor.that they. will give the maximum amount of "i- lumitation
obtainable under commercial conditions.Such lamps may be kept in service for
the number of hours of :IV,�1 life specified by the-manufactor in published data
current at the time of -installation or replacement but no to-Ager.
All glassware shall be kept clean by the Contractor and tb:e,proper
current and voltage shall be'maintained on all lighting cir6uits,401thatthe
proper conditions for the operations of each.=lampat its normal rating.,shall be
maintained
All iron posts for the support of street lighting unite., served from
the underground system shall be properly painted by the Contractor,the color,
to be determined by the Board of Public Works.
20 Extensions of the street lighting system provided for in Paragraph
I-(.b)shall be made upon the order and request of the Board of Public Works but
in no event shall the Contractor be required to install more the ttsp.tIQ)

• more than.(10) lights in the next year and in the
same manner each sueeeding year.This paragraph shall be construed with paragraph
(7)•
3. Alllemps herein provided for shall be burned from one -half-hour after
sunset until one-half hour befor sunrise ever y night and all night,burning<
approximately 4,000 hours per annum except as hereinafter provided.These hourrs
of burning shall be the normal schedule of burning but in the event of an emergeng,
causing unusual darkness prior to the time of turning on said lights,then such
lampsshall be lighted and burned during the time of said unusual darkness.
Contractor corzvenants herein to furnish and maintain Four Hundred Fifty
�(450) lighting units".b'lasgifted:-herein as "Business District Ornamental Lighting
Units".The City shall designate One Hundred Fifty-Four(154) of these units to
be lighted during the term of this contract,from one-half hour after sunset until.
midnight only,the remainder of such lamps tobe burned from one-half hour after
sunset until one-half hour before sunrise as above provided.
4.The minimum number of each type of lamp furnished under this contract
shall be the number provided for in Paragraph One(l)hereof and such lamps shall
be maintained at the locations existing at the time of the execution of this
contract withthe exception of such changes of location as are provided for in
Paragraph Eight(8).
5.If any lamp is "out" during the hours in which itshould be lighted,the
. may deduct from the total monthlyamount which would have benn paid no "outage
occured,a sum bearing the ratio to the total as the outage bears to the total
time the lamps should have been lighted in any month.
6.The city may have its option at any time during the term"..of this contract
upon order of its Board of Public Works,request the contractor to install in any
or all overhead or underground street lighting units then in service any number
of lamps of larger size and/or greaterilluminating powerin which event from the
date of such changedinstallation the city shall pay as compensation therefore in
accordance with rates for such changed lamps and classification of units set forth
in paragraph Ten(10 ) hereof.
7.Additional overhead street lighting units shall be added from time to
time on written notice from the city and payment therefor shall be at the: rate
provided in this contract,commencing on the day on which the lamps are put in
service,provided that one additional 400096000 or 10000 lumen incandescent lamp
shall be installed for each extension of 700 feet and that one additional 2500
lumen incandescent shallbe installed for each extension of 400 feet and thatb
one additional 1000 lumen incandescent lamp shall be installed for each extension
of 250 feet,all such extensions being from the then existing suitable overhead
system or overhead circuit of the Contractor*
Additional under street lighting units shall be added from time to time
on written notice from the city,an d payment therefor shall be at the rate provided
in this contract commencing on the day said lamps are put in service,provided that
• one additional 6000 or 10000.1umen incadescent lamp shall be installed for each
extension of 300C:,feet,and that one additional 2500 lumen incadescent lamp shall
be ins-talled for each extension of 150 feet,all such extensions being from the
then existing suitable underground system or overhead circuit of the contractor.
provided however,that the number of additional underground street lighting
unitsrequested by the city shall not exceed the number provided to be install d
in paragraph T n(2) hereof:
If the contractor shall be required to furnish additional overhead or
underground street lighting unite during the last two years of the termof this
contract., -then the city,at the expiration of this contract shall reimburse the
contractor for actual expense incurred in running the additional lines.for such
lamps,the cost of such lamps and the cost of the installationthereofless the,
salvage value of such lines andlampe,provided,however,that if,at the expirations
of said eontract,a new contract is awarded to the same contractor,orthe succesor
thereof,and said"additional lines and lamps are used and operated under said con
tract, the city shall not be required to make any payment on account of the cos
of such addtional lines and lamps.
8. Street lighting units shall be moved by the contractor to such new
locations as the city may by writing direct subject to the following conditions:
Such moving of lamps shall be -completed within thirty (30) days after
receipt by the Contractor of written notice from the city,Sundays,legal holidays
and stormy days not to becounted,provided that the number of such removals shall
not exceed one per day ,and provided furthur that such removals may not be
required on Sundays,legal holidays and stormy days.Notice that the work of such
removal of lamps has been completed shall be given by the Contractor to the city
eithin ten (10) days after completion of the work!
The actual cost W the Contractor of makeing such relocations shall
be paid by the. city to the Contractor within thirty (30) days after said notice
has been given,provided,however,that the Contractor will at its expense upon ord r
of the Board of Public 'forks change the location in any one year of not to excee
tweet five (25) lamps,of which twenty-five (25)changes of location not to excee
five ?5) shall be units served frorA the undergroung system.
9When street lighting units are installed and abutting property
owners pay certain portions or all of the expense of construction or equiment,-.
kml the lighting of such units shall not come under this contract but shall be
the subject of negotitation and special contract between the city and the Contra for

Department of Public Parks of said City and the contractor agrees to bill
said Department of Public Parks for said lamps and the city for -the remaning
lamps contained in this contract,axclx The said department of Public Parks
j and the said city to pay f6r said respective billings.
ll.The Contractor shall have the right with the consent of the Board of
Public Worksof the city at any time during the life.of this contract to install
operate and maintain in the place of the lamps herein provided for,and under the
same terms and conditions,oth er and more improved lamps in keeping with such
advancement as may be made in the t-tof the lighting lamps shallbe
of equivalent or greater illiuminating power.
12.In authorizing or granting a permit to any person firm or corporation
to repair or out into any street,alley or sidewalk in which street lighting
units and lines cables supply current thereto are located,the city shall require -
•
as a condition to the granting of such permit,an agreement on the part of the
applicant that such lines and ea kes and street lighting units will not be
interfered with in any manner without notice to the Contractor.
13.If the City shall make default in the payment of any billas hereinbefore
providedithe Contractor may at its option after have given ten(IO) days written

notice of such intention so to do,discontinue theservice herein contracted
and continue to withhold the supply of*electrical energy for street lighting
until such time as the city has made payment for all bills in which it is arre
Any Suspension of service by the Contractor shall not terminate this contract
unless Contractor so elects*Otherwise'lupon payment by the city of the. amount
it is in the arrears.the contract shall remain in full force and effect for
the period herein specified.
14,It is further understood and agreed that the terms of the written
contract contain the entire agreement between the parties.and that none of the
terms of this contract shall be affected controlled or modified in any particul
by any specifications heretofor in 1934 filed in the office of the Board of
Publie Works,Provided that nothing herein contained shall prevent a modificatio
of th&s contract hereafter by mutual agreement of the parties#'
15.All the covenants.expressionsstermstconditionstprovisitions and
agreements herein shall extend' to and be binding upon,,or inure to the benefit
of as the case may be each and every one of the successors or assigns of each
of the parties hereto as if in every case so expressed*
16,This contract shall be inf6rce and effect from and after its
approval by ordinance for a period of five (5) years from and after the first
dayv of Januaryq19351at` noon*

its corporate seal to be hereunto affixed and this contract to be signed by the

Excavation bond of Charles Oberlin was released there being no charges against
him.
Continuation Contractors bond and ExeVation Bond of Ralph Sollit & Son were
approved. •
Mr Fred Christman submitted two plans for filling stations one to be erected
at DuBail and Michigan St and one to be erected at South bend ave and Eddy Sts
A dis'-cussion-was had as to openings permitted in,such projects and it was moved-
seconed and carried that opening at new filling.station installations be not
more than'30 feet and then more than one opening is on the same street a
suitable island be provided for the safety of pedestrians.The secretary was
instructed to so notify Mr Christman and to return his blue prints.

Mr-Freeh reported that Park Woodworth had agreed to lower the bell on
the Central Fire station for the sum of $100.00.Thls was authorized and Mr Freeh
was instructed to have the bell cleaned up and to report to the Board of its
condition end if any inscriptions may be found on it.
