HomeMy WebLinkAbout6.B.(6) Interlocal Agreementc~~~~~ INTERLOCAL AGREEMENT BY AND AMONG THE SOUTH BEND PARKS BOARD, THF, SOUTH BF,ND BOARD OF PUBLIC WORKS AND THE SOUTH BEND REDEVELOPMENT COMMISSION (Animal Shelter Project) THIS AGREEMENT is entered into and made effective the day of , 2010, by and among the South Bend Department of Parks and Recreation, by and through the South Bend Parks Board, the South Bend Department of Public Works, by and through the South Bend Board of Public Works, and the South Bend Department of Redevelopment, by and through the South Bend Redevelopment Commission. RECITALS WHEREAS, the South Bend Department of Parks and Recreation ("Parks") and the South Bend Department of Public Works ("Public Works") are each departments within a municipal corporation existing and operating as a political subdivision of the State of Indiana as defined by Ind. Code § 36-I-2-13 and are authorized enter into an interlocal agreement pursuant to Ind. Code § 36-1-7-4; and WHEREAS, the South Bend Department of Redevelopment ("Redevelopment") is a public corporate body created by Indiana law; and WHEREAS, the South Bend Parks Board ("Parks Board") is the governing body of Parks; and WHEREAS, the South Bend Board of Public Works ("BPW") is the governing body of Public Works; and WHEREAS, the South Bend Redevelopment Commission ("Commission") is the governing body of Redevelopment; and WHEREAS, Parks is the owner of the real estate and facility generally known as Kennedy Park located in South Bend; and WHEREAS, Parks desires to remodel the building located at 521 Eclipse Place to become the new state of the art animal shelter for South Bend Animal Care and Control (the "Project"); and WHEREAS, Redevelopment has the resources to fund the Project; and WHEREAS, Public Works has the expertise and procedures in place to contract for and administer the Project; and WHEREAS, Parks Board, BPW and Commission desire to enter into an agreement providing for the funding and contract administration of the Project. NOW, THEREFORE, in consideration of the mutual promises and obligations in this Agreement, the adequacy of which is hereby acknowledged, the Parties agree as follows: I. PURPOSE Kennedy Park is a public facility located in South Bend, Indiana and benefiting the citizens of South Bend and Parks Board determines that it is necessary and in the public's best interests to remodel the building located at 521 Eclipse Place to become the new state of the art animal shelter for South Bend Animal Care and Control. The Project is generally depicted at Exhibit "A"attached hereto and incorporated herein. BPW has considerable experience in contracting for and administering similar public works construction projects. The parties wish to utilize the expertise and experience of BPW in letting and overseeing any such contracts reasonably necessary to carry out and accomplish the Project and BPW is willing to provide its expertise and experience. Commission has resources that can be used for funding the Project. The parties wish to use the Commission resources to fund the Project. II. PROJECT FUNDS AND DUTIES a. Budget. The Project will be completed for a sum not to exceed $1,500,000.00 ("Project Funds") These costs shall be funded by Commission. b. Duties of Parks. Parks hereby agrees as follows: i. Parks shall make available and provide free access to the Project site to Public Works and Redevelopment and to each of their agents and designated contractors. ii. Parks shall review for approval all proposed improvements to Kennedy Park before Public Works begins the contract bidding process. c. ~ Duties of Public Works. Public Works hereby agrees as follows: Subject to the Project Funds identified for the Project, Public Works shall enter into each contract for the project and make decisions necessary to complete the Project. ii. Public Works shall supervise and administer all necessary contracts with the design consultant and the construction contractor. d: Duties of Redevelopment. Redevelopment hereby agrees as follows: i. Redevelopment shall have the duty of receiving, discharging, and accounting for all the monies of this joint undertaking and shall make payments upon authorization from Public Works. e. Ownership of Project i. Upon completion of each respective aspect of the Project, the ownership of the Project shall remain with Parks. III. ADMINISTRATION This Agreement shall be administered by a joint board consisting of the Parks Superintendent, the City Engineer and the Director of Redevelopment. Upon completion of the Project, a final audit shall be performed by Redevelopment. IV. DURATION This Agreement shall go into effect when it has been approved by each of the parties, approved by proper resolution of the governing body of the City of South Bend and has been recorded with the St. Joseph County Recorder. The Agreement shall terminate on December 31, 2013 unless extended or sooner terminated by the parties. The remodeling will be done according to design and specifications done by Grinsfelder Associates Architects of Ft. Wayne, Indiana, complementing the surrounding park land (Kennedy Park). Scope of Work: The Board of Public Works, acting on behalf of the Redevelopment Commission per the proposed Agency Agreement, will adapt the Grinsfelder design, bid the project per applicable statutes, award the project, and monitor construction activities. The hoard of Public Works will consult with the South Bend Park Board, as owner, and Catherine Toppel (Director of Code Enforcement), as operator of the new facility and Dave Relos (representative of the Redevelopment Commission) for approval of bidding specifications and change orders. Budget: Project is not to exceed $1,500,000.00 in cost. Source of Funds: Airport Economic Development Area Tax Increment Finance District. Timeline: Completion Date of the Project will be contingent upon various approvals from area agencies. Leal Description: A parcel of land located in the West one half of the Southwest Quarter of Section 3, Township 37 North, Range 2 East, Portage Township, City of South Bend, St. Joseph County, Indiana and being a part of Kennedy Park and is more particularly described as follows: Beginning at the North right of way line of Bendix Drive and the East right of way line of Goodland Avenue; thence North 360 feet, more or less, to a line of utility poles; thence East along said pole line a distance of 245 feet, more or less, to a fence; thence South along said fence line a distance of 175 feet to a point where the fence turns East; thence East along said fence line a distance of 230 feet, more or less to a City sidewalk; thence South along said sidewalk and another fence line a distance of 163 feet, more or less to the North right of way line of Bendix Drive; thence West along said North right of way line a distance of 450 feet to the place of beginning. Containing 2.776 acres, more or less subject to all legal highways and easements of records. Every year, the staff at the SBACC Shelter manages over 4,000 animals. The officers, who are available 24/7, 365 days of the year, do their best to answer all calls regarding stray animals, lost animals, abused animals and neglected animals. The kennel staff, that is available 7 days a week, year round, does its best to provide compassionate care for all the animals that find their temporary home at the shelter. Unfortunately, for the staff and for the animals, the current facility is extremely inadequate for the work that they do. The current facility is a century-old building that was converted from a vacated fire station into a shelter in 1996. The 3,100 square foot facility is severely limited in space. Bearing in mind that on any given day SBACC provides a temporary home for up to 100 animals; the current facility only allows for 17 kennel runs, 12 dog cages and 23 cat cages. As well as the space limitations, the building has several structural issues as a result of its age. For example, the building has appalling drainage problems due to the aging plumbing. Another issue with the building is the lack of adequate ventilation and air flow. Air flow and ventilation become a particular problem when there is a sick animal in the shelter. Several of the common pathogens that affect animals are airborne pathogens. Wrthout adequate airflow and /or the space to quarantine the sick animals, these diseases spread rapidly amongst all the animals. The new facility would nearly quadruple the size of the existing facility and will increase adoptions and volunteerism. Unlike the current 3,100 square-foot facility, the new 9,378 square-foot shelter would give SBACC ample room for additional kennels and cages as well as room for: Its own spay-neuter clinic, an expanded lobby and reception area, an adoption preparation area for bathing and grooming of animals, interaction room for families to meet with prospective pets, a confined area to unload animals from vehiGes, a secure area for the quarantine of bite case 8~ dangerous animals, a treatment area for sick and injured animals, a secured area that is protected from the elements for after-hours drop-offs. In 2009 South Bend Animal Care &~ Control responded to 4,558 calls for service, 712 after hour calls and handled 3,852 Domestic animals. Of those animals 357were adopted out, 414 were returned to their owners and sent 344 to other rescue organizations. SBACC also assisfed 249 wild animals. SBACC hosted the Neuter Scooter, a mobile spay/neuter clinic, on 9 visits allowing more than 500 families and 7 rescue groups get 1,008 cats spayed or neutered. CARE (Community Animal Rescue Effort) of South Bend held several fund raisers/adoption events, Friend raiser ~ SB Chocolate Cafe, No Spay no Neuter No Service with Hacienda, Run Ten Ten (10 K & Mutt March), Curl up with a critter book sale with Borders, Howl-O-Ween costume party ~ Howard Park, Skating Party with Parks Department, Santa Paws ~ PetSmart, PetSmart Spring and Fall National Adoption Event. SBACC has begun a partnership with Brown Mackie College Veterinary Technology Program. Thru this program we have been able to have nearly 100 animals health checked, treated, vaccinated, diagnosed and tested for certain diseases. Additionally more than 40 animals were spayed/neutered and no cost to the City of South Bend. This partnership benefds the students by providing experience in animal care in a kenneling environment, valuable animal handling skills, practical medical skills, as well as education/insight they can take into practice obtained from shelter experience including the- end result of animal overpopulation and animal abuse 8~ neglect issues. SBACC animals benefit by receiving vaccinations, medical screening tests, medical treatment, grooming, human interaction and care and spay 8 neuter surgery. Existing shelter cLD 105 S. The top photos show the animal shelter in Hendricks County Indiana that was constructed in 2009. Tom Famy of Grinsfelder Associates Architects designed the facility and supervised the construction. Chain link fence walls allow aggressive dogs to attack dog in adjacent kennel. Garage that will provide a secure enclosed area for unloading animals preventing them from escaping. This poses two dangers to families entering the shelter.
