Tax Sale Properties — On Acquisition List

At various times over the past few years, the Commission has approved the attached five
properties to be added to the Airport Economic Development Area. These properties are
now up for bid on the County Commissioner's tax sale list. Staff feels purchasing these
properties from the tax sale will allow for much lower costs in the acquisition process.
Four of these parcels are vacant lots. Staff has not been able to locate their owners. Two
of the four are in the Oliver Plow retention basin expansion project area. The other two are
in the Indiana Avenue / Taylor Street acquisition area approved by the Commission last fall.
The fifth property, on South Michigan Street, is a property that was added when the
Commission was trying to clean up this area, but was never purchased. This lot has a
dilapidated building on it, and is an eye sore to the area. The Commission owns the two
adjacent properties north of this parcel, and an additional parcel two lots further north.
Staff feels if we can get this property at little cost, it would facilitate the clearing of this
property, and add value to the neighborhood.
Since these properties are already on the Area's acquisition list, staff requests approval to
take the necessary steps to register and bid on those parcels, in a not to exceed amount of
$50,000.

RESOLUTION NO. 2654
A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION
RELATED TO ACQUISITION OF PROPERTY
WHEREAS, under the authority granted by Indiana Code § 36 -7 -14, et seq. and
in furtherance of the Airport Economic Development Area Plan ( "Plan "), the South Bend
Redevelopment Commission ( "Commission ") has determined that it is necessary to
acquire unencumbered fee simple interest in certain properties located within the area
heretofore designated as the Airport Economic Development Area (the "Area ") within
the City of South Bend, Indiana (the "City "), which properties are more particularly
described at Exhibit A attached hereto and incorporated herein ( "Properties "); and
WHEREAS, the Commission has added the Properties listed in Exhibit A to the
Acquisition List by amending the Plan and adding the Properties to the Area's acquisition
list; and
WHEREAS, the Properties have been placed on the St. Joseph County Tax
Sale Certificate Sale; and
WHEREAS, appraisals of the Properties would indicate that an offering price
not to exceed the assessed value of each of the Properties (the "Offering Price ") is
reasonable and in accordance with § 36- 7- 14- 19(b); and
WHEREAS, the Commission now desires to authorize its authorized agents,
hired for such purposes, or the staff of the Commission to register for and bid upon the
Tax Sale Certificates for each of the Properties up to the Offering Price for each Property;
and
WHEREAS, the Commission finds that all procedures necessary for
authorizing and acquiring the Property have been completed in accordance with Indiana
law;
NOW, THEREFORE, BE IT RESOLVED by the South Bend
Redevelopment Commission that:
1. Authorized agents of the Commission and the staff of the Commission are
hereby authorized and directed to register for and bid upon each of the Tax Sale
Certificates for each of the Properties as described at Exhibit A.
2. The Commission's agents and attorneys are hereby authorized and
directed to take all steps necessary to accomplish the acquisition of the Tax Sale
Certificates for each of the Properties in accordance with this Resolution and in a manner
acceptable to the Director of Economic Development and legal counsel.
3. Don Inks or Jeff Gibney is authorized to execute on behalf of the
Commission any documents necessary to carry out the intent of this resolution.
ADOPTED at a Regular Meeting of the South Bend Redevelopment
Commission held on February 19, 2010, at 1308 County -City Building, 227 West
Jefferson Boulevard, South Bend, Indiana 46601.
