Committee Chair John Voorde called to order the Public Works and Property Vacation
Committee meeting at 4:02 p.m. He introduced members of the Committee and proceeded to
give the floor to the presenters.
Bill No. 69-17- Street & Alley Vacation for property located on Corby St. & Eddy Street(5
Corners, LLC)
Mike Danch,Danch, Hamer& Associates with offices at 1643 Commerce Drive, stated, I am
representing the petitioner for this legislation. He provided a handout(available in the City
Clerk's Office). He continued, You have already had the public hearing for this. You were
waiting for the report from the Department of Public Works for this street and alley vacation.
They are in support of this. We were also asked at the last meeting to meet with the neighbors.
We did that and we have crafted an agreement with the Spaldings. That agreement gives them
rights to go over a portion of the property for their driveway. This agreement would also apply to
Mr. Bakos,the other neighbor. There is no specific land-use for this. We are just assembling the
property for 5 Corners, LLC.
Committee Chair Voorde opened the floor to questions from the Committee and
Councilmembers.

Councilmember Tim Scott stated, I was told that Mr. Bakos was asking for a postponement on
this.
Committeemember Jo M. Broden stated, His concern was the service plan for basic City-
services. Will there be a formal ingress/egress relative to his property?
Mr. Danch replied, This agreement would allow him to use this as well,yes. He is not directly
mentioned in the agreement, but the Spaldings are allowed to give him permission to use the
easement. That is all in public record.
Committeemember Broden then followed up with a few specific questions regarding trash pick-
up. Mr. Danch answered all of her questions to Councilmember Broden's satisfaction.
Committee Chair Voorde then opened the floor to members of the public wishing to speak in
favor of or in opposition to the legislation. There were none. He then turned the floor back to the
Committee for further comment or main motion.
Committeemember Gavin Ferlic made a motion to send Bill No. 69-17 to the full Council with
no recommendation. Committeemember Broden seconded this motion which carried
unanimously by a voice vote of three (3) ayes.
With no further business, Committee Chair Voorde adjourned the Public Works and Property
Vacation Committee at 4:12 p.m.
