Committee Members Present: John Voorde, Jo M. Broden Committee Members Absent: Randy Kelly, Gavin Ferlic Other Council Present: Karen White, Dr. David Varner, Tim Scott, Regina Williams-Preston, Oliver Davis Other Council Absent: None Others Present: Kareemah Fowler, Graham Sparks, Bob Palmer Presenters: Joe Hart, Steven Cox, Rich Estes Agenda: Bill No. 47-17- SB Cubs Cul-de-Sac Vacation Committee Chair John Voorde called to order the Public Works and Property Vacation Committee meeting at 4:00 p.m. He introduced members of the Committee and declared there to be no quorum, rendering the Committee incapable of committing any official action. He then gave the floor to the presenters for the legislation. Bill No. 47-17- SB Cubs Cul-de-Sac Vacation Joe Hart, President of the South Bend Cubs, stated, We are looking at the vacation of the dead- end on William Street which is located on the left side of our team store. We are looking to relocate our Fun-Zone as part of the new development of Ivy at Berlin Place. We are working with the City to relocate the Fun-Zone over to that section. I also talked to Mr. Jaworski who lives in the house nearby and he doesn't seem to have any concern. By relocating the Fun-Zone over there it would give more space to the stadium. Committee Chair Voorde opened the floor to questions from the Committee and Councilmembers. Councilmember Karen White asked,No one has spoken in opposition at all? Broden asked, Will there be any turn-around or area for folks to enter the road? Mr. Hart replied, Our folks with JPR have worked on that and there will be a turn-around for Fire and Safety vehicles as well as parking lot access. On game days there is quite a bit of traffic which we deem to be a little unsafe so this will actually help eliminate some of the traffic issues. Steve Cox, Chief of the South Bend Fire Department located at 1222 S. Michigan Street, stated, We had some planned review around that issue associated with it but our concerns have since been resolved. Richard Estes, representing the City of South Bend Public Works and Community Investment with offices on the 13th and 14th floor of the County-City Building, stated, We had a turn-around easement filed with us. Committeemember Broden asked, Does the church still have Historical Preservation status and does this in any way impact that? Mr. Hart replied, I don't believe it would impact it in any way at all. Mr. Estes stated, We aren't doing any work to the church, we are only in the area adjacent to the church. Committee Chair Voorde then opened the floor to members of the public wishing to speak in favor of or in opposition to the legislation. Murray Miller, 23698 Western Avenue, stated, It would harm public access through and around the facility. It will limit what the owner of the house can do. The City has given a lot to the Berlin project and this will take a lot of value out of that and I am opposed to this. Mr. Hart responded, We don't see any restriction that comes of this. We talked to that neighbor and we let him know his parking would still be available on game nights and work with him on anything he would need. Councilmember Broden asked, Do you have ownership of that team store or is it a lease agreement?Was my Historic Preservation question out of the blue? Mr. Hart responded, It is a lease agreement. Kurt Meade, 63483 Miami Road, stated, I am opposed to this because the South Bend Cubs should be paying a fair price for the land. Richard Whiteman, 51611 Cherry Road, stated, I also rise in opposition to this. I think the South Bend Cubs should pay fair market value for the property they are asking for. I think it is only fair considering how much the City has already given them. 2 �I Mr. Hart responded, We aren't actually looking for ownership of the property. It is Park land so the South Bend Cubs would not be owning the property, it would be owned by the Parks Department. We pay a lease as well as a ticket surcharge based on attendance. We currently pay approximately eighty thousand dollars ($80,000) a year and the ticket surcharge runs approximately forty five thousand dollars ($45,000). We also pay the utilities for the property. With no further discussion and no quorum,Bill No. 47-17 was sent to the full Council with no recommendation.
