The minutes of the December 11`h, 2017 meeting of the Common Council therefore will not be accepted until the Common Council Meeting on Januau 22nd, 2017. SPECIAL BUSINESS BILL NO. 18-01 HONORING FORMER SOUTH BEND COUNCILWOMAN BEVERLY DELORES (MUNGER) CRONE Councilmember Oliver Davis, 1801 Nash Street, South Bend, IN, served as the presenter of this bill. Councilmember Davis called members of Mrs. Crone's family to join him at the podium. Councilmember Karen White, stated,A Resolution of the Common Council of the City of South Bend, Indiana commemorating and celebrating the life and public service of Beverly D. Crone. Whereas, after twenty years in bookkeeping and accounting, Beverly D. Crone first sought 1 REGULAR MEETING January 8, 2018 elective office as a member of the South Bend Common Council in 1979; and, Whereas, Beverly was successful in her bid and was elected a Councilmember-at-Large and reelected in 1983; and Councilmember Oliver Davis stated, Whereas, Beverly chose to leave the Common Council after two terms to fill a vacancy in the St. Joseph County Auditor's office; and, Whereas, Beverly became the first woman to serve as the St. Joseph County Auditor, a position for which she was elected for two terms and held for ten years; and, Whereas, Beverly chose to leave the St. Joseph County Auditor's office to run for a position as a St. Joseph County Commissioner; and Councilmember Jo M. Broden, stated,Whereas, Beverly was again successful in her bid and, along with Cindy Bodle, became the first woman to serve as a St. Joseph County Commissioner; and, Whereas, Beverly served two terms as a County Commissioner, including a term as the first woman President; and, Whereas, Beverly's dedication to public service is demonstrated by the thirteen elections in which she ran, all successfully; and, Whereas, Beverly received many awards during her lifetime including the Sagamore of the Wabash award from the Governor of Indiana; the Women's Fest Lifetime Achievement Award; the Ideal Baldoni Distinguished Achievement Award; together with the keys to the Cities of South Bend and Mishawaka as well as St. Joseph County; and, Whereas, the many physical manifestations of Beverly's public service include the Beverly D. Crone Park; the Thomas N. Frederick Juvenile Justice Center; the Mishawaka AM General Plant; the UN Tek facility; the restored 1855 St. Joseph County Courthouse; and Councilmember Regina Williams-Preston stated, Whereas,Beverly's legacy will continue not only through her good works in the local community, but also through the lives of her children, grandchildren, great-grandchildren and all others who love and admire her. Now, Therefore, be it resolved, by the Common Council of the City of South Bend, Indiana, as follows: Section One (1). The South Bend Common Council proudly commemorates and celebrates the life and achievements of one of the community's great citizens, Beverly D. Crone. Section Two (2). The Common Council offers Beverly's family and friends its most sincere condolences on Beverly's recent passing on December 31, 2017 after a lifetime of public service. Section Three (3). This Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. Councilmember Oliver Davis stated, It is truly an honor to serve with my colleagues as we take the time to honor a distinguished woman.All throughout this whole City and throughout this whole community, we can see that her life and her legacy is speaking for her—and it continues to speak for her in the life of her sons and their families. Councilmember Karen White stated, It has indeed been an honor to be a part of this resolution on behalf of such a wonderful, outstanding lady. Her legacy does speak for itself. She's a woman of honor. She's very honest—she'll tell you like it is. She's a hard worker, and she's committed not only to excellence but she's committed to this community, and we have been the beneficiaries of her great work. Councilmember Regina Williams-Preston stated, Being new to public service, being a woman, and have the opportunity to serve in some of the same capacity that she has, I really look forward to learning more about Mrs. Crone from my colleagues—people who served with her. It's an honor to be a part of this resolution,to just be able to recognize someone who's really forged a pathway for women in public office here in our community. Councilmember Jo M. Broden stated, I'm so proud to be a member of this Council that is taking tonight especially to recognize Bev's tremendous contribution to our city,to our county, and really to our state. In terms of her public service—not only just bringing an amazing skillset, but also just the fabulous disposition of really understanding issues, attentiveness to the public, and the true service. I know that comes from her life of faith and I also know that it's enabled by a family that shared her so generously. I would be remiss not to thank you, gentlemen, and the larger family at whole, because when someone serves with her length, breadth, and depth, it really is a family commitment and a family project. She is,was, and always will be a trailblazer for Councilmembers—regardless of whether female or male—and public servants in general. Very, very tough shoes to fill, I think, for anybody who has followed after her. Councilmember Broden offered her condolences to Mrs. Crone's family and thanked them and her fellow 2 REGULAR MEETING January 8, 2018 Councilmembers, adding that her comments in remembrance of Mrs. Crone are echoed by Councilmember Broden's husband. Terry Crone, 418 Shoemaker Drive, Carmel, IN, thanked the Council for the resolution on behalf of the Crone family. Mr. Crone stated, It's very gratifying to see people remember Mom and respect the work that she did. Things were a lot different back in 1979. She had a full career, raised her kids before she decided to try to get into public service, and,back in those days, not only were there a lot fewer women and it was a lot more difficult path for women than it is today, but you did things differently. She and Dad and I would sit down at the kitchen table to have what we used to call a"kitchen table campaign"back then, because you didn't have a lot of money. One (1) of the things you did back then was—particularly when you were a newcomer— to try to come up with a slogan that people would associate with you and differentiate you from the others. Mom's slogan that she came up with at that time, which we used through all thirteen (13) of those elections was: "The key to good government is participation."Anybody who knew my mom knew that she didn't say anything that she didn't mean and believe. So, I'm very proud of the fact that she decided to participate in our government and believed that government requires people to be active and participate in order to operate properly, and that means you have to work hard. I believe that many of the things that she did, and the respect that's been expressed through this process, is a result of the fact that she was more interested in getting things done than she was interested in taking credit. She didn't care whose idea it was. She worked with people on both sides of the political spectrum, and tried never to make a permanent enemy and understood that politics is a game of inclusion not exclusion.And, while we may not agree today, if you treat people with dignity and respect, you may be able to work with them tomorrow to accomplish something else. Councilmember Gavin Ferlic stated, Condolences to the family, and, obviously, she leaves behind a great legacy. I spoke with Dr. Varner on an unrelated matter, in between Committee and Council, and he also wanted to share his condolences and say what a pleasure it was to know your mom. Thank you. Councilmember John Voorde stated,There are so many things to say, but I think we should acknowledge her fourth son who lost,really, another mom when Bev passed—and that's Butch Morgan, who she helped raised and was really the fourth of you guys. I met Bev during that primary campaign in 1979. I gravitated toward Bev as we made our stops. In those days, it was the political clubs—things that no longer exist—and campaigning in those days, too, required factor gates and things like that. But I gravitated toward Bev to the point where Phil, her husband, would come tug on my arm or Beverly's arm and say, "You got to talk to other people, you can't just talk to him all night." I don't know if people remember, but when that primary election day was over and the votes were counted, Bev lost. Bev came in fourth in that three (3) way race for At-Large, and I was sick about it because, of course, I wanted to win and I was one (1) of the three (3). But,the next morning, after the County Election Board counted all of the votes, Bev was declared winner, and there was nobody happier, I think—other than her family— than me, because...I'm sure going to miss her. Councilmember Tim Scott stated, I did not have the opportunity to know Bev. I love that saying, "The key to good government is participation," and I've taken that from her now, so I appreciate that. My condolences. Councilmember Randy Kelly stated, I am also terribly sorry for your loss.A remarkably distinguished career, and I want to echo the fact that she was also such a trailblazer. I am, again, terribly sorry for the loss but thrilled with what she brought to our community, which we continue to enjoy to this day. This being the time heretofore set for the Public Hearing on the above bill, proponents and opponents were given an opportunity to be heard. Those from the public wishing to speak in favor of this bill: Beverlie Beck, 1630 Randolph Street, South Bend, IN, stated that she went to school with Ms. Crone before the two (2) of them served together as the first two (2) women on the City Council. She stated that though they did not vote alike every time, they both voted with the City's interests in mind and convened to give each other updates on their respective families. Ms. Beck stated, 3 REGULAR MEETING January 8, 2018 So sorry she had to go so soon, because she was my age, and she could have been here a lot longer. Jason Critchlow, 221 Marquette Avenue, South Bend, IN,thanked the Council for considering this resolution. Mr. Critchlow stated that Ms. Crone was always campaigning, always serving the community, but she also believed that it did not matter who you were if you were dedicated to your community—willing to do what must be done, to work with whomever must be worked with to move the community forward. He stated, That's really the culture that I've always been surrounded with, so, thank you for sharing her with us, and that's the legacy that I will always take with me and remember. None from the public wished to speak in opposition to this bill. Councilmember Gavin Ferlic made a motion to adopt Bill No. 18-01 by acclamation. Councilmember John Voorde seconded the motion which carried by a voice vote of eight(8) ayes. REPORTS OF CITY OFFICES Representing the City Administration: Suzanna Fritzberg, Deputy Chief of Staff RESOLVE INTO THE COMMITTEE OF THE WHOLE At 7:24 p.m. Councilmember Oliver Davis made a motion to resolve into the Committee of the Whole. Councilmember John Voorde seconded the motion which carried by a voice vote of eight (8) ayes. Councilmember Gavin Ferlic, Chairperson,presiding. Councilmember Gavin Ferlic explained the procedures to be followed for tonight's meeting in accordance with Article 1, Section 2-11 of the South Bend Municipal Code. PUBLIC HEARINGS BILL NO. 69-17 PUBLIC HEARING ON AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTIES: STREET VACATION-EDDY STREET FROM CORBY STREET SOUTH 180 FEET+/-, CORBY STREET FROM EDDY STREET WEST 90 FEET+/-, CORBY STREET FROM EDDY STREET EAST 230 FEET+/-,THE FIRST EAST/WEST ALLEY BETWEEN HOWARD STREET ON THE WEST AND THE FIRST NORTH/SOUTH ALLEY EAST OF SOUTH BEND AVENUE, SOUTH BEND, INDIANA Councilmember John Voorde, Chair of the Public Works and Property Vacation Committee, reported that they met this afternoon and send this bill forward with no recommendation. Greg Shearon, Danch, Harper&Associates, Inc, 1643 Commerce Drive, South Bend, IN, served as the presenter of this bill. Mr. Shearon stated, We are here representing Five Corners, LLC, for the four(4) right-of-way vacations that were just read into the minutes. The purpose for these vacations is for future development. Right now,there's no particular plans of what's to be developed. I believe the property is zoned Residential, so right now what could be developed is Residential without coming back to this committee for a rezoning. In the pre-board meeting, there was some mention of the easement agreement that was written for Spalding, a property 4 REGULAR MEETING January 8, 2018 owner adjacent to the Corby right-of-way that's to be vacated,which gives her the right to have access into that right-of-way that's been vacated. Per that meeting, it was stated that it also would give Mr. Banios or his assigns the right to use that easement. So, I just wanted to put that in the record, and if you would like that to be a part of the access agreement, let it be written in, as well. Councilmember Oliver Davis asked Council Attorney Bob Palmer, Is that good enough for it to be considered in the record, or does he have to say anything else in any other way? Council Attorney Bob Palmer responded, It's good enough for the record,but it would be stronger if we had a written agreement filed with the Clerk's Office, much like Ms. Spalding. Mr. Shearon responded, We can amend this agreement and put Mr. Banios and his assigns into this document. We can do that. Councilmember John Voorde asked, So, action tonight could be contingent upon that agreement? Mr. Palmer responded, It could be a condition that preceded the enforcement of the adoption of said measures of the sub. Councilmember Jo M. Broden stated, I think that really addresses a lot of the issues with regard to City services and it should mutually benefit both the developer and the adjacent neighbors in particular. So, I commend everybody for working something out here that will be workable now and in the future. This being the time heretofore set for the Public Hearing on the above bill, proponents and opponents were given an opportunity to be heard. Those from the public wishing to speak in favor of this bill: Emily Spalding, 1140 Corby Boulevard, South Bend, IN, stated that she is the adjacent neighbor in question. Ms. Spalding thanked Councilmember Broden for hearing her and other neighbors out, and thanked Five Corners, LLC, as well. None from the public wished to speak in opposition to this bill. Councilmember Jo M. Broden made a motion to send Bill No. 69-17 to the full Council with a favorable recommendation, subject to the written agreement. Councilmember Oliver Davis seconded the motion which carried by a voice vote of eight(8) ayes. 85-17 PUBLIC HEARING ON AN ORDINANCE INITIATED BY THE AREA PLAN COMMISSION OF ST JOSEPH COUNTY, AMENDING CHAPTER 21 OF THE SOUTH BEND MUNICIPAL CODE,ARTICLE 9 ADMINISTRATION TO UPDATE PROCEDURES FOR ZONE MAP AMENDMENT,VARIANCES, SPECIAL EXCEPTION USES,AND WRITTEN COMMITMENTS ASSOCIATED WITH AREA BOARD OF ZONING APPEALS APPLICATIONS;ARTICLE 11 DEFINITIONS TO FURTHER DEFINE THE ZONING ADMINISTRATOR AS THE EXECUTIVE • DIRECTOR OF THE AREA PLAN COMMISSION;AND ARTICLE 12 FLOODPLAIN REGULATIONS TO DESIGNATE THE BUILDING COMMISSIONER AS THE FLOODPLAIN ADMINISTRATOR. Councilmember Oliver Davis, Chair of the Zoning and Annexation Committee,reported that they met this afternoon and send this bill forward with a favorable recommendation. 5 REGULAR MEETING January 8, 2018 Angela Smith,Area Plan Commission, with offices on the 11th Floor of the County-City Building, South Bend, IN, served as the presenter of this bill. Ms. Smith stated, This text amendment is sort of an administrative cleanup and a way to transition the City Administration, from the Building Department to the Area Plan Commission. The first portion deals with how rezoning petitions are filed. For all of 2017, we had an expedited process where people filed with the Area Plan Commission instead of the Clerk's Office. We handled a lot of the paperwork for them. This tidies up and catches the ordinance up to the current procedures we've been using for the last year. The other part of this ordinance is that any place where the Building Department was listed as where requests related to the Area Board of Zoning Appeals should be filed, we were changing that to the Area Plan Commission. There was one (1) instance where we needed to change from the Zoning Administrator to the Building Commissioner for the floodplain. "Check below, as the Building Commissioner will retain floodplain administration." So,that's all handled in this ordinance. This comes to you from the Area Plan Commission with a favorable recommendation. This being the time heretofore set for the Public Hearing on the above bill,proponents and opponents were given an opportunity to be heard. None from the public wished to speak in favor of or opposition to this bill. JOSEPH COUNTY AMENDING CHAPTER 21 OF THE SOUTH BEND MUNICIPAL CODE,ARTICLE 10 ENFORCEMENT BY ADDING THE AREA PLAN COMMISSION TO THE DESIGNATED ENFORCEMENT STAFF. Councilmember Oliver Davis, Chair of the Zoning and Annexation Committee, reported that they met this afternoon and send this bill forward with a favorable recommendation. Angela Smith,Area Plan Commission, with offices on the 11 th Floor of the County-City Building, South Bend, IN, served as the presenter of this bill. Ms. Smith stated, This section deals with the enforcement chapter of the ordinance. We wanted to treat this as separate from the last text amendment just so we had a better opportunity to work with Code Enforcement and the Building Department to help define their proper roles. What this essentially does is allows for the Area Plan Commission as the zoning enforcement agency, along with the Building Department and Code Enforcement.Anything that was previously under the primary responsibility of Code Enforcement will be retained and the Building Department will still have the authority to enforce any of the ordinances that they need to, as well. This comes to you from the Area Plan Commission with a favorable recommendation. This being the time heretofore set for the Public Hearing on the above bill,proponents and opponents were given an opportunity to be heard. None from the public wished to speak in favor of or opposition to this bill. Councilmember Oliver Davis made a motion to send Bill No. 86-17 to the full Councir with a favorable recommendation Councilmember Tim Scott seconded the motion which carried by a voice vote of eight(8) ayes. 87-17 PUBLIC HEARING ON AN ORDINANCE INITIATED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 21 OF THE SOUTH BEND MUNICIPAL CODE,ARTICLE 13 6 REGULAR MEETING January 8, 2018 HISTORIC PRESERVATION COMMISSION IN CONNECTION WITH THE TRANSITION OF HISTORIC PRESERVATION STAFF TO THE CITY OF SOUTH BEND UNDER AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF SOUTH BEND AND ST. JOSEPH COUNTY. Councilmember Oliver Davis, Chair of the Zoning and Annexation Committee, reported that they met this afternoon and send this bill forward with a favorable recommendation. Angela Smith,Area Plan Commission, with offices on the 11th Floor of the County-City Building, South Bend, IN, served as the presenter of this bill. Ms. Smith stated, This has to do with what was before you late last year: the transition of the Historic Preservation Commission. There's a chapter of the zoning ordinance that deals with the day-in responsibilities of that department. There were many things that needed to be adjusted,just to handle the day-to-day activities. It was written, actually, and highly vetted by all the attorneys involved. This comes to you from the Area Plan Commission with a favorable recommendation. Councilmember Oliver Davis stated for clarification that though he reported the committee's recommendation, it is a committee chaired by Councilmember Gavin Ferlic, not him. Councilmember Randy Kelly made a motion to continue Bill No. 17-75 indefinitely. Councilmember Gavin Ferlic seconded the motion which carved by a voice vote of eight(8) ayes. BILLS FIRST READING BILL NO. 01-18 FIRST READING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA AMENDING CHAPTER 2 (ADMINISTRATION)AND CHAPTER 6 (BUILDING) OF THE SOUTH BEND MUNICIPAL CODE, BY REMOVING ZONING ADMINISTRATION AND AREA BOARD OF ZONING APPEALS FROM THE RESPONSIBILITIES OF THE BUILDING DEPARTMENT AND REMOVING ASSOCIATED FEES. Councilmember Karen White seconded the motion which carried by a voice vote of eight(8) ayes. 02-18 FIRST READING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA,AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION BONDS FOR THE PURPOSE OF PROVIDING 9 REGULAR MEETING January 8, 2018 FUNDS TO PAY FOR CERTAIN CAPITAL PROJECTS AND INCIDENTAL EXPENSES IN CONNECTION THEREWITH AND ON ACCOUNT OF THE ISSUANCE OF THE BONDS,AND ALL MATTERS RELATED THERETO. Councilmember Oliver Davis seconded the motion which carried by a voice vote of eight(8) ayes. 05-18 FIRST READING ON AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 3527 LINCOLN WAY WEST, COUNCILMANIC DISTRICT NO. 1 IN THE CITY OF SOUTH BEND, INDIANA Councilmember John Voorde made a motion to send Bill No. 04-18 to the Area Plan Commission on February 20th, 2018 and to the Zoning and Annexation Committee, and set it for Second Reading and Public Hearing on February 26th, 2018. Councilmember Oliver Davis seconded the motion which carried by a voice vote of eight(8) ayes. UNFINISHED BUSINESS Councilmember Jo M. Broden stated that members of the Council should have in their inboxes resolutions being considered by the Solid Waste Management District. Councilmember Broden stated that a ten(10) year contract with a five (5) year out-clause is being considered. The other resolutions were related to household hazardous waste, one(1) of which considers charging everyone in the county, while the other considers a fee that would be those who are recipients of curbside services. Councilmember Broden encouraged Councilmembers to look over the 10 REGULAR MEETING January 8, 2018 resolutions and get back to her. Councilmember John Voorde stated that the next meeting of the Solid Waste Management Board is on February 12th, 2018. NEW BUSINESS There was no new business. PRIVILEGE OF THE FLOOR Sharon Banicki, 3822 Ford Street, South Bend, IN, stated that residents are pleased with the plowing in the city but Ms. Banicki urged the City to put out notice for alternate parking earlier in the process, stating that though the main streets look good, side streets are in bad shape. Ms. Banicki also stated that the 3800-3900 block on Ford Street needs new curbs. She stated, The sidewalks are fine, but we will be losing them,though, if we don't do something with curbs. So, keep us in mind when it's time for your allotment of money. Councilmember Tim Scott stated, Ms. Banicki,the Council officially recognizes and congratulates you on a grandbaby. Ms. Banicki thanked Councilmember Scott, adding, Isn't he such a cutie?
