A petition for a light at the intersection of McPherson and Sample Streets was orde
j ed placedon file until sufficient funds are available to new instillations.
Upon the recommendation of City Engineer, William S . Moore, plans were approved
for cuts in curb for driveways at 222 North Michigan Street for a proposed parking lot
at the above address.

Your petitioner would show that he is the legal owner of the following described
j real estate situate in the City of South Bend, Indiana, St. Joseph County, to -wit:
A small tract of land in the North part of the B,,st Half of the Northeast Quarter
i of Section Nine (9). Township Thirty-seven (37) North, Range Two (2) East, bounded
by a line running as follows: Beginning at a point sixty (60) feet east of the
So$ta.heast corner of Block Numbered Ten Hundred "ighty-five (1085) as shown on the
Oecond Plat of LaSalle Park, in tie City of South Bend, as recorded in Plat Book
Number Bight (8) on Pages 30 and 31 of the Records of said County, which point
is at the intersection of the North line of West Washington Street with the Bast
line of Falcon Street, thence East on the North line of West Washington street ,
one hundred twenty-nine (129) feet- thence North on a line parallel with Falcon

Street four hundred sixty-two (462JI feet; thence West one hundred. twenty-nine (129)
{ feet to the East line of Falcon Street; thence south on said. line four hundred
sixty two (462) feet to the place of beginning; estimated to contain a little more

Beginning one hundred twenty (120) feet north of the Northeast corner of Washington
and. F&lcon Streets, theme North three hundred forty-two (432) feet; thence east 129 !
feet ; thence ''outh three hundred forty-two (542) feet; thence West one hundred twenty
nine (129) feet to the p la ce of beginning.

That the total assessment levied ageinst the last above described real estate was Onl
One Thousand and Four and 99/100 Dollars ($1004.99) ; that the i#stallement s of said
special assessments payable 1929, 1930 and 1931, have been paid but that the installment
payable in 1932 in the sum of One Hundred and 49/100 Dollars (100.49) is delinquent , whil�
which with penalties rnd interest now amounts to One Hundred Sixty -Nine Dollars (169.00)1;
that the installment of said special assessment payable in1933 in the sum of One hundred4
and 49/100 (100.49) is delinquent, which with penalties and interest now amounts to

improvement known as Falcon Street, Grade, Curb and Valk from Jefferson to Colfax Avenue

Your petitioner would. further show that title to said Heal .-state appee red of
record An the name of 'alph Jones. That notice of said improvement was sent to the
said Ralph Jones, and your petitioner, who inherited said real estate from his said
fether, Samuel Whitehall, never received notice of said improvement; that said improve -I.,
ment was not waivered and. there is now due on said improvement the sum of five hundred I

Your petitioner would further shod that Credd Jarett is the purchaser under land
contract from this petitioner of the following
described, Real Kstate, situate in said.
City, county and State, to -wit:
Beginninp on the test line of F lcon Street in the City of South bemd at a point
one hundred twenty (120) feet North of the North line of `«ashington Street,, in said
Uity; thence East one hundred twenty-nine (129) feet; thence North forty (40) feet-'i
thence Viest one hundred twenty-nine (129) feet; thence South forty (40) feet to be-
ginning, and being the North forty (40) feet of the Oouth one hundred sixty (lc)o)
feet of Lot Numbered Ten hundred -tiFhty Six (1086) as shown on a proposed, plat of
LaSalle Park.
Your petitioner would further show that said improvement assessments above de-
scribed are a lien against said real estate; that the said Creed Jarett has applied
for a loan through home Owners Loan Corporation to pay off said contract; that in
order to secure said loan all assessment for public improvement now due or past due
must be paid; that said home Owners Loan Corporation will pay said assessments now
due or past due levied against the above described Real Estate.
Your petitioner would further show that the City Treasurer is unable to separate
and. divide the assessments for public improvement hereinbefore mentioned so that the
amount due against the above described Real Estate may be determined.
*Wherefore, your petitioner prays that an order be entered directing the City 11•
Engineer, together
_ether with the City Controller, to respread said assessments so that the
amount due afrainst said lest described Real Estate will epprea of record, and for
all other relief right and -proper.
