of meeting held Tuesday, February 28th. , 10,33, read and- approved.

The Board approved the excavation bond in the sum of 111, 000. 00 written in
favor of sleek Plumbing Uompar4r and executed by the h1pryland Cgsualty Company by
D. Sherm<-n Ellison, attorney -in -fact.

and hereby orders City Controller to pa7T same.

Centlemen: In re: Clair: of Francis Salata.
t,_r. Salata claims that while 'proceeding west on last Jefferson Blvd., his
car hit a hole in the street and caused d emPges enumerated by him. Undoubtedly the
drive of a vehicle has s right to proceed along a street at a reasonable rate of speed
without having holes therein cause blow -outs and other damages to his automobile.
Consequently, if from the facts which you have gathered, it appears that LIr. Salate
had his automobile damaged by a defect in the street while proceecing along said street
I at a reasonable rate of speed and that the officials of your department responsible
for street maintenance either knew of the defect or with reasonable deiligence should
1 have knovrn of the defect., then there is no question cf liability.

It may be that you feel that the price set by him fctr such second hand tires is too

The original claim of Ir. Salata in t.e rrmtter of the damages to his car
amounted to 53.01 but after talking with the Board, he filed a corrected claim in
the sum of 41.58 which was allawed by the Board ane ordered paid through the Finance
Pepartrm nt .
