Minutes of rreetings held. June 18th., and June 21st., 1932, read and approved.
This being the date set, hearing was had on Vacation Resolution No.
2472 for the vacation of the alley situate in a triangular parcel of Arnold's -�,irst
Addition to the City of South Bend., Indiana , vt ich parcel is- bounded on the East by
Grant Street, on the north by Mlerry Avenue: and on the Southerly side by the right -of-
way of the New York Central Railroad. Company
In the above named vacation resolution No.2472 no remonstrators
appeared and, no written remonstrances were filed. A7r. A. H. Huguenard, Attorney for the
Chicago, South Sho-r.e and. South Bend Railroad Company was p.,esent, and the Board adopted

WHEREAS, the Board of Public Works of the City of South bend, County
I, of St. Joseph and State of Ind is na, did on the 31st. , day of May, 1932, adopt a resolu-
tion that it desired and deemed it necessary to vacate the alley running from the west
line of Grant Street to the south line of Merry Avenue in said City of South Bend, more II
particularly described and bounded by a line running as follows:
Beginning at a point which is the southeast corner of Lot Numbered I
Thirty-five (35), as shown on the recorded plat of Arnold's First Addition, which point ;`
is in the west line cf Grant Street; thence running west along the south line of lots
Numbered Thirty-five (35), Thirty-six (316), Thirty-seven (37), Thirty-eight (38) and
Thirty-nine (39), as shown on the recorded. plat of said Arnold's First Addition • thence
running northwesterly along the southerly line of Lots Numbered Thirty-nine (39j, Forty I
(40), Forty-one (41) and Forty-two, as shown on the recorded plat of said Addition, to
the south. line of 1-Terry Avenue; thence west oi. the south line of 11erry Avenue projected
west to the right-of-way of the New York Central Railroad Company; thence southeasterly 1
along the northerly line of said right-of-way to the north line of Lot Numbered r'orty-three
(43) as shown on the recorded plat of said Addition; thence east along the north line
of said Lot Numbered -0orty-three (43) to the west line of Grant Street; thence north
along the west line of Grant Street to the place of beginning; and i
WHEREAS, said Board of Public Works of the City of South Benddid, in
said resolution, fix the 21st. , day of Dune , 1932, at 10 o'clock A. 111 , as the date at
which said Board will receive and hear remonstrances from persons interested in or
affected by said proposed bacation and vrould take final action thereon; and j
WHEREAS, said Board of Public Works of the City of South Bend, Indiana
did give notice of such resolution -and of the time when said Board of Public V�orks would
receive and hear said remonstrances by publication of said notice once each week for
two (2) consecutive weeks in the South Bend 'tribune and South Bend. News Times, two
daily newspapers of peneral circulation published in the English language in the City of
South Bend, Indiana, the date of said publication being on the 3rd ., day of June , , 1932,
and. the loth. , day of June, 1932; and
NHE'REAS, owing to a failure of a majority -pf the members to be present
t the meeting of this Board of Public Works on the 21st. , day of June, 1932, at 10

WHEREAS, pursuant to said notice, this Board of Public Works of the
ity of South Bend, Indiana , did meet on the 28th. , day of June , 1932, at 10' o' clock

rom persons interested in or affected by the proposed vacation of the alley described

WHEREAS, no remonstrancces have been made or filed with or presented
the Board of Public Works against said proposed vacation, the Board now proceeds to
a.r the same and being fully advised in the premises and having fully considered the
tter of said vacation, said Board now takes final action on said resolution, confirm-
g, without modification, all former action taken on the same;
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the
ity of South Bend, Ind iana., that said Board now in all respects confirms its said oripi
al resolution adopted on the 31st. , day cf May, 1932, vacating the alley hereinabove
escribed and orders H. C. Wray, Uity Engineer, to prepare a list or roll of all owners
r holders of property and all interess therein to be beneficially or injuriously affect-
d by said vacation, which said list or roll shall show with reasonable certainty, in
ddition to the names of the holders or oviners of said property or interest therein,
he description of each piece of property belonging to each person to be affected, either
eneficially or injuriously, which list csr roll shall be filed with the Board of Public

I� BE IT FURTHER RESOLVED that upon the completion of said list, said Board
shall proceed to award the damages sustained and to assess t je benefits accruing to

BE IT FURTHER RESOLVED, that upon the completion of said assessments or
awards , t his Boa. rd sha 11 c au se a writ ten notice to be served upon the owne r of each
piece of property in said list, which notice shall shown the amount of assessment
or award. bo said piece of property, a copy of which said written notice shall be
!j delivered to the weer of said property in person or shall be left at his last usual
ple ce of residence in the City of Ooath bend , Ind Tana , and in case the residence
i�of any property shall he unknown, or in case said person shall be a non-resident,
then this Board shall give notice showing the amount; of such assessment or award
�I against the separate pieces of real estate of said owner, to be published once
each w eek f or t hre e (3) consecut ive weeks in t he South Bend Tribune and the South
Bend Dw es Time s, tw o da ily newspapers of general circulation published in the English
language in the City of South ljend, Indiana, which notice shell name a_ day not earlier

In the above named improvement resolution No.2473, the Board, hereby orders
i that on the 19th. , day of July, 1932, this -board will meet in their office in the City
lIall -:It 10:00 A. hT.. , to hear and receive remonstrances from all persons interested in
i or affected by said improvement and will decide whether the benefits to the several
lots and parcels of land liable to be assessed for said improvement will be equal to
the estimated. cost thereof. The Board further orders that notices of said hearing
be published. on the 30th., da.y cC Jung_ and on the 7th., day of July, 1932, in the
South bend Nevis Times and. 'Tribune according to law.
The Board approved claims f c:r various departments in the sum of 06,674.95.
The hoerd approved pay roll claims for various departments in the suer. of
$101121.61.
The Board approved pay roll claim for grade separation vrork in the sum of
1433.33 and hereby orders City Controller to pay same out of Grade Separation fund.
The Board authorized the purchase of a Ford Truck for the Engine ring
Department at a cost of $49S.00 from the.Nolycross & Nye, Inc., dealers.
