Is separation of g�,,.6es at Western -Walnut Streets. This Club has been well informed
Ion the steps taken and the progress made in the dealing with the railroads. The
Club feels that if the much desired elevation has not been thus far obtained it is

not due to the lack of efforts on the -oart of the Board. It also feels that with
continued effort and watchfulness over this project the Board. �,.Till bring about a
realization Of this cherished improvenen-t- so necessary on the West Side.
Accept therefore, pentlemen, our eincere-� worlds of appreciation and commenda-
tion for our fine civic spirit and your active � . interest in the welfare of the
c it i zens. Since it is just as easy to praise as to criticise, li,,e choose the former

In. further reference to our donference on 1-larch 25th . , at which
conference, on hehalf of the New York Central, I again requested that the New York
Central be given an extension of one year from L'Iarch 1 for the starting of work under
its agreement with the City of South Bend for the separation of grades at Division
Street, this extension being asked anti based upon the facts set forth in my letter to y
You of ?March 3T 1932. This extensi on was requested for one year upon the consideration
that Within that time there would be such an improvement in this unusual business
depression which would result in the New York Central being financially able to carry
out this grade serara.ti on project.
It was stated in our last conference that Your Board would like,
in view of the fact that there is existing a signed agreement between the City and
the New York Central for this grade separation project and the City has expended cer-
tain sums of monev do contemplation of the project imrlediately going aheadz.

me advise you as definitely as possible as to the position the New York Central
will . take in r ega rd to this improve rant in connection with other improvement s in
other communities which are in the process of begotiation, construction, or signed
a.greemeazt s existing, similier to our s itua Lion in South Bend, or where age e ement s have
not been signed. At our conference I stated and do so now advise you that our Company
fully epprec as tes it would be unfair to South Bend to start work of this type in other
communities along our Railroad 17,izere agreements covering the work have not been
executed or ,T,here the facts are difference. I appreciate that the City of South Bend
is entitled to preference over all projects on our property where the conditions are
not of an emergency type. In other -words , the New York Central will give this im-
provement preference over any- other project where t1- con itions are such that the
municipal authorities or�e public authorities have not started tre improvenent or
done wank in contemplation of the improvement, as has been done in South Bend. As
I advised you at our conference, there are pending in the State of Indiana other im-
provernents on our property of this type where agreements have been executeat, where1.
public authorities have spent large sums of m-�n.ey in contemplation of the immediate
going ahead. with the improvermnt, and I realize that this type of improverent, which
is in the sa.rm category as South Bend, must be given preference. As -I further advlsdd
you at our confe?ence, it is difficult, in view of these facts, to advise you more
definitely in this regard. The New York Central desires to treat the City of South
Bend., taking in consideration all the facts involved, with the utmost fairness, and
it must necessarily also treat other communities with the sane fairness, and I assume
that you would not ask us to do otherwise.
I think that knowing our relations in connection with your City
in the past and the fact that we have spent a very large sum of money in furtherance
Of your grade separ=�tion improvement, that you can be assured that vie 1.ri..11 show the
utmost good faith and fairness to you in connection with this present subject matter.
