Boerd met in regular'session at 10:00 A. M. All members present. Minutes of
meeting held Tue slay, February 2nd . , 1932 , read and approved.
The Board approved the renewal certificate for the excavation bond. in favor
of Arthur Deppert, signed by the Maryland Casualty Company.
This being the date set, hearing was had on the assessment roll fbr the local
i sewer improvement in Iowa Street from Washington A.vEnue to alley north of Western
Avenue under Improvement Res olu ti on INo.2457.
I In the above named assessment roll, no remonstrators appeared and no written
remonstrance was filed and the board, being dilly advised in the premises, finds that
it the several lots and parcels of land have been benefited in the amounts shown on said
roll. The Board, therefore, takes f inal action on said assessment roll and declares
same in all things ratified, confirmed and approved. without modification and the pro
li ceedings closed.. The .hoard now orders said assessnent roll delivered to the Depart -
'I ment of -Finance.
Street Commissioner, Guy D. Staples, f iled the monthly report show ing number
of cars parked in the h1unicipal Parking Ground dumng the month of Jenuary, 1932.
City engineer, H. C. Wray, filed plans and the Board adopted. said plans together
with the fol_loring vacation resolution:

RESOLVED BY THE BOARD OF PUBLIC VRORKS OF THE CITY OF SOvT'H BEND, INDIANA: That
it is desirable to vacate the following:
i That portion of Former Johnson btreet as platted and dedicated in Realty &
Construction Co.'s 1st. , Addition, That lies outside of the present alley west of
Brookfield Street as platted- in the Elwood Manor Addition, from Elwood Avenue to
I Kel 1 er Street.
• The follcwing property may be injuriously and beneficially affected by such
vaca t ion:

Lots 61 to 120 inclusive in Elwood Manor Addition.
Notice of this resolution shall be published on the llth. , day of February and
on the 18th., day of r'ebrunry 1932 in the South Bend Tribune and New-s Times.
This Board, at its office in the City hall on the 1st. , day of March, 1932,

Upon the petition of Samuel, District bolicitor of the Pennsylvania Railroad
System, to construct, and npaintain a single track railroad siding across Test Tutt
Street, in the City of South 4 nd , Indiana,, the Board adopted a form of contract
to be entered into; which. contract form An words and figures is as follows: ,

TRACK SIDING ACROSS GUEST TUTT STREET
This agreement entered. into between the Pennsylvania Railroad Company, party
j of the first p art , and the Board of Public Works of the Municipal City of South Bend,
• j Indiana , party of the second part, WITNESSETEI:
l That whereas the said first party desires to construct and imintain a single
II track siding across Guest Tutt Street East of and adjoining the right of way of the
,,Pennsylvania Railroad Company near the point where said West Tutt Street intersects
j South Main Street in said Cit y, w hic h sa id tracks are upon the right of way of said
Pennsylvania Railroad Company, save and except where the same will cross West Tutt
Ii Street ,
Now, therefore this agreenent, t o-wit : `I`hat the said second party does hereby
ig� ant unto said first party the right to construct and maintain said side track across

agrees to carefully and properly lay and maintain the said tracks across West Tutt
Street at such grade as the Civil Engineer of said city may designate, and said f irst

tracks and to keep said crossing open at all times end upon failure so to do.-ii the said
grant shall become null and void at the option of said second party, and at its
election after such default, said first party will forthwith take up and remove such
side track, a blueprint of the territory affected by this track being herewith
attached end. made a part hereof.

that said Pennsylvania Eailroad Company, at their own expense, shall cause the full
and complete text of said contract to be published as required by law.
The hoard approved p,-..y rolls fbr various departments in the amount of $6,952.29.
The -board. appioved claims for various department in the amount of $1,2440.06.
