Assessment roll shoeing the awards of damages and. assessments of benefits in
the natter of the vacation of alley east of Michigan Street from �'outn line of, New York
Central R. R. to -North line alley soutn of Bwnson Street under Vacation Resolution
No. 2468.

Ij no written remons trances were filed. Clerk ar board submitted proof of service of
notices as heretofore order by Board, after hearing all persons interested in said
j assessnent rolls, and oeing fully • a_avised in the premises, the boarei decides to take final action oft said rolls and declares same in all things ratified, coif ilmed and
li approved and the proceedings closed and the streets and alleys vacated and all proceecd
had with reference to said vacations are nereby sustained and the proceedings closed.

In the aoove reamed assessment roll, Lucy �Dtegmann, owner of lot No.l in
Wenger's 1st.., Addition, withdrew all ob j ed.tions regaraing said vacation and the
board., after hearing all per. sons interested in said roll and being fully advised in
the premises, the;_;severe 1 lots and parcels; o f land have been benefited and
damaged in tij e amounts shown on said roll. The board , therefore, takes final action on
said assessment roll and declares same in all things ratified, confi rme d and approved
without modification and the street vacated and all proceedings had with reference to
said vacation Resolution A0.2463 are hereby sustained and the proceedings closed.

acation Resolution No.2422.
In the above named assessment zo ll , the board,, here try orders that on the
26th. , day or- -January, 1962, this board will meet in their office in the City Hall
at 10:00 A. M* , to hear anci receive remonstrances i'rom all persons Whose property
has been aVrectea by said vacation and will decide uhether the several lots and
parcels of land have been, or will be bendfited bn damaged in the amounts shown on
saia roll or in a greater or less sum than that shown on said roll. The Board further
orders that notices or said nearing together with the amounts of damages awarded and
benefits assessed, be delivered to property owners according to law.
The following contract was presented to the board by Charles B. Calvert,
of the Indiana. and Michigan Electric Company and was signed by the Board:
CONTRACT AND SPECIFICATION FOR ELECTRIC ENERGY FOR
LIGHTING PUBLIC BUILDINGS OF SOUTH BMTD, INDIMA.
THIS AGREEP;V"VNT, made and entered into this bth. , day of January, 1932, by
and between Indiana & Michigan. Electric Company, a. corporation pf the State of Indiana,
hereinafter sometimes called the 'Company and the City of South Bend a municipal
corporation, by aihci tiil=ougrL its board of Public Itiorks� me
hereinafter sometimes called
the "Customers,
W I T N E S S E T H
That for a.nd in consideration or the mutual covenants and agi°eements herein-
after contained, parties hereto agree with each other as i'ollows :-
1. The Company shall furnish Customer and the Customer take and pay for as
hereinafter provided, for and during the term of this contract (but with the restrict-
ion .that the Customer will not resell or distribute the electric energy hereby contract-
ed for) all of the electric energy cf the character hereinafter specified which shall
be required by the Customer for light and power purposes at the public building listed � in"Schedule A" hereto attached and made a part hereof.
2. The Company aiall furnish anti the Customer shall take and pay for electric!
energy iiereunder for and during ttie period beginning on January 1st., 1932, and ending
December 31st., 1932 and thereafter in successive periods of not less than one (1) year
each until either party shall give the other not less than sixty (60 ) days notice in j writing of its election to discontinue the service at -the expiration of any said speci-
fied periods.
3. The electric energy delivered hereunder small be in the firm of single
phase, sixty cycle, alternating current at commercial voltage for lighting and in the form of three phase, sixty cycle, alternating current at commercial voltage for power
and shall ce delivered and metered at the raeter or meters installed anti owned by the
Company at each of said public buildings, which points shall be known as "Points of
Delivery" of such electric energy.
All such electrical energy shall be delivered at a reasonable close mainten-
ance of constant potential and frequency arm. shall be measured at c.omiiercial voltage at
the points of delivery.
The Company, snail provide and install in a. suitable place to be pmvided
therefor by the Customer at the Points of Delivery or such energy, suitable standanrd
I' integrating watthour• meters to neasule the energy delivered to the Customer/
4. C`ast omer shall pay Companyeach month during the term of this contract
for all electric energy delivered to it during the preceding month upon bill rendered
therefor at a price of three ($.03) cents per kwh.
The above is subject to a minimum monthly bill cf One Dollar for each meter
ins to Iled.
All bills for such electric energy furnished by Company to the Customer shall
be computed on a monthly basis in accordance witri tine foregoing charge ano shall be paid
for by tiie Customer within a period of ten (10) days from the date thereof.

7. The Customer agrees xx properly authorized agents ~pit' the Company shall at all
reasonable hours have free access to the premises owned by or under control! of the
Customer where in or whereon any equi-oment or the Compsn y is located, for the purpose
of examination, repairing or removing any cf such equ ipirEnt of the Company. All such
equipment of the Company 8aail oe and remain the personal property of the Company and
:,be subject to removal by it upon the termination of this contract.
8. If the Customer shall make default in the payment of any bill rendered it by
the Company herein or shall violate any other of the terms or conditions of this contract
'an(dt after su is default or violation the Company shall deliver to the .hoard of Public
Yorks a written notice of its intention to out off the supply of electricity to the
Customer on account of such default or violation, then the Company shall have the right
to cut off such supply a-t the expiration of five days after the giving of such notice
unless within such five days the Customer shall make good such default or violation.
Should the Customer continue in such eiefault or violation after service has been dis-

continued by the Company, the Company may cunt inue to withhold the supply of electricity
luntil such time as such default in or violation of the terms of this agreement has been
