Board met in regular session at 9 A. M. All members present. Minutes of meet
ings held November 5th., and November 6th., 1930, read and approved.
This being the date set, continued hearing was had on Vacation resolution No.
2405 for the vacation of the alley west of Riverside Drive from Hudson Avenue to the
north line of the a lle-,y north of Hudson Ave nue . ( See files for copy of resolution.)
In the above namedveep t ion resolution, no remonstrators appe .-r ed and no writt
remonstrance -was filed and the Loard, after hearing all persons interested in said vaca
tion resolutio n, takes final action on said resolution and declares same in all things
ratified, confirmed. and. approved subject to any existing utilities now occupying said.
alley. The Board now orders that - list or roll be prepared of all owners and holders
of property and of valuable; interests therein sought to be taken, which list or roll
shall also describe the property beneficially affected by such vacation.
This being the date set, hearing was he. d on Improvement Resolution No.2406
for the local sevver improve;, ent on Ford Street from Arnold Otreet to a. point 225 feet
east. (See files for copy of resolution.)
In the above named improvement resolution, the Board decides to continue hear-
ing until Tuesday, November I8 th. , I930.
This being the date set, hearings were had. on the follo�iing improvement resolu
ti ons :
Improvement Resolution No.2407 fbr a local sewer in Bendix Drive from Orumsto
Avenue to Lincoln Way Viest . ( See files for copy of resolution.)
Improvement rEe soluti on No.2408 for the grade, curb and walk improvement on
Bendix Drive from Crumstovan Avenue to Lincoln '"ay West . ( See files for copy of resolu-
tion. )
In both of the above named improvement resolution, s no remonstrators appeared
and no written remonstrances was filed and the Board, after hearing all persons inter-
ested in said improvement resolutions, and being frilly advised in th premises, finds
that the several lots and parcels of land liable to be assessed for said improvements
will be equal to the esti=ted costs of same as reported by the City Enginner. The
Board, therefore, take s final action on said improvement resolutions and declares same
in all things ratified confirmed and approved v.nthout modification.
In the above named improvement resolutions, the Board now orders that on the
25th., car of November 1930, this Boerd_ will receive, open and read sealed proposals
for tre construction of said improvements u) to I0:00 A. 111. The Board further orders
that notices o� said proposals shall be published on the I4th. , de -IT of November and on
the 2lst. , day of November I930, in the South Bend Iribune and ltlirror according to law.
rJpon the recommendation of Yam. I% Qualls, the -Board appmved the installation
of two ornamental Bus ine ss District lighting units in the 300 block on East Jefferson
Boulevard between Lincoln Way -6ast and the bridge at a cost of $50.00 each n er year.
Upon the recommendation of 17m. F. Qualls, the Board approved the installation o
a 4000 lumen light over head service at the corner of Jacob Street and LaSalle Avenue
at a cost of 845.00 per year.
Upon the recommendation of 'i�n. F. Qualls, the Board approved the petition of
the Ind i_a nr Bell. Telephone Company fo.- nder�round conduit in the vicinity of ""alnut
Street and ''`lest ern Avenue w ith the provision that conduit sra ce be provided for the use
of the City.

with the following Condemnation resolution:

Resolved by tie Board of Public 14orks of the oity of South Bend, Indiana: That
the following described property be approprieted for the use of said city:
Knowblock 6treet (Portions of) between Lincoln :day 'crest and City Limits, more
particularly described as follous:
Twenty two feet (22' ) off of the entire crest end of Lots I6, I8 and 19 in
Posts Place Addition, also twenty-two feet (22') off of the entire east end of lots 30,
31 am 37 end 38 in Posts Place Addition.
The following described property may be injuriously or beneficially affected
by such appropriation:
Lots I to 16 inclusive in Knowblw. ks Subdivision, lots 19 21- 39 7 to 39 inelu
sive in Po-ts Place Addition.
Notice of this resolution shall be -published. on the I4th. ,. day of November and
on the 2Ist., day of November I930, in the mouth Bend Tribune a.nd Mirror.

THIS TNSTRM.UPNT 4:`ITNG SSETH and agreement by and be tw een henry Beutter
doing bisine ss as the bo ff m n and Buet ter Coal Company, in the City of South Bend,
St. Joseph County, Indiana, first party, and the Board. of Public Works, of South Bend-,
Indiana , a second. party, as follows, to -wit:
Whereas, the said first party desires to construct and maintain a
single track siding across Kankakee Avenye, south of and, adjoining the right of way of
the New York Central Railroad Company, near the point where Meade Street intersects;
Kankakee Arent- in said City, which trabks are upon the right of way of said railroad
company and the lands of the said. Hoffman and. Beutter Coal Company, save and except
where the same cross Kankakee Avenue.
Now, this w itnesseth , iha t said second party does hereby grant unto
said first party the right to construct and maintain said side track across the same
Kankakee Avenue, and in consideration of same- grant, said first party contracts and
agrees to carefully and properly lay abd maintain the said tracks across said Kahkakee
Avenue, at such grade as the cibil engineer of the said city may designate, and to,
at ill times, maintain either .amis, or other material, as designated by said city,
on and along hankakee Avenye, where crossed by said track, and to 11 eep said. crossing
open at all times andupon failure so to do, the said grant shall become null and void
at the option of said second party, and at its re $ue st , said first party, Till forthwith
take up and remove such side track. A blue print dravring of the territory affected
by this track is hereto attached a& make a part hereof
This contrpct shall not be effective until ratifies , and approved by an
Ordinance of the '-ommon Council of said city.
