October I4th., and October .I5th., 11930, read and. approved. City Engineer, H. G. Wray, filed a copy of the contract between the City of South Bend and .� . T. T`ranberg, contractor for the pavement of the alley north of Colfax Avenue from Twyckenham Drive to Estiher street under Improvement Resolution No.2397. The Board signed and approved same in the amount of 4*2,047.60. City Engineer, h. 0. Garay, filed. plans and specifications and the Boarc ado-pted said plans and specifications together with the follaring Improvement Resolution: is Improvement Resolution No.2406 for the local sexier on Ford Street from I'lArnold Street to a point 225 feet east. (See files for espy of resolution.) In frie above named improvement resolution, the Board hereby orders tha on the IIth . , day of November 1930, this Board will meet in their off ice in the City Hal at I0:00 A. M., to hear and receive remonstrances from all persons interested in or af- fected- by said improvement and will decide whether the benefits to the several lots and parcels of land liable to be assessed f or said improvement will be equal to the estimate cost of same as reported by thA"City Engineer. I In the above named assessment roll, no remonstrators appe=-red and no j. 1written remonstrances were filed and the Board, being fully advised in the premisesf 1,finds that the several lots and parcels of land have been benefited and damaged in the !� amounts shown on said roll. The Board ,-therefo ze , takes final action on said. assessment ;,roll.. and deel res same in all things ratified, confirmed and approved without modificati ',land the proceedings closed and the alley vacated. In the above named assessment roll, no remonstrators appeared and no written remons'trsnce was filed and the Board, after hearing all persons interested in said roll, finds that the sever -.1 lots and parcels of IarA have been benefited and damage in the amounts shorn on said assessment roll. The Board, therefore, decides to take final action on said roll and declares same in all things ratified, confirmed and approv- ed. without modification and the proceedings closed and the street vacated. In both of the above named assessment rolls., no remonstrators appeared and no written remonstrances were filed and the Board, after hearing all persons inter- ested in said Issessment rolls, finds that the several lots and parcels of land have been . lbenefi ted and damaged in the amounts shown on said rolls. The Board, th ere fore, takes !final action on said assessment rolls and declares some in all things ratified, confirmed and approved without mod ifi cation and the proceedings closed and the alleys vacated. ,I This being the date set, continued hearing was had on the assessment ,roll for the pavement of Lerslake Oourt from 23rd. , St7°eet to 25th., Street under Improve Invent Resolution ?`+o. 2366. Upon the petition of henry Beutter, doing business as the Hoff- man & Beutter Coal company, to construct and maintain a single track railroad siding across Kankakee Avenue, south of and. adjoining the right of way of the New York Central Railroad Uom-p any near where Mende Street intersects Kankakee Avenue, in the City of South Lend, Indiana, the Loerd adopted a form of contract to 'be entered into, which contract is in words and ftigures as fo 1lcxnrs: I'ORMT OF C0172EACT FOR TEE CONSTRUCTION OF A SINGLE TRICK -ACROSS KLNK=E AVENUE. This instrument witnesseth an agreement by and between Henry Beutter, doing business as the Hoffman and Beutter. Coal Uompany, in the City of South Bend , St. Joseph County, Ind iena, first party, and the Board of Public 'Nor? s, of �'outh Bend:, Indianan a party of the second part, as followings to -wit: Whereas , the said first party desires to construct and main- tain a s ing_ le track siding --,cross Kankakee Avenue, south of and adjoining the right of way of the New York Central Railroad Company, near The point where llleade Street inter- sects Kankakee Avenue in said city, which tracks are upon the right of ray of said rail toad company and the lands of the said Hoffman and. Beutter Coal ompany, save and ex- cept where the same c orss Kankakee. Now, this witnesseth, that said second party does hereby grant to unto said f irst party the Tdght of construct and rtnintain said side track across the sa Kankakee Avenue, and in consideration of said grant, said first party contracts and, agrees to carefully and properly lay and maintain the said tracks across said Kankakee Avenue, at such grade as tht- civil engineer of the said city may designate, and to, at all times, maintain either planks, or other material, as designated by sadd city, on an along Kankakee Avenue, where crossed by said side track, and to keep said erns sing open at all times and upon failure to to do, the said grand sh al 1 become null and void at th option of said second party, and at its request, said first party, gill forthwith take up and remove such side track.
