Board met in regularr -session at 9 A. M. All members present. Minutes
of meetings held June 24th. , 1930, read and approved.
City Engineer, H. G. Wray, filed plans, specifications and estimates
and the Board adopted said plans and specifications together with the following improve
ment resolutions
Improvement Resolution No.2378 for the grade, curb- and walk improvement
on the North side of 1 ishawalm Avenue from Longfellow Avenue to the east line of Lot

In all of the above named improvement resolutions,: the Board, hereby,
orders tha t on the 2 3rd. , day of July 1930 , this Board will meet in their off ice in the
City Fall at 7-15 P. M.. to hear end receive remonstrances from all persons whose pro-
• i perty is liable to be assessed for said improverents and will decide whether the bene-
fits to the several lots and parcels of land liable tD be assessed for said improvements
will be equal to the estimated costs of same as reported by the City Engineer. 'The
Board fur the r orders that notices of said hearings shall be published on the 3rd .,
day of "July and on the IOth., day of July 1930 in the South -bend Taibune and Mirror

Upon the petition of H. N. Fristoe of 1129 South Lafayette Street, the
!i Board granted him the privilege of it ing' the northwest corner of Michigan and Sample
Streets
and also the northwest corner of Michigan and Garst Streets for the purpose

of selling newspapers. This privilege was

consent of the occupants of both corners had been obtained by Mr. Tristoe.

City Engineer, H. G. lyray, filed the Final estimate for the
pavement of the west j of Logan Street from Mishawake Avenue to Jefferson Blvdc j. under
Improvement Resolution iTo.232I in the amount of $16,623.59. The Board signed same
in said amount.
City Engineer, H. G. dray, filed the primary assessment roll
for the pavement of the west one half of Logan Street from Mishawaka Avenue to Jeffer-
son Boulevard. under Improvement Resolution 14o.232I.
In the above named assessment mll, the Board, hereby'. orders
that on the 23rd., day of July I9301, this Bofrd'will meet in their office in the City
Hall at 7-I5 P. M. , to hear and receive remonstrances from all persons whose property
has been assessed fo r said improvement and wi 11 d ec id e whethe r the severa l lots and
parcels of land have been or will be b encfited in the amounts shown on said assessment
roll cm in a greater or less stun than that shoc:n on said roll. The Board further odders
that notices of said hearing shall be published on the IIth., day of July, on the I2th.,
day of July an d on the I8th . , d ay of July, I9309 1 n the South Bend Tribune and New s
Times according to law and that notice be mailed to property owners according to law.
The board approved a drive way for filling station at the
corner of Chapin '-'treet and Jefferson street owned by Percy H. Walsh.

corner of Elder and Michigan Streets and also at the vorner of Lincoln Way West and
Harrison Avenue owned by The Texas Company.
No petitions having been filed for a change in the type of
avement other than that specified in the preliminary order for the pavement of Olive
treet from Lincoln Way West to Elwood Avenue under Improvement Hes olut ion No.2367,
the Board this Ist., day of July, I930, hereby, makes a final order for concrete pave-
ment as the type of pavement with which said street shall be improved and awards the
contract for said imprvement to Gross Construction Company at their lour bid of
I5,677.30 for concrete pavement.

Board this Ist., day of July 1930, hereby makes a final cfrder for sheet asphalt pavement
as the type of pavement with which said street shall be improved and awards the con-
tract for said improvement to Albert Constriction Company at their low bid of $5,079.00
for sheet asphalt pavement.
This being the date set, hearing was had on the plans and
estimates for Grade Separation under I4ofzf:ied. Wrack Elevation Resolution No.5.

We, the undersigned residents and citizens of the City of South Bend
St, Joseph County, Indiana, respectfully represent and show that we are the owners
of real estate abutting on Division Str�-et adjacent to the intersection of Walnut and
Division Streets in the City of South Bend, Indiana, and that all of our separate
pieces and parcels of real estate so abutting upon said Division Street will be affect-
ed by the proposed improvement; that said realestate owned by each of the undersigned
is now occupied .by buildings used for business purposes; that the proposed separation
of railroad tracks by the construction of a subway under the seine, as shown by the
plans now on file with the Board of Public Wcsks, will ruin and destroy each separate
and several piece and parcel of real estate and the buildings thereon situated owned
by the midersigned in so far as the -same would be useful for business purposes; that
the plan proposed is unjust, unreasonable, and is not the cheapest and best plan
that can be adopted for accomplishing the proposed imnro vement ; that the plan should
be modified. in this, that The New York Central Railroad Company be mquired to elevate
its tracks above the present grade to a sufficient height that the depression in the
street meking proper clearance under and through said. subway will minimize the damages
to the reppective real estate owners adjacent to said improvement; that under the
present plan the realestate of this remonstrator, Anthony Buchholtz, on the south side
of Division Street to the west side of Walnut Street will be approximately eight (8)
to eight and one half (82) feet above the pavement of said street in front of his
buildings if said improvement is made as proposed and on the plan now before the Board
of Public Works; that the real estate of John P. Rozplochowski and others on the north
side of Division Street west of said proposed improvement will be six (6) to seven
(7) feet above the pavement on said street and the real estate of Mrs. Josephine
Brambe rt is on the north side of Division .3treet east of said proposed improvement
and the pavement of Division Street in front of her real estate will be nine (9).
feet lower than her real estate, and the buildings situated thereon; that the real
estat e owned by the remons trator , Samuel Burke , on the s outh si de of Division Street,
and if said improvement is made under the proposed plan now on file the pavanent on
Division Street will be nine (9) to ten (I0) feet lower than the buildings on his real-
estate; that all of said buildings have basements underneath the s'arue, and if they sho
should undertake to lower said pavement said basements would be ruined; that the sew-
erage on Division Street is not sufficiently law so as not to affect the basements;
that portions of said. buildings cannot be lowered nor rebuilt to make the same ade-
quete for business purposes; that the proper specifications and plans for the improve-
ment proposes would require and provide that the tracks of the Railroad Company?; be
elevated where the same crosses Division Street approximetely six (6) feet in order to
make said proposed work feasible and to render servicable and useful the bhildings
adjacent thereto.
'Re therefore, remonstrate and pray that the same be modified to
the end that the tracks where the sane cross Division Street be elevated as herein
prayee.

The undersigned, resident and citizen of the City of South Bend,
County of 6t. Joseph and State of Indiana, respectfully represents and. shows:
The t he is the owner of the real estate on the south east corner
of Division and Walnut Streets in the City of South Bend, County of Wit. Joseph and
State of Ind iane , which grope rty abut is upon Division litreet and will be affected by
the proposed additional improvement to elevate the rpilroad trr cks of the New York
Central nailroad at the intersection of Division and Walnut Streets; that the property
of the undersigned is occupied by buildings used. for business purposes; that the pro-
posed separation of the said railroad tracks by the proposed elevation of said tracks
ah.d the construction of a sub -way under the same as shown by the plans now on file
with said Board of Public Works wi 11 destroy the real e state of the und ersigned, and
particularly the building thereon fbr business purposes and- that said property cannot
be used for any other purpose; that the proposed plan with respect to the, undersigned's
property will lower the I Bement on Division Street from nine to ten feet laver than
the present grade level of the buildings of the und ersi gned ; that said buildings have

and destroy the basement thereunder; that the sewerage on Division Street is not

sufficiently low as not to effect the said basement; that a portion of said buildings
cannot be lowered or rebu _lt to make the same adequate for business purposes; that said
plans and seecifications the.-efore.for reasons herein stated are unfair, unjust and un-
reaso#able, and does.not represent the chepest and best plans that can be adopted for
accomplishing the proposed improvements; that the plans should. be modified and that the
New York Central Railroad Company should be required to elevate its tracks above the
grade of said street to a sufficient hetFhth that the depression in the street make
proper clearance under and trrough said sub way which reduced to a minimum the damages
to the real estate of the undersigned, which is immediately adjacent and contiguous to
said imnrovementsh to that the tracks of the railroad" company be elevated where the same
-crosses Division 6treet , approximately six feet in order to make said proposed work
approach feasible and to at least attempt to render the buildings of the undersigned
adjacent to said proposed improvennnt s, reasonably udeful.
We the undersigned further represent s tha.t heretofore as a
part of the same general elevation his property and buildings have been subjected to
damages by reRson of the elevation by raising the grade of the right of Tay of the New
York Central eilroad Company which the lieu Fork Central Tracks are located on and
that he is being subjected to further and additional damages which if said plans -and
specifications ere pursued and said construction completed will completely damage and
ruin the real estate and improvements thereon of the undersigned.
MEREFORE, the undersigne� remonstrates and prays that either
the tracks where the same crosses Division Street be elevated as heretofore provided;
that nofurther improvements of said intersection be discontinued and that he further
remonstrates for reasons hereinbefore set _out; that his property will not be subjected
to any more damage and inconvenience as hereinbefore set out, and that the proposed
plan end improvements be discontinued.

The Board having under consideration the plans, specifications
and estimates of cost heretofore filed on or before the I7th., day of June-I930, by the
New York C.ntral railroad Company the Grand Trunk Miestern Railroad Company and. the
New Jersey, Illinois and Indiana Railroad Company and the City of South Bend, Indiana,
covering the work to. be done under IOW ified Tra ck Elevation Resolution No.S, and it
appearing to the Board that notice of a hearing upon remonstrance thereto has been duly
published as provided by law and that at least ten days written notice of such hearing
has been served pn each of the stem railroads affected by the proposed grade separation,
proof of publication and. service of notice is now on file in the o' ffee of said Board
and comes now Anthony S. Buchholtz, J. P. Rozplochowski and Josephd)" Brambert and
also Joseph Burke and file, theft written remonstrances. Said written remonstrances
are now over ruled and it further appears that no other remonstrances have been. filed
and that no other person, firm or corporation interested in or affected by such improve
went and the cost there ar has in any way remonstrated against said plans, spe-cificati ons
and estimates or any part thereof, the Board of Public works now approves and confirms
all of such plans and specifications and allows the estimates so filed on the I7th. ,
day cif' June 1930, and the said Board nor makes its allotment of said work as follows,
to -wit:
I. That the New York Central Railroad Company shall do and pe
all of the work inc lud ed within the plans, spe ci f is t ions and estimates filed by it.
2. That the Grand Trunk Western Railroad Company shall do and
perform all of the work included wit1hiti the plans, specification and estimates filed by
it.
3. That the New Jersey, Indiana and Illinois Railroad Company
shall do and perform all of the work included within the plans, specifications and es-
timates sled by it.
4. That the City of South Bend shall do and perform all of the
work included within the plans, specifications and estimates filed by it.
The Board further orders that all of said work shall be done
as provided for in Modffded Resolution No.5 for Grade Separation and in accordance
with the plans and specifications hereby approved and directs that such work be so
planned and performd as to cause the least possible interruption of traffic and the
least possible interruption or interference with any public utilities.
Proofs of -_aublication in Neww Times and South Bend Tribune
with affidavit signed by M. TP. Reed assistant publisher of the News Times and Charles
E. Crockett Secretary of the South Bend Tribune, stating that notices of hearing on said
plans and specifications'a& esti3w. tes were published on the 20th., day of June and on
the 27th., day of June 1930"wen filed and placed on file with other papers in connection

The Board further sets the Ist. , day of September I930 as the
date for commencement of the above work and the Ist. , day of beptember I93I as the E1
completion date for said work, subject, however, to any appeals which may be taken by
remonstrators in the Circuit or Superior Courts and subject also to the final ratifieati�n
of all pr oceed.ings. had in connection with Track Elevation Reso luti on No.S as modified,
by the Common Council of the City cf South Bend.
