This agreement made and entered into this I7th., d.ay of June
1930 between the City of °outh Beri, a municipal corporation of the State of Indiana
by and through its Board of Public orks, -party of he first part, hereinafter referred
to as the "City" and Indiana and Michigan. Electric company, party of the second pant,
ereinaffter referred to as the Contrector, pursuant to a resojutiop of the Board of
Public orks passes at a meeting called on the I7th. , day of une 930.
IVITi'yESSETH
That the parties hereto, each in consideration of the agree-
ments on the part of the other herein contained, havd mutually agreed and hereby mutua
agree as follows:
E I. The Contractor shall progide, maintain and light with
lectricity a street lighting system in the City of outh Bend-, ndiana, consisting of
not less than one hundred sixty (I6I) . street lamps supplied from an underground dis-
tribution system of the Contractor. much underground lamps shall be as follows:

All property furnished by Contractor under this contract shall be and
remain the property of the Contra ctor.
The Contractor shall at its cost, furnish all lamp renewals and light
all lamps in this Paragraph "I" provided for a period t ermimting with the termination
of the general contra et f or street 1 ight ing, which termination drte As January I, I935o
at noon.
All the lamps which shall be provided and, maintained by this Contractor
shall be so operated that they vjill give the maximum amount of illumination obtainable,
All temps in this Paragraph "I" provided for shall be burned. from one
half hour after sunset until one half hour before sunrise, every night and all night,
burning approximately four thousand (4000) hours per annum.
2. The Contractor shall furnish electricity only for lighting traffic
and special danger indicators owned and maintained by the City as follows: -
(A) North side of Sample Street,, west of intersection of Fellows and
Samples Streets:-
4- Special! -Danger Indicators, each equipped with I- 50 watt lighting unit-, burning ill
night.
(B) At Sample Street Railway Und erpass :
j3 -Traffic Indicators, each equipped with I - 50 watt lighting unit, burning all night.
(C) .Traffic Directors located by the City as fb ilows :
37 - Suspension Type Traffic. Directors, each containing 12 - 50 watt lamps, four of
which lamps barb continuously while unit is in service, Units are in service appr

oximately sixteen _(I6) hours per day.
(D) Traffic Directors located by the City as fbllows:
15 - Post Type Directors, ee ch containing 3 - 50 watt lamps, one of which burns con-
tinuously while the unit is in service, Units are in service approximately sixtee
hours per day.
The entire installation of traffic directors or danger indicators speci
fied in Paragraph '12" hereof, shall be made by the City and the City shall maintain
said dorector s or indicators, and all property so installed by said City shall be and
remain the property of the City. Contractor will furnish electricity only for the
lighting of City"s installation.
The Contractor assumes no duty or obligation to maintain an uninterrupted
supply of electric energy. The use of electricity cor the purpose of lighting said
directors or indicators shall not in any case subject the contract to any liability

whatsoever for damages of any nature whatsoever due to the failure in the supply of
electric energy or any interrupti on of or deficiency in the same, and the City hereby x :._ :z; o
agrees to indemnify and save harmless the Contractor from. any Toss, cost or damage
which may be occassioned by any -of, the causes herein in this paragraph set forth.
3. The number of lamps furnished and 1 ight ed by Contractor un
der this contract shall be .the number provided for in Paragraph "I" hereof abd shall
be located as shown on prints attached hereto and indentified by the signatures, of
the Contractor and the Board of Public Works.
4. All. outages of lamps provided for in Paragraph "Itt shall
be reported daily in writing by the proper officials of the City to the Contractor and
the proper officials of the City may deduct from the'total monthly amount which
would have been paid fvz any lamp so reported on any outage, occurring, the sum bear-
ing the ratio to such total as the period of outage bears to the total time the lamp
would have been lighted in any month.
5. Street lighting united in Paragraph "I" contrasted for
shall be moved by the Coiitractcr to such new location as the City may by.writing
direct, sgb j ect to the following conditions:
Such moving of lamps shall be completed within thirty (30 )
days after receipt by contractor of written notice from the city, Sundays, legal hol-
idays and stormy days not to be included, provided that the number of such removals
shall not exfeee one per day and provided further that such renewals shall not be re-
quired on Sundays, le ga 1 holidays and stormy days. Notice that the work of such re
moval of lamps has been completed shall be given by the Contractor to the City within
ten (TO) days after completion of the work.
The actual cost to the Contractor for making such reloeetions
shall be pfid by the City to the Contractor within thirty days after said notice has
been given.
6. Additional traffic directors or special indicators of like
type and characteristics as those provided for in Paragraph "2" hereof may be added
from time to time by the City and the Contractor shall upon written notice from the
City furnish electricity for lighting same and payment therefor shall be at the rate
provided for in this contract, commencing on the day on thich the units are to be in
service.

9. - In authorizing _ or granting a permit to any person, firm or

as a condition to the granting of such p ermit , an agreement on the part of the applicant
that such lines and cables and street lighting units will not be interferred with in
any manner without notice to the Contractor.
10. All the covenants, expressions, terms, conditions, provis-
ions and agreemtne herein shall extend to and be binding upon or tnure to the benefit of,
as the case may be, each and every one of the successors or assigns or each of the par
ties hereto as if in every casd so expressed.
II. This contract shall be in fall force and effect for a
period terminating: with the t erminatiLon of the general contract for street lighting.,
which termination date is January I, 1935 at noon.

This agreement made this I7th. dey of June I930, between Grand Trunk
Western Railroad Company and The City of South Lemd, a municipal corporation, by and
through its Board of Public i+ctr ks :
WITTNESSETH: That,
Whereas on the 3rd. �� ,day of January I930, the Board. of Public Works
of the City of South Bend adopted and placed on file its Grade Separation Resolution
No.S. providing for the separation of grades of the tracks of Grand Trunk Western
I' Railroad Company and the New York Central Railroad Company (Illinois Division) at
Walnut Street; and q
Tuesday, June I7th. , 1930.
Whereas, on the first day of April 1930, said Resolution No-5 was
modified by the filing and adoption of modified Resolution No.5; and
Whereas, on the I8th., day of •February, 1930, a petition signed by
more than fifty resident freeholders of the City of South amend was filed, petitioning
the Board of Public Works to enter into an agreement with the rand Trunk Western Railr
Company and the New York Central. Railroad Company (Illinois Division.) for divdBton of
cost of all work necessary under said grade separation project, whereby the City of
South bend shall pay thirty five (35) percent of the cost of the grade separation proje
contemplated by -hesolutio# No. 5 as modified, pursuant to Section 2 of the.pter 165 of
the Acts of the Gene ra 1 Adsemply of Indiana, a pp roved 114arch 9th. , 1927:
Therefore, in consideration of the premises it is agreed:
First: That the total cost of all work performed and materials
furnished to carry out the grade separation between the tracks of the Grand Trunk
Western-`ailroad and the New York Central ( Illinois Division) Railroad at Walnut St. ,
i4cluding all work incidental thereto , as contemplated under Modified resolution No.50
shall be divided and borne thirty-five (35) percent by the City of South Bend and the
balance of sixty-five (65) percent by the Grand Trunk Western railroad Company and The
"ew York Central. Railroad Company, is such proportions as they agree upon. The wcsrk
involved in said grade separation shall inc lif e the excavation of existing embankment,
the construction of approaches, pavement, sidewalks,, frainage and necessary changes
in other City -owned facilities, and the construction of a steel and concrete railroad
bridge for eight tracks, fige of which tracks will be Grand Trunk V+estern Railroad
tracks, and three of which will be New York Central Railroad tracks.
Second: No cost for detours fbr pedestrians or highway traffic,
or policing same, shall be included in the joint expense.
Third: Each party shall render to the other, at the end of each
calendar month, a statement of the amount due for work completed, divided as hereinbef
provided, and the party receiving such s tat ement shall pay the amount due thereon with
sixty (60) days after receipt of the same, with interest after maturity, at the rate
of six (6) percent per annum, provided, however, that no interest shall be charged on
bills disputed and returned for further information or correction.
Fourth: The City of South Bend shall vacate- and close that part of
Harris Street which lies within the limit of the rights -of -way o-f Grand Trunk Western:
Railroad Company and The New York Central Railroad Company, without any expense to the
railroad companies.
In order to facilitate the diversionof traffic from Harris Street,
to the proposed subway in Walnut Street it is agreed that Huron -jtreet shall be
paved between Harris street and Walnut btreet, and that the cost of such pavement shall
be included as part of the costs of the project.
Fif th : The City will save harmless and indemnify the Railroad Co*,
against payment of any and all claims, costs and damages arising out of or resulting
from the change of the grade of any street or alley in connection with the separation
project. `
In witness whereof the parties have caused their respective corpora
names to be signet, and their corporate seals affixed hereto and attested by the hands
of their duly authorized officers, on the day, and year first above written/

pavement of the alley west of Scott Street under Improvement Resolution 1io.2350 in
accordance with the terms of the contract between Frame and Zimmer Contractors and the

Raise the main line tracks of the N. Y. C. R. R. beginning on the
crest at about station 4476/47, thence ascending easterly on a 0.3% grade to about
• station 4500/90, thence on an ascending grade of 0.072%'to an intersection with present
grade of tracks at about station 45I4/30; suitable verticle curves being used at
changes in grade as shown on general plan dated May 24,I930. Raise the tracks of the
New York Central connecting track to the PGIi chigan Central Railroad to the new grade
of the main line tracks at their crossing, using I.0% runoff grades with suitable
vertical curves.
At the intersection of Division Street and vValnut Street with the �

29 3 and 4 as shorn on the recorded plat of Ester H. Millers subdivision of a prt of
Lots 4, 5 and 6 in the Original Plat of the Town of Lowell, now a part of the City of

the life of said lease, as to any accrued and unpaid rent, provided., however, that any

of said premises and, upon the termination of this lease, in any way, will yield up
the premises to said party of the first part in good condition.
Third. To pay (in addition to the rents above specified) all water
rents gasP or electric bills and street sprinkling assessments taxed or levied or
charged on said demised premises, for and during the time for which this lease is gra
granted.
FOURTH. Upon the termination of this lease to imme di ate ly remove
any temporary improvements put on said premises bar said. party of the second. part, and
said first party hereby consents to the construction on said- premises any such ter-
. porary structure reasonably necessary to accomod_ate said premises to the purposes of
a parking field.

FIFT. At the termination of this lease, by lapse of time or other
wise, to yield up immiediate possession to said party of the. first part, and failing

shall not be held as a waiver by, said first parity of any right bf re-entry as herein-

be made in the payment of the rent above reserved or an-,,- part thereof, or in any of
the covenants and agreements herein- conta ined , to be kept by the party of the second
part, it shall be lawful for the party of thae first part or the legal representa-
tives of said party, at any time thereafter, at the election of said f irst tarty,
or the legal representatives thereof, without notice, to declare said. temm ended,
and to reenter said demised, premises, or any Trt thereof, either with or.without
Drocess of law, and t he sa i d party of the second pe rt or any p ers on or persons
occupying the same, to repel, remove and put our, using such force as may be nee-
essary so to do, and the said premises again to repossess and enjoy, at this demise,
without prejudice to any rmmedies which might otherwise be used for arrears or rent
or preceding breach of covenants.
IT IS FURTHER AMEED, by the p art ie s hereto, that after. the service
of notice, or the c omme ndement of a suit, or after final judgement' for possession of
said premises, the first party may receive and collect any rent came and the pgyment
of said rent shall not waive or affect said notice, said suit, or said judgement.

not become effective until the same shall have been approved by proper ordinance of
the Common council of the City of South Bend, and until there shall have been duly
a-bpropriated by said Common Council the amount of money necessary for the payment of

In all of the above named assessment rolls, showing the
awards of damages and assessments of benefits for said vacations, the Board hereby i
orders that this Board will.meet in their office in the City hall on the 9th., day of
July I930 at 7-I5 P. LT., to hear and recei-ve remonstrances from all persons whose
propveyy may be affected by said rolls 'and will determine whether the segvral lots II
and parcels of land have been or mill be benefited or damaged in the amounts shown
on said assessment rolls or in a greater or less sum than that showf. on , said rolls
The Board further orders that notices be delivered to all property affected according

Upon the reconmiendation of gym. P. Quells, the Board approve
the installation of two 1000 -lumen lamps in the vicinity of Pottewatomie Park. � •

Dedication.
Pleasant View Addition is located in the west part of the i
southwest quarter of Section 25 Tcwnship 37 North, range 2 east, described as follows:
beginning at a point 991.4 feet north of the south west corner of said section 25,
thence north 976 feet, thence east 635 feet to the west line of Dixie Highwat,
thence southwesterly alo4g west line of said hig1rat 984.5 feet, thence west 582.5
feet to the place of beginning. The lots are numbered from I -to 76 inclusive and
the dimensions are marked in feet on the annext plat. The streets are hereby dedicate
to the public for public use.
