No petitions having been filed for a change in the type of pavermnt other than that specified in th preliminary order for the pavement of Marine Street from New York Central Railroad right of clay to Indiana Avenue under Improvement Resolu- tion No.2269, the Board this I3th., day of T?ay, I930, hereby makes a. final order for sheet asphalt light tra ffic pavement as the type of pavement with wh ich s aid street sha be improved and awards the contract for said imrroverBnt to �.lbert Construction Company at their love bid of $4,444,50, City Engineer, H. G. Tre T , fi 1 ed reports on remonst ra.nc es aga ins t the foll(riing improvements: Rdpert on remonstrance against tree pavement of Bend ix Drive from Washington Street to Division Street under Improven-ent Resolution No.2352: There are 26 resident property owners, I3 of whom have signed the remonstrance. The Board, finds, however, that on several pieces of property, only one of the joint deed holders have signed. In view of this fact, the Board, decides to rescind all former action on said resolutions and declares same null and void.. Report on remonstrance against the p av en. -en t of Monson n Street from alley south of Ford Street to Dunham Street under Improvenent Resolution No.2354• There are 24 resident property owners, 15 of whom have signer'_ the remonstrance. This constitutes a majority of property owners and_ the Board, therefore, rescinds all former action taken on said resolution, and declares same null and. void. Report on remonstrance against the pavement of the alley west of Scott Street from Dubail Avenue to C„lvert Street under Improvement Resolution No.2350: There are 48 resident property owners, II of whor. have signed the reiponstrance. This does not constitute a majority, therefore, the Board. sustains all former action taken on said. resolution. Report on remonstrance against the pavement 36th. J. street from 1111ishawaka Avenue to G. T. IF. R. R. Co. , under Impzoveiwt Resolution yo.2355: There are 37 resident property owners, 12 of vihomhave signed the remonstrance. This does not constitute a majority, therefore, the Board sustains all former action taken on said resolution and ord(�rs the street paved. In the matter of the improvement of 36th., Street from Yishawaka U C] 0 C] Tuesday, lt'ay I3th. , 2930 . 97 Avenue to Grand Trunk Right of gray under Improvement Resolution No.2355, the Board hereby orders that on the 27th., day of Ilay, I930, this Board will receive, open and. read sealed proposals for the construction of said. improvement up to I0:00 A. M. The Board further orders that notices of said proposals shall be published on. the I6th. , day of Iiay and. on the 23rd. , day of lav 1930, in the South Bind Tribune and T-irror a cc ord i.ng to law. City Engineer, H. C. Wray, filed plans , specificetions and estimates and the Board adopted. said. plans and specifications together with Improvement Resolution No. 2368 for the pavement of Oliver Street from Dubail Avenue to Bruce Street. (See files • for copy of re soluti on. ) In the above named improvement resolution, the Board hereby orders that on the mlth., day of June 1930, this Board will meet in their office in the City Hall at 78I5 P. if., to hear and receive remonstrance from all persons whose property may be affected by said improvement and. will decide whether the benefits to the severc7l lots end par- cels cif' land liable to 'he assessed for said imp_ rovar±ent will be equal to the estimated cost of same as reported by the City Lngine er. The Board approved the redistribution of assessments for the Northwest Trunk • Serer and. also for the Sheridan Avenue Sub. -trunk sewer as peitioned for by Arthur A. Schellinger, and as submitted by City- Engineer on schedules. i The Board approved a plan for enlarging drive way on Mishawaka. Avenue at the j cornier of 28th. , street, as approved by City Engineer. The Boa rd approved the deed of the Northern Indiana Railway Co., Inc., for portion -of street on 22nd., Street. The Board approved a renewal eertifierte for contractors bond in favor of C. a'_.. Jordan Co., in the amount of �I,000.00 signed by=merican 6urety Company. This being the dste set, hearing was had on Improvement resolution No. 2356 for the iDsvement of Huey- Street from .Elwood -"'venue to_!, arquette venue. (See files for copy of resolution'.) In the above named improvement resolution, remonstrators appe.^red but no written remonstrance was filed and after hearing all persons interested in said im-oro vement, the roard decides to modify said resolution to read "from Elwood LL'venVe to K-eller Street.'' ,-7ith this modification, the Board finds that the benefits to the several lots and parcels of land liable to be assessed for said improvement vrill be equal to the estim ted cost of srrre as reported by the City Jngineer. The board, therefore, decides to take final action on said improvement res: lution and declares same in all things ratified, confirmed and apprAed as modified. (See files for copy of resolution.) in the above named improvement resolution, remonstrators appeared and a written remonstrance eras filed and the Board, being fully advised in the premises,, decides to over rule said remonstrance and finds that the benefits to the several lots and parcels of land liable to be assessed for said improvement will be equal to the estimated cost of same as reported by the City Engineer. The Board, therefore, decides to take final action on said resolution and. declares same in all things, ratified, confirmed and approved.
