94 Wednesday, May 7th. , I930. Board met in regular session at 7-I5 P. M. Mr . ' John K. 9m.ogor absent., The Board approved the renewal certificate for the excavation bond. of W. York. S. Lodyga in the amount of t 1 000.00 signed by Fide lity and Ca sua It y" Company of New Y The Board. approved the renewal certificate for the excavation bond .of United heating and Plumbing Company in the amount of 1.000.00 signed by Fidelity and Casualty Compeny of 1�ew York. Bids having been received for the pave men t of Gre enlawnl Avenue fr cmr Mishawaka. Avenue to '�Unnymede Avenue under Improvement Resolution No.2265, the Board this 7th. , day of Icy I9301 hereby makes a preliminary order for sheet asphalt pavement heavy traffic, as the type of pavement with which said. street shall be improved and sets the 20th., day of TvEay 1930, as the time when said Board shall either pass on peti- tions for a change in the type of pavement other than that specified in the prelimincry order, award the contract cr reject all bids. This being the date set, hearing wa.s had of Improvement Resolution No. 2353 for the pave rent of Frances Street • fr c7m Corby 'street to Napoleon Street. In the above names improvement Resolution No.2353, remonstrators appear ed and a written remonstrance was filed and the Board, after hewing all persons inter- ested in said improvement decides to rescind all action taken on said improvement resol f ution and declares same null and void and the proceedings closed. resolutions: This being the date set, heerings were had on the following improvement Improvement resolution No.2352 for the pavement of Lendix 'rive from Washington 'tree t to Division street. Improvement resolution No.2354 for the pave-ent of Monson Street from alley south of Ford Street to Dunham Street. Improvement Resolution No.2355 for the pavement of 36th., Street from Mishawaka Avenue to Grand Trunk Right-of-way. In all of the above named improvement resolutions, remonstrators appear ed and written remonstrances were filed and the Board, after hearing all persons inter ested in said improvements, finds that the benefits to the several lots and -parcels of land liable to be assessed for said improvements will be equal to the estimated costs of same as reported by the engineer. The Board, therefore, decides to over rule said remonstrances and take final action on said resolutions and declares same in all things ratified, confirr_red and approved. This being the date set, continues' he•�ring was had on the assessment roll showing the awards of damages and assessments of benefits in the rmtter of the Vacation of Linden Avenue from X. Y. C. R. R. to Linden avenue under Vacation Resoluti No.2293. In the above named assessment roll, no remonstrators appeared and no written rem©nstrances xrere filed and the Board, being fully advised in the premises, fines that the several lots and parcels of land have been benef ited and damaged in the amounts s how on said assessment roll. The Boarrd, the refcre , decides to take final action on said. vacation assessment roll and declares same in all things ratified, con- firmed and approved without modification and the proceedings closed and the street va- cated end all proceedings had with re fe rence to said va ca tion resolution are hereby sustained. City Engineer, H. G. Wray, fi 1 ed the assessment roll shrming the awards of d ama ges. and the assessments of benefits in the mstter of the va ca tion of Kankakbe Avenue from west line of alley west of Kaley Street to Linden Avenue under Vacation Resolution 1,74o.2292. In the above named assessment roll, the Board, hereby orders that on the 24th. , day of June 1930, this hoard will meet in their office in the City Hall at I0:00 A. T., to hear and receive rEmons trances from all persons whose property has been affected by said vacation and will decide whither the beveral lots and parcels of land` have .been or will be benefited or damaged in the amounts shown on said assessment 1011. The Board further orders that notices of said heering together with the amounts of ben- efits and damages, be delivered to property owners according to law or t)ublished accord- ing to law, as the ease ma �r be. _ Ivieeting adjourned at 9-30 P.
