The Board approved the Guarantee -Bond for tY-B pavement on Fox street from
Leer Street to Sampson street under Improvement resolution 1llo.2224', in the amount of
3,065.80 signed by Southern Surety Company.
The Board approved the renewal certificate for the excavation bond in favor
of �=rthur V. -Meyer in the amount of I,000.00 signed by `-assachusetts Bonding and
Insurance Company.
The Board approver the renewpl c ertifi ca-te for the excavation bond in favor
of the hay -weaver Construction 'o., signed by the American Siurety Company of he`r4r York.

clerk in connection with Track elevation work and the Board hereby orders that tlB

the damaged condition of the South ivxa.i_n Street pavement near Eckman Street caused by
the operation of equipment over the surface of said street during the progress of
the construction of the Eckman Street gunk sewer, I wish to state that my company
regrets very much that it has been responsible for this damaged condition and wish
to advise you that proper and satisfactory repairs will be made by the undersigned
as soon as proper weather conditions permit.
In order that City of South Bend may be properly safeguarded in this matte
I hereby authorize you to withhold from the assessment :toll for the Eckman Street sewer
contract any amount that in your judgement is sufficient to make the proper and necessa
• repairs to the Win Street pavement; this amount to to used by you for. repairing said
damage in the event that this company fails to rake the repairs within a reasonable
lengtt of time after satisfactory weather conditions prevail. .

Dear Sits:
Referring to the damage done to South Lain Street pavement by the Northern
Indiana Construction Company while the Eckman Street sewer contract was in progress and
also referring to a recent letter received by the Board ff'om 0. A. Spadoni, manager of
Northern Indiana Construction Compan7 in nhich he advises that his company will be
agreeable to having the Board of Public works withhold a suitable amount from the assess
merit roll of his Eckman street sewer contrast to be used as a guarantee that his company
will make proper and satisfactory repairs to the damaged pavement:
This department has checked over the area of damaged pavement on Main St.
and also other items of. repair which the Northern Indiana Construetion Company should
be held liable for and it is my recommendation that the sum of $I 250.00 . should be re-
tained by the Board. of Public docks from the Northern Indiana Construction Company's
Eckman Street sewer assessment roll which amount in my judgement properly safeguards the
city's interests in this matter. An endorsement to the effect that 112250.00 is being, -
withheld should be made upon the assessment roll in writing in order that the city
C Stroller may possess the authority to withhold this amount and not overlook same.-

After due consideration and being .fully advised in the premises, the Board,.
finds that the several lots and parcels of land have been benefited in the amounts shown
on said assessment roll for the sub -trunk sewer in Eckman street under 'Improvement res-
olution No.2279, and therefore, the Board takes final action on said assessment roll
and declares some in all things ratified, confirmed and. approved. The Board further
orders that in accordance with the recommendation of H. G. Wray,City Engineer, the
I' sum of �01250.00 be retained or with held by the City Controller, as a guarantee to the
City that the contractors for this sewer improvement make satisfactory repairs to the
South ruin Street pavement which was damaged during the construction of said Eckman
II street uub-trunk serer, and the Board further orders Clerk of this Board to make this
endorsement on the assessment roll before delivering same to the City Controller, in
order that he may be duly advised in the matter.
Claits in the -amount of AM 590.65 for various departments in the C it y
Hall were signed and approved by the Board.
