June 26th., I929, iiew York Central Track Lleuat;ion, South Bend,. Indiana. The Board
signed and approved same in the amount of $30*299.37 together with detailed sheets in
connection with same.

Board met in regular session at 9 A. M. All members present. Minutes- of meetings
held October 8th. , 9th. , and IOth. , 1929, read and appr owed.
The Board approved the Guarantee Bond of kxzvwcftxx3dxZMCrtkK Williston
Construction Company_ for.the pavement on Bertrand Street from Bendix Drive to.Nanoy
Street in the amount of .2, I57.92 signed by Inland Bonding Compan$.
Upon the - recommendation of Wm. F. walls, the Board approved the installa-
tion of the following street; lights:
Installation of a 4000 lumen lamp, mast arm construction overhead construct
ion, at the. intersection of Pershing and Johnson street at cost of 45.00 per year.
Installation of a 4000 lumen lamp, mast arm construction, served from over
head service, at the intersection of Fremont and Humbolt 4treet at a cost of 45.00 per
year.
Installation of a .4000 lumen lam 9. mast arm construction,. over. hear servic4
at the intersection of College and Hamilton treet at a cost of $45.00 per year.
i! Installation of a 6000 lumen lam, mast arm construction from over head
Ij service at the intersection of Lincoln Way pest and Amer streets at a cost of 50.00
!; per year.
Installation of a 2500 lumen lamp, mast arm construction, over head service
at the corner of Elwood Avenue and Amer ''treets at a cost of ;35.00 per year.

at the alley intersection between Vassar Avenue. and California Avenue west of Wilber

The Board approved the report of H. G. Wray on the remonstrance against the
jpavement of the alley east of Miami Street from Victoria ''treet to -'Itgeld street
under Improvement Resolution No.22970 showing no legal remonstrators on said written.

The Board approved the report of G ity Engineer, H. G. Wray, on the re mon-
stranee against the pavement of the alley north .of LaSalle Avenue from Scott wtreet to
west line of lot 7 Reefers Sub.,, under Improvement Resolution No.2298, showing II
resident property owners out of 24 signing the remonstrance. This does not constitute
a majority, therefore, bids will be advertised for said improvement.

curb line of Lincoln .day East to Ewing Avenue, in a cdordanee with the terms of the
contract between the Gity and Rieth Ailey Construction Company, contractors,, under
Improvement Resolution No.2254, in the amount o f $IS, 333.80i
The Board approved the redistribution of assessments for certain improvements
as petitioned fcr by property owners and hereby orders the Clerk to deliver same to
City Uontreller's office.
The. Board approved the grade submitted by City ,Engineer, H. G. Wray, for Nancy
Street from Crumstown Avenue to Lincoln Way 'pest. as. shown on report filed by Engineer.
This being the date set, hearings were had on the following assessment rolls:
Assessment roll for the pavement of Bertrand Street from Bendix "rive to Nancy
Street under Improvement Resolution N0.2282. .
Assessment roll for the sewer in Nancy street from Bertrand street -to Westmoor
Street under Improvement Resolution No.2284.
In both of the above named assessment rolls, no remonstrators appeared and no
written remonstrance was filed and the Board being fully advised in the .premises, finds
that the several lots and pareels of land primarily -assessed for said improvements
have been benefited in the amounts named on said rolls. The Board, therefore, decides
to take final action on said assessment rolls and. declares same in all things ratified,
confirmed and approved without modification, -The Board now orders said assessment
rolls delivered to the Department of Finance.
Uity Engineer, H. G. 4ray , filed plane, specifications and estimates and the Board
adopted said plans and specifications together with a resolution for the pavement of
the alley west of. Cushing _Street from a point I32 feet south of Grand View Avenue to
a point I62.7I feet north of Oak street under Improvement Resolution No.23IO.
In the above named improvement resolution, the Board hereby orders that on the 20th
day of November I929, this Board will meet in their office at _7-I5 P. 11., to hear and
receive remonstrances from all persons whose property is liable to be assessed for said
improvement and will decide whether the benefits to the several lots and parcels of
land liable to be assessed for said impr oveme nt will' be equal to the estimated cost of
same as reported by the City Engineer. The Board further orders that notices of said
hearing shall be published on the Ist. , day of November'and on the 8th., day of Novem-=
ber I929, in the. South Bend News Times anri Tribune according to law.
The Board signed the contract with Albert Uonstruetion Company for the pavement
on Fremont street from Lincoln Way "est to Humbolt 0'treet under Improvement, Resolution
No.2259 in the amount of 0.5,953.30. The Board also approved the construction bond of
same for 50,% of the a ont ra et price signed by Inland Bonding Company.
The Board signed the contract with Albert Construction Company for the pavement on

Comes now Chicago-. youth Shore and South Bend Railroad, a corporation existing under
and by virtue- of the. laws of the State of Indiana', and respectfully represents and says
That it maintains and has mi intainid for a number of years last past a side track
running from its main line of railroad to a gravel pit owned and operated by George Ji.
Hoffman;
That said side track crosses Crumstown Road at a point west -of the intersection of
said Crumstown Road with Lincoln Way West in the City of mouth Berg

City of South Bend in the construction of said improvement it is necessary temporarily
to remove said side track from its present location as it crosses said Crumstaowa Road,,

That it is necessary for side track facilities to be maintained to said
gravel pit, _

That the Chicago, South Shore and South Bend Railroad is the only railroad
accessible to - said gravel pit;

That it will be necessary for the -Chicago, South Shore and uouth Bend
Railroad to construct a temporary side track to the west of its present side track
if said gravel pit is to be served by thin Railroad;
That in the location of the temporary side track west of the present
side track it will be necessary to construct such temporary side track upon and
across Crumstown Road and Nancy Street by a route, the center line of which is
approximately as follows:
"Beginning at a point do the southerly line of Crumstown Road, which
point is sixteen and seventy -love hundredths.. (I6.75) feet west, measured at right
angles to the west line of Secti on Three (3) Township Thirty Seven (37) North;
Range Two (2) East, in the City of South Bend, County of ,k,- Joseph, State of Indiana;
thence northwardly approximately forty (40) feet to the. northerly line of Crumstown
Road; thence by a curve to the right having a radius of seven hundred sixteen and
twenty-f6ve hundredths (7I6.25) feet a distance of approximately one hundred eighty
(ISO) feet , to the nest line of a strip of lard owned by the Chicago,Mouth Shore and
South Bend Railroad;"
That if your Honorable Board sees fit to grant the temporary permit herein
sou#ht, the Chicago, South Shore and South Bend •-Lailroad agrees:
that the trolley wires used in connection with said track shall be suspended
a# a height of not less that eighteen "and one-half (IS*) feet above the rails of said,;
track;
That said trolley wires shall be suspended from span wires, cross arms,
or supports attached to substantial wood poles;
That it will hold harmless said City from all damages,, costs and expenses
which said City shall be compelled to pay as a result of any default, carelessness
or neglect of the RailRoad in -the construction, maintenance and operation of its
said temporary side track on and across said streets, provided, however, that said
jity shall tromptly notify said Railroad pf any suit brought against said City;
That the Railroad will discontinue the use of said temporary side track
as soon as arrangements can be made for the loeati on of Us permanent track across
said streets.
Wherefore the Chicago., South Shore and South Berl Ra ilr oad respectfully i!
prays. your Ho#orable Board that it be permitted to construct and maintain, in the
manner herein set forth, a temporary side track over the route described herein
and upon the conditions set out.

Mr. E. M. Young, Architect, filed the plans, specifications and estimate

No.II Fire Station at a cost of 020,000.00. In the matter of this Fire Station- No.
II, the Board, hereby orders that on the 29th. , day of October I929, 'this Board will
receive, open and read Bedded proposals f or the construction of same. The Board
further orders that notices of said proposals shall be published in the "outh .Bend
News Times and Tribune on the ISth. , day of October and on the 25th. , dey of
October I929, according to law.

Assessment roll for the pavement on Johnson Street from Elwood Avenue to

In both of the above named assessment rolls, the Board, hereby orders that
on the 22nd., day of October 1929, this Board will meet in their office in the City
Hall to hear and receive remonstrances from all persons whose property has been
assessed for said improvements and will decide whether the several lots and parcels
of land have been or will be benefited in the amounts named on said primary assess-
ment rolls or in a greater or less sum than that named on said rolls. The Board
further orders that notices of said assessments together with date of hearings on •
said assessment rolls, shall be mailed to property owners according to law and that
