Board met in regular session at 7-I5 P. !.,T All members present.
City Engineer, TT. G. `:dray, filed the follo,, ing primary assessment roll-s:
Assessment roll for the pavement on Bendi:x Drive from Linden Avenue to
Bertrand Street under Improvement Resolution TTo.2271.
Assessment roll for the local sewer in Johnson Street from Bulla Street
to Keller Street under Improvement Resolution No.2240.
In both of the above named assessment rolls, the Board, hereby, orders
that on the 25th. day of September 1929, this Board ,Faill meet in their office in
the City Hall at 7-I5 P. PIT, to '.clear and -receive remonstrances from all persons whose
property has been' assessed for said improvements and will decide whether the several
lots and parcels of land have been or will be benefited in the amounts named on said
assessment rolls or in a greater or less sum than that named on said rolls.
The Board signed and a-pproved the guarant6e bond of the Albert Construction
Company for the pavement on Sample street from ,"I. line of Olivestreet to 7. line of
N. J. I. : I. R. R. , under Improvement Resolution '.o. 2I44 in the amount of 1757.13
signed by Inland Bonding company.
This being the dote set,

Assessment roll for the pavement on Douglas Street from Dubail Avenue
to Bruce "street under Improvement Resolution No.2252.
assessment roll for the local seT?r�rs in'Albert Avenue, Edison Avenue,
rladstone Avenue from 130• S of Ford Street to the TT line of Sample Street and from
the alley iT of Sample Street from F line of Belleville 3rd., Unit to the 77 line of
Belleville 3rd., Unit under Improvement Resolution TTo.22I5.
In both of the above named assessment _rolls, no remonstrators appeared and
no written remonstrances were filed and the Board, being fully advised in.the premises
finds that the several lots and parcels of land hav-e been benefited in the amounts
shown on said primary rolls. The Board, therefore, takes final action on -said rolls
and declares same in all things ratified, confirmed and approved without modification
and the proceedings closed.
This being the date set, hearing was had on the assessment roll for
the pavement of Yai.n Street from Fairview Avenue to alley south of ''doodside Street
under Improvement Resolution No.2226.
In the above named assessment roll, remonstrators appeared but no written
remonstrance was filed and the Board, being fully advised in the premises, fin('._s that
the several lots and parcels of land have been benefited in the amounts shoT=m on said
assessment roil. The Board, the--refore,' decides to take final action on said primary
roll and declares same in all things ratified, confirmed and approved wit3iout modifi-
cation. The Board now orders said assessment roll delivered to the Department of Fin
ance.
This being the date set, continued hearing was had on the assessment roll
for the pavement on T'ichigan ''tre-it from Donmoyer Avenue to Tot No.5 Chippewa 7-eights
Additi.on under Improvement Resolution 70.2245.
In the above named assessment roll, special 'iginner Chas. 7. Cole
having. revised said assessment roll, presented the modified assessment roll to the
Board'. After heq,rin- all persons interested in said assessment roll and being fully
advised in the premises, the Board, finds that the several lots and parcels of land
have been benefited in the amounts sho.vn on said modified roll. The Board hherefore
declares said assessment r611 in all thing:. ratified, confirmed and approved and the
proceedings closed. The Board nova orders said assessment roll delivered to the Depart
mint of Finance. -
This being the date set, hearing was had on the assessment roll for t'Ze
pavement on Sample Street from 7. line of Olive Street to W. line of 7. J. I. &- I. R.
under Improvement Resolution Yo- 2I44.
In the above namec assessment roll, written remonstrances were -filed by
the New, Yor'> Central Railroad, by its attorney John G. Yeagley, and by the Grand Trunk
West Railroad Company, through its attorneys Barker, Crabill and Crumpac'ter. 7pon
the request of these attorneys, the Board decides to continue hearing on said roll
until September 2.5th., I929.
This being the date set, hearing was had on the assessment roll for the
pavement. on Foster Otre-�t from Hos,Tard 6treet to ot. `Tincent Street under Improvement
Resolution TTo.2247.
In the above named assessment roll, Ernest 73eiland, oTFmer of Lot TTo.I in
Daliman's Addition remonstrated against his assessment of : II5.30. In vielzt of the
fact that this lr)t is only 33 feet wide and has a depth of 225 feet, the Board decides
to modify said assessment roll by reducing this assessment-70,00, leaving the amount
assessed against Lot I in Dallmanrs Addition p45.39 and the City to pay this reduction
of 70-30 out of Refunds, awards and damages appropriation. After hearing all persons
interested in said assessment roll, the Board takes final action and declares said

City Engineer, E. G. gray, submitted the tabulation of bids for the grad
ing of the alley south. of Donald Street from Robinson Street to Sampson Street under
Improvement -Resolution No.2280, as follows:

Bids having been received for the grading cf the alley south of Donald
Street from Robinson Street to Sampson Street under ImprovemEnt Resolution No 2280, the
Board this I8th. , day of September I929, hereby awards :the contract to Eston Ball at
his low bid of $456.00%

The -board approved the Final Estimate submitted by City Engineer H. G.
Wray for the pavement on VI'ilber Street from Lincoln Way Vest to Elwood Avenue under
Improvement Resolution No.2253 in the amount of 032,422.80.

the Board adopted said plans and specifica ti ons t ogethe r with the follcping improvement
resolution:
Improvement resolution No.230I for the pavement of the alley Est of

j In the above named improvement resolution, property owners filed a
waiver, waiving P11 objections on and in defense to any defect in proceedings and town
violation in procedure for the construction of street or alley improvement as fixed by
law. Vkereupon the Board, receivedm opened and read the following proposals for the

for 507o of the contract price signed by Inland Bonding Co.

2273 in the amount of26,672.60. The Board also approved the construction bond of sam
for 50% of the contrast price signed by Inland Bonding Company.

In all of the above named improvement resolution, the Board hereby orderz,

the on the 9th., day of October 1929, this Board will meet in their .office in the City
Hall at 7-I5 P. M. � to hear and receive remonstrances from all persons whose property
is liable to be assessed fbr said improvements and will decide whether the benefits to
the several lots and parcels of land liable to be assessed for said ikprovements will b
equal to the estimated costs of same as reported by the City Engineer. The Board furth �r
orders that notices of said hearings shall be published on the 21st. J day of 'pep tember
and on the 28t�r., day of September I929, in the South Bend Nms Times and Tribune accor-
j ing to law.

resolutions:
Improvement Resolution No.2289 for the pavement of the alley south of
50 Wednesday, September I8t h. , ;920.
Tilton Street from Nigh! 6treet to Dale Avenue.
Improvement resolution No .2290 for the pavement of the k1ley
east of Nigh Street from 1,ilton Street to Calvert street,
In both of the above na:n.ed improvement resolutions, no remon-
strr= tors appeared and no written remons tra nce was filed and the Board, being fully ad-
vised in the premises, finds that the benefits. to the several Tots and parcels of land
liable to be assessed for said improvements will be equal to the estimated costs of samE
as reported by the City Engineer. The Board, therefore, decides to take final action
on said improvement resolutions and declares same in all things ratified., confirmed and
approved without modification.
The Board now orders that on the Ist.,, day cC October 1929, th
Board will receive, open and reaa serled proposals for the co4struction of said.' improve
ments up to I0:00 A. M. The Board further orders that notices of said proposals shall
3ublished on the 20th.0 day of September and on the 271t., day of September I929 in the

vacation resolutions:
Vacation Resolution No.229I for the Vacaation Df the alley
north of werwinski street from the wrest line of Wilber Street to the west line of Lot
64 in Kauffman Place Addition projected north. ( See files for copy of resolution.)
vaca. tion Resolution No.2293 for the Vacation of Lnden Avenue
from New York central Railroad rig1-t of Way to the new location of Linden avenge. (See
files for copy of resolution.)
In all of the above named vacation resoltuojs, no remonstrator.
appeared. and no written ^emonstrences we-e filed and the Board, being fully advised in
the premises decides to take final action on said vacation resolutions and declares same
in all things r-tified, confirmed and approved and the street and alley vacated, The
Board now orders that lists or rolls be prepared cif' all owners and holders of property
and of valuable interests therein sought to be taken or to be affected by :such vacationf
which lists or rolls shall also describe the property beneficially affected by such
vacations.
The Bce rd signed the claim of E. T. Tranberg against the Air
Port Department in the amount of 02,779.02.
This being the detq set, hearing was had on the resolution for
the Vacation of Kankakeerenue from r'eade Street to Linden Avenue under Vacation Res-
olution No.2292. (See files for copy of resolution.)

In the above named vacation resolution, representatives of
the Indiana and Michigan Electric Company were present remonstrating against said �
vacation resolution. After hearing all persons interested in said vacation and being;
fully advised in the premises, the Board decides to modify said Vacation Resolution
to read as follows: vacation of Kankakee Avenue from the west line of the alley west
of Kaley Street to Linden Avenue, more particularly described as follows, to -wit:

Beginning at the intersection of tb e south line of Kankakee
Avenue with the west line of the alley west of Kaley Street, thence north to the south
right of way line of the New York Central Railroad, thence northwesterly aloo.g said south
line to the south lane of Linden Avenue :�roduced eastg thence west along said south lin
of Linden Avenye produced east to the south line of Kankakee Avenue, thence southeaster-'
ly along the said south . I ine to the west line of the alley west of Kaley Street, the
place of beginning, excepting that portion lying within ti-�_e new location of Llfdlan
Avenue.
With this modification, the Board decides to take final actionii
on said Vacetion Resolution and declares sme in all things r^tified, confirmed and
approved as modified. The Board now orders that a list or roll be prepared of ill own-;1
ers end holders of property and of valuable interests therein sought to be taken, whichl-
list or roll shall also describe the property beneficially affected by such vacation. 11
