Board met in regular session at 9 A. M. All members present. Minutes of
meetings held September 3rd. , and September 4th., I929`, read and approved.

Assessment roll for the pavement on Douglas Street from Dubail .Avenue to
Brmce Street under Improvement Resolution No.2252.
Assessment roll for the pavement on main Street from Fairview Avenue to

approved the construction' bond of same in the amount of I00% of the contract price
signed by Standard Accident Insurance Co., Detroit, 71richigan.
The Board signed the contract with Rieth Miley Construction Company for the
apavement on '.line Street from south curb line of Lincoln Way Fast to Swing Avenue under
Improvement Resolution 2to.2254 in the a�^ount of 159,492.51. The Board also approved the
construction bond of same in the amount of 50 of the contract price signed by Southern

This being the late set, bVs were received, opened and read for the grade,
curb and waft improvement on Farneman Street from T."ichigan Street to Yain Street under

remain the pr-perty of the Contractor.
The Contractor shall at its cost, furnish all lamp renewals and
light all lamps herein provided for a period terminating with th?termination of the
street lighting contract, which :°ate is January I, I935, at noon,

tion obtainable.
2. Additional street light_ng units referred to herein as railway
elevation un�ler pass lights, shall be added from time to time upon written notice
from the City, provided, ho;�!e`rer, that not more than two (2) additional lamps shall
be ordered at any street crossing, garment therefor shall be at the rate provided
for in this con"ract, commencing on the day on which the lamps are to be in service.
3. All lamps 'Herein provide' for shall be burned from one-half
hour after sunset until one half hour before sunrise, e-rery night and all night,
burning approximately fourthousand (4000) hours per annum.
4. Th' number of lamps furnished and 1 _ghtbd under this contract
shall be the number provided for in paragraph I hereof and shall be located as shown
on prints Attached 'Hereto and i,''.entified by the Signatures of the Contractor and the

5. All outages shall be reported daily in writing by the proper
officials of the City tf the Contractor and the proper officials of the City may
deduct from the total mont,�tly amount which would have been paid for any lamp so re-
ported on any outage occurring, the su, bearing the ratio to such total as the outage;;
bears to the total time the lamp rroald have been lighting in any month.

6. Street lighting units herein contracted for shall be moved by the
Contractor to such new locations as the City may by writing direct, subject to the
following conditions:

Such moving of lamps shall be completed within thirty (30) days after
receipt by Contractor of written notice from the City, Sundays, legal holidays and
:1 stor-my day not to be included, provided that the number of such removals shall not.
Jexceed one per day and provided further that such removals shall not be required
1 on Sundays, legal holidays and stormy days. Notice Viat the wor'c of such removal

The actual cost to the Contractor for making such relocations shall be

8. The Contractor shall have t'r e right with the consent of the Board of
Public ''forks of the City, at any time during the life of this contract to install,
operate and maintain in the place of the lamps herein provided for-,. and under the
same terms and conditions, other and more improved lames in 'peeping with such advance
ment as may be made in the art of lighting, which lamps shall be of equivalent or
greater illuminating power.
9. In authorizing ar granting a permit to any person, firm or corporation
to .repair or cut into any street alley, or sideway-c in which said street lighting
units and lines and cables supplying cars-nt thereto are located, the City shall
require as a condition to the granting of such permit, an agreemtn on the part of
the applicant that such lines and cables and street lightning units will not be inter-
ferred Trrith in any manner without notice to the Contractor.

10.1 All the covenants, expressions, terms, conditions, provisions and
agreements herein shall extend to and be binding upon, or inure to the benefit of,
as the case malr be, each and every one of the successors or assigns of each of the
parties hereto as if in every case so expressed.
II. This contract shall be in force and effect for a period terminating
with the termination of the =eneral Contract for street lighting, which termination •
date is January I, 1935, at noon.
In witness whereof, the said City of South Bend, Indiana, has caused its
corporate seal to heremnto affixed and this contract to be signed by the Board of
Public Works of said City and said Indiana & I-Tichigan Tlectric Company has caused
this contract to be duly execated , in duplicate, this day and y-ar first above '

The Board approved the Final Estimate for the heavy traffic concrete rave-
1; ment improvement on Foster Street to Foward Street to St. Vincent Street in accord-
ance with the terms of the contract between the City and Hoban Pr Roach, contractors,
I' under improvement Resolution No.2247, in the amount of '"5,084.9I.
Day roll claims in the amount of 79,027.96 for various departments were
signed and approved by the Board.
The Board also approved a pay roll claim for the Trigineering Department
in the amount of I32.00 and h-reby orders the City Controller to pay same out of
Trac'c Mevation fund.
Claims in the amount of 13,599.93 for various departments were s-tgned and
approved by the Board.
This being the date set, the following proposals were received, opened and
read for the Collection and Disposal of Garbage and for the Disposal Only of Garbage
in the City of South Bend, Indiana.

Gentlemen:
As we have been operating and disposing of the garbage of the City of
South Bend of the City of South Bend, also of Yishawaka, for more than two .years,
and had no complaints or caused any disturbance in the neighborhood, and with our
present tray of disposing of the garbage, crhich '-ias proven very satisfactory, also
the convenience way of unloading the garbage for the City trucks, which is quite a
saving of expense of the City true,s and tires, this has been very satisfactory
with the Superintendent of the Garbage Department of South Bend, we will continue
in like matter for the term.
Also we will furnish one truck and man to be used in gathering and drawing
garbage to the place of delivery during the heavy season of the year, and will at
all times cooperate with the City, and still are going to make more improvements in
the way to lessen the expense bf both ourselves and the City.
In the event an injuntion should arise against us, or any trouble of any
kind, and we are unable to find a suitable place to dispose of the 13arbage, the
City then will release us from this contract and obligation.
Our proposition is that the City shall deliver the garbage to the farm
now occupies by us north of Yishawa'ca and unload the same under our direction without
cost or expense to us, and the will care for and dis,-ose of the garbage without cost
or expense to the City, and we will execute a contract forthwith, giving and execut-
