W y g' ay, filed the following primary assessment rolls Assessment roll for the pavement on Bissell Street from Eddy Street to east end.of Bissell Street under Improvement Resolution No.2185. Avenue -to Assessment roll for the pavement a point 348 -feet south of Pleasant Street it of 26th. , Street from Mishawaka under Improvement Resolution ii No. 2I94. In both of the above named assessment rolls, the Board, hereby, orders that on the 7th., day of August I9299 said Board will meet in their office in the City Hall at 7-I5 P. Mt., to hear and receive remonstrances from all persons whose I property has been assessed for said improvements and will decide whether the i several lots and parcels of land have been or will be benefited in the amounts -named on said primary assessment rolls or in a geeater or less sum than that named on said rolls. The Board further orders that notices of said hearings shall be on the 2nd published day of August and on the 3rd. , day of August I929, in the South Bend News Times and Tribune according to law.it i City Aigineer, IT. Bids having been received for the pavement on Tonti Street from Tecumseh Street to Irquois Street under Improvement Resolution No.2256, the Board this 3Ist. , day of August, 1929, hereby, makes a preliminary order for sheet asphalt resurface as :the type of pavement with which said street shall be imps oved and sets the I3th. , day of August 1929, as the time when said Board shall either act on petiti ons for a change in the type of pavement other than that specified in the preliminary order, award the contract or reject all bids. This being the date set, hearing was had on Improvement Resolution li No.226I for the pavement of Pleasant ''treet from the alley west of 2Ist. , Street to • east line of 31st., Street. (See files for copy of resolution.) 'i In the above named improvement Resolution, remonstrators appeared and a written remonstrance was filed and the Board, being fully advised in the premises, decides to rescind all -former action taken on said resolution and all ii proceedings null and void .and the g g procee in s closed. This being the date set, continued hearing was had on Improvement Resolution �I Ny2254 for the pavement on Kline Street from the south curb line of . Lincoln Way st tv iffi4g Avenue. (See files for e.opy of resolution,) In the above named improvement resolution, _remonstrators- appeared and Yr. Brie Parker, -appeared, representing about 75% of the resident property owners on sad street. Mr. Parker requested the Board to. continue action on this resolution under August 7th.., 1929. Tiny 3Tst., I929.. • • • W rerresented were faivorable to the improvement but would like to have the hearing continued for one week, during which time these property owners expect to work out some plan of assessment on the lots along said Kline Street. The Board decides to -grant said request and continues hearing until August 7th., 1929. This being the date set, hearings were had on the following improvement resolutions: improverr:ent Resolution No. 2259 for the pavement of Fremont Street from Lincoln flay Kest to Humboldt Street. (See files for copy of resolution.) Improvement Resoluition No.2260 for the pavement of Huey Street from Lincoln 'Way West to Elwood Avenue. (See files for copy of - resolution.) . In both of the above named improvement resolutions, no remonstrators appeared but no written remonstrances were filed and the Board, being fully advised in the premises, finds that the benefits to the several lots and, parcels of •land - liable to. be assessed for said improvement will be equal to the estimated cost .of same as reported by the City Engineer. The Board therefore, decides to take final action on said resolutions and declares sare in all things ratified, confirmed and approved without modification. The Board now orders in the matter of noth of the above named improvement resolutions, that on the 20th., day of August, 1929, this Board will receive, ppen and read sealed proposals up to 10:00 A. V. The Board further orders that notices of said proposals shall be published on the 9th. , day of August and on the Nth., day of August 1929, according to law in the south Bend News 'dimes and Tribu4e. This being the date set, hearing was bad on the assessment roll showing the awards of damages and assessments of benefits in the matter of the opening and extension of Linden Avenue and Bendix Drive under Condemnation Resolution No.2243. In the above named assessment roll, no remonstrators appeared and no written remonstrance was filed and the Board, being fully advised in the premises, finds that the several lots and parcels of, land have been benefited and damaged. in the amounts shown on said assessment roll. The Board, therefore, takes final action on said assessment roll -and declares same in all things ratified, confirmed and approved with out modification and the proceedings closed. Whereas, on �eeember.'�Ist., I928 Edward T<rill, :arid others, filed in, the office of the Auditor -f St-: Joseph County, in the ?tate of Indiana, their i) petition for the improvement of a certain highway, in Portage Township of said county; in which proceedings, the beginning, course and termination of said proposed" improvement is as follows: Commencing at the point on the Ear Road where it intersects the public highway known as the Portage or Nasturtium Road, at the center of Sect on5, Towns#ip I 37 North, Range 2 East, in St. Joseph County Indiana, thence rnnning East along and upon said fir Road through the East half of tection 5, and thngh the west half of Section 4, and thence Northeasterly along and upon said Earoad through the East half of said Section 4, and through the Northwest ,,carter of Section 3, all of said -Township and Range, to where it intersects the public road known as the Lincoln Highway in the City of South Bend, where it terminates; being less than three (3) miles in length. And whereas, said petition was afterward duly referred to viewers, and said. viewers have duly file' their determination and report thereon, with complete plans,, specification and an accurate profile of the said highway to be improved by said proceedings; And k hereas, a part of said highway proposed to be improved is within the corporate limits of the -said City of Jouth Bend, Indiana, which said part is a portion of the Ear. -Road in said City; Therefore, be it resolved by the Board of Public Works of the City of South Bend, Indiana, that this Board does hereby consent to and apir ove the said proposed improvement of said street and highway, and of said portions of said thr Road in the City of South Bend, 'by the Board of Commissioners of St. Joseph County, State of Indiana, under said petition, as set forth and described in said proceed- ings, and according to the plans, specification and profile, now in file in the office of the Auditor of said County; the grade within the City is to conform to the,established grade of said Road in said City.
