The meeting was held in the Common Council Chambers, 4th Floor County City Building, South

The Board of Public Safety met in the regular meeting at 9:18 a.m. on Wednesday, December 16,
2009, with President Juanita Dempsey and Board Members Patrick Cottrell, Bruce BonDurant, Laura
Vasquez, and Eddie Miller present. Also present were Police Chief Darryl Boykins, Fire Chief
Howard Buchanon and Board Attorney Thomas Bodnar.
The meeting was held in the Common Council Chambers, 4th Floor, County City Building, South
Bend, Indiana.
ACCEPT MINUTES OF PREVIOUS MEETINGS
President Dempsey advised that if there were no objections by members of the Board, the minutes of
the Public Agenda Session, Executive Session, and Regular Meetings of the Board held on
November 18, 20099 and the Special Meeting of December 8, 2009 would be accepted.

APPROVE RE-ASSIGNMENT OF FIREFIGHTERS AND ADOPT RE SOLUTION NO, 62-2009 -
A RESOLUTION OF THE BOARD OF PUBLIC SAFETY REORGANIZING THE RANKS OF
THE SOUTH BEND FIRE DEPARTMENT
Upon a motion by Mr. Cottrell, seconded by Mr. Miller and carried, the following Resolution was
v,pproved by the Board of Public Safety:
RESOLUTION NO. 62-2009
A RESOLUTION OF THE BOARD OF PUBLIC SAFETY REORGANIZING THE
RANKS OF THE SOUTH BEND FIRE DEPARTMENT
1. The rank of Firefighter shall be abolished and any sworn members holding that
position shall be assigned the rank of Third Class Firefighter;
2. Every sworn member, including those who currently hold the rank offirefighter, shall
be assigned to and shall hold the rank of Third Class Firefighter until the end of his/her probationary
year-,
3. The rank of Second Class Firefighter is created. A sworn member shall become a
Second Class Firefighter upon the completion of his/her probationary year; and
4. All sworn members who hold the rank of First Class Firefighter on December 31,

2009 shall be reassigned at the beginning of the new year to the rank of Second Class Firefighter,
which reassignment shall not involve any change of pay or of benefits.
6. Any Firefighter sworn in after this date shall be eligible for promotion to First Class
Firefighter after the five years of service and a recommendation from the Fire Chief that the sworn
member has completed five years in a satisfactory manner.
T The rank structure of the South Bend Fire Department shall not be otherwise changed
by this Resolution,

Also presented from Chief Buchanon to the Board for approval was a list of Firefighters First Class
that will be re-assigned to Firefighter Second Class effective the I st of January, 2010. Upon a motion
by Mr. Cottrell, seconded by Mr. Miller and carried, the re-assignments were approved effective
January 1, 2010.
APPROVE AGREEMENT WITH MEMORIAL HOSPITAL FOR AMBULANCE STAFFING FOR
2010
Mr. Bodnar presented the Board with the above yearly contract for approval. Upon a motion by Mr.
Cottrell, seconded by Mr. Miller and carried, the 2010 Children's Hospital/Medflight Ambulance
Staffing Agreement was approved.
APPROVE 2010 AGREEMENT FOR THE PROVISION OF 911 EMERGENCY MEDICAL
SERVICES TO THE UNIVERSITY OF NOTRE DAME
Upon a motion by Mr. Miller, seconded by Ms. Vasquez, and carried, the 20 10 Agreement for 911
Emergency Medical Services to the University • Notre Dame was approved. Mr. Bodnar noted that
Mr. Cottrell abstained from the vote due to his employment with the University of Notre Dame.
APPROVE 2010 COLLECTIVE BARGAINING AGREEMENT
Mr. Chuck Leone, City Attorney, spoke to the Board about the negotiations of the 2010 Fire
Department Collective Bargaining Agreement. He stated it was hard bargaining between the City and
the Union and he was pleased with the final product. He noted there are changes to allow for

managing overtime that will help with the budget restraints. Upon a motion by Mr. Cottrell,
seconded by Mr. Miller and carried, the agreement was approved.
FILING OF MONTHLY STATISTICAL ANALYSIS REPORT — NOVEMBER 2009
Chief Howard Buchanon submitted to the Board the monthly report for the month of November 2009
compiled by the Prevention/Inspection Bureau of the Fire Department. The Board accepted the
report as submitted for filing.

Upon a motion by Mr. BonDurant, seconded by Ms. Vasquez and carried, the following Resolution
was approved by the Board of Public Safety:
RESOLUTION NO. 61-2009
A RESOLUTION OF THE BOARD OF PUBLIC SAFETY REORGANIZING THE
RANKS OF THE SOUTH BEND POLICE DEPARTMENT
WHEREAS, in the months of June through September, 2009, the Board of Public Safety
through its appointed agent, Charles Leone, and other members of the City's Advisory Negotiating
Team negotiated a new one year ng wage package and Working Agreement with the Fraternal Order of

Police Lodge No. 36, the representative of the sworn members of South Bend Police Department
excluding the ranks of Captain and above; and
WHEREAS, during the negotiations the parties agreed that there should be a restructuring of
the ranks so that eventually the highest non-supervisory rank in the South Bend Police Department
will be Patrolman First Class and the rank of Corporal will be phased out; and
WHEREAS, the financial constraints upon the City at this time require that this full
restructuring take place over a number of years but that the intent is to benefit pensioners and not to
provide an interim windfall raise to some current sworn members; and
WHEREAS, the Board of Public Safety is the appropriate body pursuant to its powers under
LC. 36-8-3 to restructure the ranks of the South Bend Police Department, and to create job
descriptions and promotion requirements for the ranks within the South Bend Police Department.
NOW, THEREFORE, THE BOARD OF PUBLIC SAFETY, makes the following changes in
the rank structure of the South Bend Police Department to be effective at 12:00 midnight, January 1,
2010:
1. The rank of Entry Level Officer shall be abolished and any sworn members holding
that position shall be assigned the rank of Third Class Police Officer;

that will become Second Class Patrol Officers effective the I st of January, 2010. Upon a motion by
Mr. BonDurant, seconded by Ms. Vasquez and carried, the reassignments were approved effective
January 1, 2010 pursuant to Chief Boykins letter,
RESOLUTION NO. 63-2009
A RESOLUTION OF THE BOARD OF PUBLIC SAFETY OF THE CITY OF SOUTH
BEND, INDIANA AMENDING RESOLUTION NO. 57-2009 TO CORRECT THE 2010
HOLIDAY SCHEDULE FOR THE SOUTH BEND POLICE DEPARTMENT.
WHEREAS, the Board of Public Safety of the City of South Bend, Indiana, is empowered by
law to establish rules and regulations for the South Bend Police Department: and
WHEREAS, it is in the interest of the City of South Bend that the Police Department
holidays be set with certainty,
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Safety of the City of South
Bend:
SECTION 1. That for all sworn police officers who are assigned to work as their regular
schedule, 5 on and 2 off, Monday through Friday, the following holidays shall apply:

ACCEPT AND FILE DONATION
CliiefBoykins, Police Department, advised the Board of a generous donation made to the South
Bend Police Department Summer Tennis Program. The donation of twenty-five dollars was given by
Mr. and Mrs. Costello in memory of Mr. Pletcher. There being no further discussion, the donation
was accepted and filed.
ACCEPT AND FILE DONATION
Chief Boykins, Police Department, advised the Board of a generous donation made to the South
Bend Police Department Youth Boxing Program. The donation of one-thousand dollars was given by
the St. Joseph County Prosecutors Office. There being no further discussion, the donation was
accepted and filed.
FILING OF MONTHLY STATISTICAL ANALYSIS REPORT — NOVEMBER 2009
President Dempsey indicated that unless there were questions or objections by members of the
Board, the monthly statistical report for the month of November 2009 as submitted by the Police
Department, would be accepted for filing. There being no objections, the following report 'Alas
