The first (1NO010C5H00081) covers the period of August 29, 2009 through August 28, 2010, the second (INO009C5H00081) covers the period of August 1, 2009 to July 31, 2010. The City serves as a fiscal agent and recipient of funds for the eligible agency receiving the SPC dollars. The funding allocated provides support for 6 units and 2'7 units respectively, of sponsor based xental assistance for housing mentally ill clients. Addressing homelessness is one of HUD's top priorities and the continuance of these projects makes a significant contribution toward assuring the development of a continuum of care system in our community, I will be presenting this ordinance at the January 25, 2010 meeting. S. Department of Housing and Urban Development for the delivery of such services through various subgrantees. As you may recall, when the Common Council enacted its budget appropriation Ordinance #9956 -09 on September 28, 2009, The National Football Foundation had recently announced its intent to relocate the Hall of Fame to Atlanta, Georgia. Accordingly, the Con -mon Council did not appropriate funds for the Hall of Fame. At this time, the College Football Hall of Farne will remain open and operable through all or most of calendar year 2010. Because the City has certain financial obligations to The National Football Foundation under the Second Interim Agreement, this ordinance makes the necessary appropriation. On September 28, 2009, the South Bend Common Council enacted Ordinance No 9956- 09 constituting the City of South Bend's budget appropriation for 2010. At that time, the status was uncertain of the College Football Hall of Fame located in downtown South Bend. Accordingly, South Bend's 2010 budget as enacted September 28, 2009 did not include appropriations for the College Football Hall of Fame. At this time, it is agreed that the College Football Hall of Fame will remain open and operational through all or most of calendar year 2010, Consequently, the City has certain financial obligations relating to the College Football Hall of Fame pursuant to the City's Second Interim Agreement with The National Football Foundation and College Football Hall of Fame, Inc. This ordinance appropriates monies necessary for South Bend to meet its financial obligations under the Second Interim Agreement. WHEREAS, a petition for personal property tax abatement consideration has been filed with the City Clerk for consideration by the Common Council of the City of South Bend, Indiana, requesting that the area commonly known as 850 S. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council hereby determines and finds pursuant to Indiana Code 6- 1.1- 12.1 -4.5 et seq., that: a. The estimate of the cost of the n.ew manufacturing equipment is reasonable for equipment of that type; b. That the estimate of the number of individuals that will be employed or whose employment will be retained by the Petitioner can reasonably be expected to result from the proposed installation of new manufacturing equipment; C. That the estimate of the annual salaries of those individuals that will be employed or whose employment will be retained by the Petitioner can be reasonably expected to result from the proposed installation of new manufacturing equipment; d. Any other benefits about which information was requested are benefits that can be reasonably expected to result from the proposed new manufacturing equipment; and The totality of benefits is sufficient to justify the deduction requested. SECTION II. The Common Council hereby determines and finds that the proposed new manufacturing equipment can be reasonably expected to yield the benefits identified in the Statement of Benefits as set :forth in Sections I through 3 of the Petition for Personal Property Tax Abatement Consideration and that Statement of Benefits form completed by the petitioner, said form being prescribed by the State Board of Accounts, are sufficient to justify the deduction granted under Indiana Code 6-1.1- 12.1 -4.5. SECTION III. The Common Council hereby accepts the report and recommendation of the Department of Community and Economic Development, and the Community and Economic Development Committee's favorable recommendation; that the area herein described be designated as an Economic Revitalization Area for purposes of personal property tax abatement and hereby makes such a designation. SECTION IV. The Common Council determines that such designation is for personal property tax abatement only and shall be limited to two (2) calendar years from the date of the adoption of this Resolution by the Common Council. SECTION V. The Corrm)on Council hereby determines that the property owner is qualified for and is granted property tax deduction for a period of five (5) years. SECTION VI. The Connuon Council directs the City Clerk to cause notice of the adoption of this Declaratory Resolution for Personal Property Tax Abatement to be published pursuant to Indiana Code 5 -3 -1, said publication providing notice of the public hearing before the Coznnaon Council on the proposed confirming of said declaration. Dear Council Member Rouse: Please find attached the Department of Community & Economic Development's report on a personal property tax abatement petition for the above- referenced petitioner. Also attached is a copy of the petition, Statement of Benefits form, and supporting information. The project calls for the acquisition and installation of precision machining equipment to be located at 850 South Marietta Street, Suite 300. The report contains the Department's findings relative to the above petition. The total cost for the equipment is estimated at $437,500. The project meets the qualifications for a (5) five -year personal property tax abatement and a representative from Endeavor Machined Products, Inc. will be available to meet with the Committee on Monday, January 25, 2010. They fake pictures of the ID, the person, and their finger print. This is all logged with whatever they are scrapping. They can search by name, item scrapped, dates, etc....... They are paid by contactors to take in forklift tires. They then strip the rubber from the tires and make various rubber products from them. They take the metal left over from tires, and throw it in a bin which is collected by Acme recycling. They are then paid by Acme for the scrap. At no point do they do any purchasing for any scrap, tires, or anything else. They are paid both for taking in the tires, and the scrap metal their business produces. They do not have any of the required items, because they do not do any purchasing. This will further enable all public safety responders within the St. Joseph County boundaries to cooperate with state, local, and surrounding county police and fire departments, as well as federal agencies, in the face of a massive emergency, and in day to day law enforcement. South Bend's current portable public safety radio system is not compatible with 800 Mhz technology and thus impedes effective interagency communication. To upgrade South Bend's public safety (police and fire) radio system to an 800 Mhz system fully integrated with that of the County and City of Mishawaka requires an expenditure by South Bend of $2,750,000.00 as its cooperative portion of the cost of (1) upgrading five (5) Safe -T towers by adding two additional 800 Mhz channels per cell tower, (2) purchasing associated equipment and upgraded software, and (3) purchasing for South Bend's public safety officers three hundred sixty (360) in- vehicle mobile radios and four hundred five (105) portable radios. A Variance from the requirement that the proposed 14-foot high Bottled Gas Storage Tank be allowed to exceed the height of the proposed 10 -foot high vinyl screening fence by a maximum of 4 feet (i.e. height of Bottled Gas Storage Tank being a maximum of 14 feet) . Property is presently zoned "LI" Light Industrial District. The Petitioners are the owners of the real estate parcel shown on the attached site plan and as shown in the records of the St. Joseph County, Indiana Auditor's office. The Petition property presently has a Zoning classification of "i,I" Light Industrial District. The Petitioners have been the owners of the property for the last several years. The present use of the owners property includes two existing multi - tenant buildings. The owners have been approached by NuCO2, a Bottled Gas Distributor who desires to lease space in the building facing Cleveland Road. They also would like to place a CO2 Storage Tank as shown along the west property line behind the existing buildings. The proposed storage tank has a height of 14 feet. NuCO2 would place a 10 --foot high solid vinyl fence around the proposed storage tank to screen it from the adjacent property and from Cleveland Road. The placement of the tank was chosen to be located on the existing paved parking lot, but also placed to allow for circulation of cars and delivery trucks that access the rear of the existing buildings. The existing buildings would screen the proposed storage tank area from Deahl Court and from a large portion of the Cleveland Road frontage of the property. The shown storage area will be large enough to park three of the company's delivery trucks within a secured chain -link fenced area. The Petitioners met with the City's Building Department Staff, to discuss the Bottled Gas Storage Tank facility proposed to be located on the petition site. Based on review of the present City Zoning Ordinances, the Petitioners would be required to have approved a Special Exception to allow for the proposed Bottled Gas Storage and Distribution facility on property with a zoning classification of "LI" Light Industrial. There are also certain screening requirements and setback requirements that would apply for the placement of the proposed storage tank. More specifically, the Petitioners are requesting approval of a Special Exception as allowed under Section 21 -04.01 (2) (A) of the City of South Bend Zoning Ordinance to allow for a Bottled Gas Storage and Distribution facility. The Petitioners and the NuCO2 believe this location in an Industrial Park and having access to Cleveland Road, one of the South Bend's and the County's main thoroughfares, would allow easy access to a majority of their clients. They also believe the size of the proposed Bottled Gas Storage area is small in size and would not be a detrimental use in the Industrial Park nor would it have an adverse affect on surrounding properties. The facility is also placed on the site to have the least interruption with the existing circulation pattern of cars and delivery trucks to the existing buildings. The Petitioners and contingent purchasers would ask the Board Members to agree that approval of the Special Exception to allow for the proposed Bottled Gas Storage and Distribution facility as shown on the attached site plan, would not be injurious to the public health, safety, comfort, community moral standards, convenience or general welfare, or injure or adversely affect the use of the adjacent area or property values therein, and that the proposed use will be consistent with the character of the district in which it is located and the land uses authorized therein, and that the proposed use is compatible with the recommendations of the City of South Bend Comprehensive plan, all of which is requested by the South Bend Municipal Code 5 21 -09.03 (i). With regards to the Variance requests for Parcel "A ", the first Variance the Petitioners are requesting, is from the minimum required 10 -foot Side -yard Setback along the West property line to a minimum of 5 -feet for a proposed Bottled. Gas Storage Tank. As stated above the location of the proposed tank was placed to allow for cars and delivery trucks to use the existing parking spaces and delivery docks behind the buildings. By placing the storage tank as shown, the existing aisle ways will remain open and the existing parking spaces can be easily accessed. The location of the storage tank will also allow for a delivery truck to re- -fill the tank as needed. NuCO2 would like to place the facility on the existing paved area, and leave a clear space around the tank. The location of the tank will not be detrimental to any adjacent owner. There is an existing 10 -foot wide utility easement which runs north and south on the adjacent property along the common boundary line which will also insure no buildings would be built close to the proposed storage tank. The second Variance request is from the required screening of outside storage areas with a ornamental, solid wall, architectural screen, masonry or similar fence with an open space of less than 30% including entry /exit gates made of materials compatible with the fence, supplemented by a Type "B" Partial screening along the North, East, South sides of the proposed outside storage area and along the West property line to the following: Along the North, East, South sides of the proposed outside storage area and along the West property line using a 10- -foot high vinyl screening fence, with no additional landscape screening as shown. The proposed placement of the storage tank is located behind the existing buildings as viewed from Deahl Court and from almost the entire frontage of Cleveland Road. The storage tank would set 280 to 300 feet from Cleveland Road. 'There is also a grade M difference of approximately 12 feet from Cleveland Road to the area of the storage tank. Vehicles traveling west on Cleveland Road would have a difficult time viewing the storage tank and vehicles traveling east on Cleveland Road would have a very limited view of the storage area. The placement of the 10 -foot high vinyl - screening fence should also mitigate any direct view into the storage tank area. As shown, the storage tank is on the existing pavement. The pavement is at the property line, which leaves no area for placement of landscaping. The owner and NuCO2 would prefer not to remove the existing pavement. They would hope the Board would agree that with the location of the storage tank behind the existing buildings, the placement of the 10 -foot high vinyl fencing around the storage tank and the distance the storage tank sets back from Cleveland Road would meet the intent of the zoning ordinance to screen the use. They believe that approval of the request for no additional landscaping would not be detrimental to surrounding properties. The last Variance request is from the requirement that the proposed 14 -foot high Bottled Gas Storage Tank be allowed to exceed the height of the proposed 10 -foot high vinyl- screening fence by a maximum of 4 feet (i.e. height of Bottled Gas Storage Tank being a maximum of 14 feet). The proposed storage tank with its required piping located at the top of tank will exceed the fence height by a maximum of 4 feet. The owners and contingent leaser do not believe this small amount of exposure by a portion of the tank and piping will create an adverse impact on adjacent properties. They would note that the fencing will screen a majority of the structure and combined with the location of the structure on the site; there should be little negative impact on surrounding industrial sites or along the Cleveland Road frontage. The Petitioners would ask the Board Members to agree that approval of the above described Special Exception and Variances will not have a detrimental affect for this area, nor would the property values, public's health, safety, morals, or general welfare be adversely affected. The Petitioners contend that the strict application of the terms of the Zoning ordinance will constitute an unusual and unnecessary hardship as applied to the property for which the Variances and Special Exception are sought! that the need for the Variances and Special Exception arises from such condition peculiar to the property in the same Zone: and that the use or value of the area adjacent to the property described in the Petition for the Variances and Special Exception; will not be injurious to the public health, Safety, morals, or general welfare of the community. Ignition Park is a major development initiative of the City of South Bend, which may very well change the development pattern not only within the project area, but well beyond it. As Ignition Park develops into a modern technology park, land uses within the park and surrounding it must be compatible with the goals being established to ensure its success. Establishing non - compatible uses on the edges of the technology park will not support the general welfare of the community in the success of the park, and may very well affect the values of property within the park as it is marketed and developed to standards well beyond what is currently required on industrial - zoned properties surrounding the park. 12. The petition of Paul Markley. The staff recommends that the Special Exception be sent to the Common Council with a favorable recommendation. The staff recommends denial of the no additional landscaping variance. Some landscaping with the fence would act as a buffer to traffic on Cleveland Road, a main entry into South Bend from the west. The staff also recommends denial of the setback variance. No hardship has been presented as a reason to not be able to move the tank another 5' from the property line. There is an expansive paved area including parking spaces that could be reconfigured to meet the required setback. I'm actually going to mare it better because I'm going to amend the petition and I've got a couple of things that bind of go with 27 Area Board of Toning Appeals — .lanuary 6, 2010 what the staff recommendation was. I'm going to amend the petition so that we don't actually need number one. We're going to move the tank over so that it actually is 10' off the side yard setback line. MR. FEDDER: So variance A -I is out? MR. RANCH: So A -1 we do not need. And number two, what we're going to do is we're going to amend that and we are actually going to put landscaping along the west side and along the south side of where the tank is going to be located. And that pretty much matches what the staff had asked us to do. What we're asking for, this piece of property is right up on the corner the northwest corner Deahl Ct. and Cleveland Road. It's a multi tenant building there at 3371. Cleveland Road. NUCO2 basically wants to go in the building but they need to have an outside storage area for their carbon dioxide tank. Under the City requirements for that type of use they consider it, I guess, a gas bottled distribution facility. We need a Special Exception so I need your recommendation for the Special Exception for the tank and the variance that we're just requesting is basically is to be allowed to put it as we had showy with the representation that we're going to put Evergreen .screening along the west side of where the tank is and the chain link fencing and also we're going to put landscaping along the south side. That's all we need. MR. URBANSKI: And the gate's along the south side? MR. DANCH: Yeah but what we'll do though, where you see the gate to just to the west of that, we're going to rip up the pavement there and I'm going to put some landscaping, Evergreen screening there too. And I think one last variance that I didn't change that I usually ask for is that they're going to put a 10' screening fence, solid screening fence around where the tank is but because of the height of the tank with what they call, there is some piping up above it, that would stick up above the fence by 4'. So one of the variances was to be allowed to have anything sticking above the fence by a maximum of 4'. MR. VELLEMAN: You're putting up a white vinyl fence? MR. DANCH: Actually we met with the Design Review Committee yesterday with the City and it will end up being a beige fence because it will match the facade of the building. MR. PHIPPS: Mike the part of the tank that is 4', it's not the full 30' in length as on the site plan? MR. DANCH: They have the piping Jerry. It's the air pipes or whatever they're called. MR. FEDDER: .lust for the record then, we're going to be voting on which variances? MR. DANCH: Well I need the recommendation for the Special Exception and on number two I just need the approval that the way I've represented that we' 11 do the landscaping on the west side and the south side will meet the intent of the ordinance and number three that I'm allowed to have that extension up to 14' up above the 10' fence. DANCH: The way the ordinance is Jerry, on the landscaping portion you can make an interpretation that you might need landscaping all the way around four sides of it and when we went to Design Review when we talked to the staff they basically said on the west side and the south side because that's visible from Cleveland Road. That would be fine, that was their whole concern. MR. PHIPPS: The only thing you might have to leave off with landscape screening is on the north and east side? MR.
