The Board signed the contract z{Tith the Northern Indiana Construction Company for t
the construction of- a sewer in Greenlawn Avenue under Improvement Resolution No.2200, in
the amount of $2,326.12. The Board approved the construction bond of same for T00 % of
the contract price signed by Great American Indemnity Co. !)
The $oard signed the contract with the Albert Construction. Company for the pavemen.
of Chapin street from Ford Street to Prairie venue under Imp ovement Resolution No.2I92 i
in the amount of 43,706.45. The Board also approved the construction bond of same for
50% of the contract price signed by the In1and7 Bonding Company. {
The Board,,signed the contract with Reith Miley Construction Company for the pave-
meat of 26th. , street from Vislaawaka Avenue to a point 3481 south of the south line of
Pleasant Street under Improvement Resolution Wo.2194 in the amount of 21,7I5.44. The
Board also approved the construction bxond of same for 50% of the contract price signed
by 3 uth ern 'cur ety Company. j

This being the date set, continued hearing was had on the assessment roll for the
sewer in Southwood Avenue from Harriett Street to Greenlawn Avenue under Improvement
Resolution N0.2142. The Board decides to continue hearing on said assessment roll until{
Vay 22nd. , I929, at 7-I5 P. M.
This being the date set, continued hee.ring was had on the Tjacat ion Resolution No.
2196 for the vacation of Bridge street from `'olfax Avenue to LaSalle avenue In the
above named resolution, the Board decides to continue hearing until May :22nd..,v 1929 ,.,at

No petitions having been filed for a change of type of -navement other than that
specified in the preliminary order for the pavement of 75th. Street from the Grand
Trunk 'Iestern to 1'ishawa'oa livenue under Imp_r_over-.ent -L�esolution No.2I95, the Board this
21st. , day of Yay I929, hereby makes a final order for concrete pavement heavy traffic
as the type of ravement gith ini',iich said street shall be improved and awards the contract

Bids having been received for the ;grade, curb, walk and pavement imrrovement on
Streets in Ridgedale 5th Addition, under Improvement Resolution No.2228, the 'Board
this 2lst. , day of Vay I929, hereby awards the contra ct for said improvement to
Twyckenham Land and Investment Company at their low bid of, 45,596.00.
Bids having been received for the sidewalk improvement on Aragel
la Avenue and Pokagon
Streettmder Improvement Resolution No.2234, the Board, this 21st. ,. day of MY I929,
hereby awards the contract for said improvement to E. T . Iranberg at his low bid , of
3,368.75.
The Board approved the following bonds;
Renewal certificate for contractors bond,in favor of C. A. Jordan moo., ,in the amoun
of 1,000.00 sign =d by the American Surety company.
Renewal certificate for c ontrae tors bond in favor of ' F. T . Tranberg in� the amount,
of $T,000.00 signed by the Employers Liability Assurance Corporation.
The Board approve('. the recommendation of City Ingineer., u. G. `fray, to -include in
all local sewer improvement specifications, machine made plain concrete sewer, pipe.
The Board approved claims in the amount of 1642.42 for various departments.
City-'ngineer, K. G. Wray, filed the following -nrimary assessment rolls
Assessment roll for the grading of the alley west of Yiami Street from Fairview
Avenue to the cent e- line of Ist. , alley south of Fairview Avenue under. Improvement
Resolution No.2T30.
Assessment roll for the grade, curb and walk improvement on Sherrill Street.f'rmm

In both of the above named assessment rolls, the Board hereby orders that on the
5th. , day of June 1929, this Board will meet .in their office in the City Hall at 7-I5
P. PT.. , to hear and receive, remonstrances from all persons whose property has been
assessed for said improvements and will decide whether the several lots and parcels
of land have been .or will be benefited in the amounts named of said primary assessment
rolls or in a greater or less sum than that named on said rolls. The . Board further
orders that notices of said hearings shall be published on the 3Ist. , dgy of 11ay .
and on the Ist. , day of June 1929, in the lon th Bend News Times and Tribune_ according
to law.

vement on Johns6ni Street from Mwood Avenue to Bulla Street under Im-rovement. Resole-

In the above named assessment roll, the Board hereby orders that on the `5th. , day
of June I929, this Board will meet in their office in the City Hall at 7-I5, a. r.
to hear and receive remonstrances from all persons whose property has- been assessed
for said improvement and will decide whether the several lots and parcels of land
have been or will be benefited in the amounts named on said assessment roll or in a

City Engineer, H. G. Wray, f iledplans, specifications and estimates and the Board
adopted said plans and specifications together with the following improvement resole
ti ons :

south of Sample Street from the west line of Industrial 'Drive to a point 1280 feet
west of the west line of Industrial Drive/ (See files fore copy of resolution.)
Improvement Resolution No.2239 for the pavement of hlarletta Street from the south
line of Sample Street to the south line of the fist alley south of Sample street.

In both of the above named imp3vovement resolutions, property owners waived all
objections on and in defense to any defect in said uroceedings and to any violation
in proceedings, for the constrr-ietion of street improvements as fixed by law. Whereupon[
the Board, received, opened and read the following -proposals:

In all' of the above named improvement resolutions, the Board, hereby, orders
that on the I9th., day of June.I929, this Board will meet in their office in the
City Mall at 7 15 P. Y., to hear and - receive remonstrances from all persons whose
property is liable to +be asses'sed for said improvements and will decide whether
the benefits to the several lots and parcels of land liable to be assessed for. said
improvements will be equal to the estimated costs of same as reported by the City
Mrigineer. The Board further orders that notices of said hearings shall be published
on the 3Ist. , day of May and on the 7th. , day of June I929, in the South Bend News
Times and Tribune according to law and that notices be mailed . to property owners
according to law.
The Board approved the ;following agreement nade with the Chicago, South Bend
and Northern Indiana Railway "ompany regarding the pavement of Chapin Street under
.Improvement Resolution No. 2I92:
A GREPE7'V,NT .
This agreement, made and entered into this 2Ist. , day of Vay, I929,. by and
between the City of South Bend, Indiana, through its Board of Public forks, and
R. R. Smith, Receiver for, Ohicago, South Bend and Northern Indiana Railway Company,
a corporation duly created, organized and existing under the laws of the state of
Indiana, '4itnesseth:
Whereas, under Improvement Resolution No.2I92 of said Board of Public forks
approved by said Board on April IOth. , I929, said City is about. to pave that portion
of Chapin Street lying between Ford Street and Prairie avenue, all in the said City
of South Bend, And,
Whereas, the plans and specifications for said improvement comtemplate the II
paving by said City of said portion of said street from curb to curb including the !`
space between the rails and trac'cs of a single and double track street railway line
of said Railway Company on said portion of said street, as well as the space outside
thereof; And,
Whereas, said Railway. Company has prepared plans and^specifications for the
reconstruction of its tracks in the said portion of Chapin Street.
Now Therefore, it is agreed between the parties hereto that, in consideration
of the construction, (including the furnishing of material and labor)and the comple-
tion by said City of that portion of said pavement between and within the rails and
tracks of said company and the space one foot in width to ail4acent to and outside
of said track or. tracks, according to the plans and specifications now on file with

and adopted by said Board of Public 'ores, said railway Company agrees to -pay that part
of the cost of said pavement hereinafter specified. But it is expressly agreed between;
the" parties that said Railway Com-nany shall be entitled to and shall pay said ra.rt. of
said cost on the ten year installment plan as prpvided by law, on the same basis as
the p-- ivilege of said installement plan: is extended to property v ners abutting upon
the line of said improvement. And said `'it,y hereby agrees to tajce all such steps and
to do all such things as ray be necessary to be done by it to enable said Railway
Company to ray said ?part of said cost in accordance with said installment plan.
It is finially agreed between the -parties hereto that that part of such cost
so to be braid by said Railway `'ompazy shall be the excess of the cost of the construct
ion of said ravement in the area within and between said rails -=nd one foot in width
adjacent to and out side of each track or tracks over what the cost of the construction!
of a ravement within said area would be if there were no street railway track in the
street.
In witness whereof the parties hereto have hereunto signed their names the
day and date first above written.
