If. if !f Attested: le . of the Board ledne sdav Evening. April 24th. L_ _I929. Board met in regular session at 7-I5 P. x'. All members present. This being the date set, hearing was had on Improvement Resolution Tto.2200 for the local sewer improvement on Greenlawn Avenue from Grand gunk `pest ern Railroad. to Chester Street. (See files for copy of resolution.) In the above named improvement resolution, no remonstrators appeared and no written remonstrances were filed and the Board, being fully advised in the premises, finds that the special benefits that will accrue to the property liable to be assessed for said sewer improvement, will be equal to the estimated cost of same as reported by the City Civil Engineer. The Board, therefore, decides to take, final action on said improvement resolution No.2200 and declares same in all things j ratified, confirmed and approved without modification. The Board now orders that on the 7th. , daffy of Vay 1929, this Board will !� receive, open and read waled proposals up to I0:00 A. V., for the construction of said improvement. The Board further orders that notices of said proposals shall be published on the 26th. , day of April and on .the 3rd. , day of I`ay, 1929, in the South Bend News Times and Tribune according to law. fi This being the date set, hearing was had ^n Im ovement Resolution No.2I99 for the pavement of the first alley west of Cottage k*rove avenue .from Lincoln Way Vi E West to Ilan Buren street. .(See files for copy of resolution.) !� In the above named improvement resolution, remonstrators appaared and a II written remonstrance ias filed and the Board, being full.* advised in the premises, decides to over rule said remonstrance, and finds that the benefits to the several lots and parcels of land liable to be assessed for said improvement will be equal to the estimated cost of same as reported by the City Engineer. The Board, there - tore, decides to ta'_�ce final action on said resolution and declares same in all things ratified, confirmed and approved. G. stray, filed the following primary assessment rolls: Assessment roll for the local sewer on Fremont ' Street from Lineoln' Way lest to Humboldt Street -under Improvement Resolution No.2139. ii f; Assessment roll for the local sewer on Southwood ..venue from Harriett Street to Greenlawn Avenue under Improvement Resolution No.2I4.2. In both of the above named assessment rolls, the Board hereby orders that !' on the 8th. day of Vayj I929, this Board ltrill meet in their office in the City Hall at 7-15 D. 11r., to hear and receive remonstrances from all persons whose property has it been assessed for said improvements and will decide whether the several lots and parcels of land have been or will be benefited in the amounts named on said primary i assessment rolls, or in a greater or less sum than that named on said rolls. Thej Board further orders that notices of said hearings shall be published on the 26th., day of A fril and on the 3rd. , day of Ray 1929, in the South 3end Views Times and Tribune according to law. This being the date set, hearings were had on the following Vacation i! Resolutions : Vacation Resolution No.220I for the Vacation of the alley east of Marietta ''treet from the south line of Dubail Avenue to the North line of the alley South of 'Jubail, and from the south line of the alley south of Dubail Avenue to the north line of Dayton Street. (See files for copy of resolution.) Vacation .Resolution No.2202 for the vacation of the Alley south of Dubail from the east line of Marietta Street to the east line of H. Studebaker first and second A4ditions. (See files for copy of resolution.) Vacation Resolution No.2203 for the vacation of Fremont Street from north line of Roger street to the south line of Longley Avenue. (See files for copy of resolution.) Vacation of the alley north of Roger Street from the west line of Fremont Street to the east line of 1"eade Street. (See files for copy of resolution.) Vacation of the alley "hest of Fremont -Street from the north line of Roger Street to the south line of the alley north of Roger Street, and from the north line of the alley north of Roger -Street to the south line of Longley Avenue. (See files for copy of resolution.) In all of the above named vacation resolutions, no remonstrators appeared and no written remonstrances were filed. Yr. Roland Obenchain, attorney for the School City, at whose request these vacation resolutions were adopted, was present asking the Board to take final action on said vacation resolutions. The Board, there- fore decides to take final action on Said Vacation Resolutions No.220I, 2202, 2203, 2204 and 2205 and declares same in all things ratified, confirmed and approved and the streets and alleys vacated. The Board now orders that lists or rolls be prepared of all owners and holders of Property and of valuable interests therein sought to be ta:lcen, which lists or rolls shall also describe the property beneficially affected. This being the date set, hearing was had on 0ondemnation Resolution No.220611 for the condemnation of the following described property: !! Lot 38 in %clid Park Addition, Also Beginning at the point of intersection of the north line of North . Side Boulevard and the west line of the east one half of Section I8, Township 37 North, Range 3 Fast, thence north along said west line to a point due east of V'le northeast corner of lot 38 in %clid Park Addition, thence running due east one hundred five feet (I051) to a point, thence south and parallel to the west line of the east one half of said Section I8, to the north line of North Side Blvd., thence northwesterly along the north line of said North Side Boulevard to the mace of beginning." In the above named condemnation resolution No..2206, R. R. Smith, represent- ing the Chicago, Northern Indiana and South Bend Railway, was ,resent and advised the Board, that while his company would not stand in the way of any public imrrovement, he felt that the City should be willing to pay well for the property necessary for this improvement. After hearing all persons interested in said resolution, the Board decide to take final action on said condemnation resolution No.2206, and declares same in all things ratified, confirmed and approved viithout modification. In the above named condemnation resolution No.2206, the Board hereby appoi4*0 Edward Pfeiffer and David Gibson as appraisors. The Board further orders that a list or„ roll be prepared of all owners and holders of property and of valuable interests thereini sought to be taken or to be injuriously affected by such condemnation, which list or roll shall also describe the property beneficially affected by such condemnation. :36 dednesday. vening, April_ 24th., 1929. In the natter of Condemnation Resolution No.2206, the Board of appraisers filed the primary assessment .roll showing; the award of damages and assessment of benefits to property ownerst whoze property lies within the district for said condemnation. •. In the above namerd primary assessment roll, the Board hereby orders that lion the 7th., day of Vay 1929, this Board will meet in their office in the 0ity Hall at jI0:00 A.., to hear and receive remonstrances from all persons whose property has been 1affected by such condemnation and will decide whether the several lots and parcels of gland have been or will be benefited or damaged in the amounts named on said primary ;;assessment roll or in a greater of less sum than that named on said roll. The Board iifurther orders that notices of said hearing of award of damages and assessment of benefit's ;shall be delivered according to law or published according to law.
