The Board signed the contract with the Albert Construction Company for the pavement -of Franklin Street from Calvert Street to {Ewing Avenue under Improvement Resolution Noi2178 in the amount of 14,636.50. The Board approved the bond of same for 50% of the contract price signed by Inland Bonding Company. i� • • • 0 Tuesday, -arril 9th., 1929. The Board'si�ri ed the contract with the Albert Construction Company for the pavement of Van Buren Street from Portage Avenue to Cushing Street under Improve-- merit Resolution No.2I75 in the amount of 2,007.00. The Board also approved the u construction bond of same in the amont of 50 of the contract price signed by Inland 'Bonding 00. This being the date set, continued hearing was had on Improvement Resolution No.I790 for the local sewer Improvement on Chalfant Street from Walsh Street to a r,oint IO feet east of the west line of Lot .150 in repla t of Park Place .2nd. , Addi'tion. In the above named improvement resolution, no remonstrators appeared and no written remonstrance was filed and the Board being fully advised in, the premise finds that the benefits to the several lots and parcels of land liable to "be, assessed for said improvement will be equal to the estimated cost of same as submittdd by the City Engineer. The Board, therefore, decides to ta'Ke final action on said improve went resolution and declares same in all things ratified, confirmed and approved without modification, The Board now orders that on the 23rd. , day of A.�,ril 19.29, this Board will receive, open and read sealed proposals for the construction of said sewer under improvement resolution No.I7909 up- to I0:00 A. T,. The Board further orders that notices of said proposals shall be published on the IIth., day of April and on the I8th. , day of April I929, in the South Bend News Times and Tribune according to law. City Engineer, Ti. G.. /ray, filed plans', specifications and estimates and the Board adopted said plans and specifications to-gether with the following j improvement resolutions: i Improvement Resolution Fo.2208 for the grade, ,curb and wale on Bella Street from Portage Avenue to Fedora Street. (See files for copy of resolution.)! Improvement Resolution No.2207 for the grade, curb and walk on Anderson Street from ing Street too Bulla Street. ( See files for copy of resolutiln. ) In both of the above named improvement resolutions, the 73oard hereby orders that on the 30th., day of April I929, t'zis Board will meet in heir office in ;i, the City Hall at I0:00 A. 1%, to hear and receive remonstrances from all persons whose,{ property is liable to be assessed for said improvements and will.decide whether the benefits to the several _lots and parcels of land liable to be assessed for said impro vements will be equal to the estimated costs of same as reported by the City Etigineer. The Board further orders that notices of said hearings be published in the South Bend News Times and Tribune on the I2th., day of April and on the I9th. , day of April' 1929 according to law and that notices be mailed to property' owners according to law. a i City engineer, H. In the above. named vacation resolution, the Board hereby orders that on the 30th.-, day of April I929, this Board will meet in their office in the City Hall at I0:00 Ab M., to hear and receive remonstrances from all persons whose property is is liable to be affected by such vacation. The Board further orders that notices of such hearing shall be published on the I2th. , day of April and on the I9th.9 day of April 1929 in the South Bend News Times and Tribune according to law. The burning i hours of said lamps shall be as follows: Twenty-four (24) of said lamps shall be burned from one half hour after sunset until one-half hour before sunrise, every and all night, burning approxiamtely four thousand (4000) hours per sinnum. During such period, the ontraetor shall maintain and keep said cables, conduits, bases and other -apparatus and equipment in a reasonable state of repair, provided, however, that any renewals or replacements - of all or any part of said cables conduits, bases, apparatus or equipment which `may be installed and paid for by the contractor, shall be and remain the property of the &ontraator. ill property used in the pe rfZrmanc e of this contract shall be and remain the property of the Contractor. The ontraetor, shall at its cost, furnish all lamp renewals and light all lamps herein provided for by electricity for a period terminat- ing with the termination of the General Contract for Street Lighting. All of the lamps herein provided to be maintained and operated Eby this Contractor shall be so operated so that they.wJ11 give the maximum amount of illumination obtainable under commercial conditions. 2. The number of lamps furnished and'lighted under this contract shall be the number provided for in Paragraph I hereof, and shall be located as shown on the blue print attached hereto and identified by the signatures of the Contractor and membbrs „of the Board of Public Wor'os. 3. All 8utages. shall be reported daily in writing by the proper officers of the City to the ,ontractor and the proper officers of the City may deduct from the total monthly amount.which would have been paid for any lamp so reported had, no outage occurred, the sum bearing -the ratio to such. total as the period of outage bears to the total time the lamp would have.been lighted in any month. 4. Street lighting units herein contracted for shall be moved by the Contractor :to such new location as the City may by writing direct, subject to the following conditions: - SVch moving of lamps shall be completed within -thirty (30) days after receipt by' Contractor of written notice from the City, Sundays, legal Holidays and stormy dajts not to be counted, provided that the number of such removals -shall not exceed one per day and provided further that such removals shall not be required on Sundays, - legal holidays and stormy days. Notice that the work of such removal of lamps has been completed shall be given by the Contractor to the City within ten days after the completion of the work.. The actual cost to the Contractor of makiijg such relocations shall be paidbythe City to the Contractor frithin thirty days after said notice has been given. 5. The Cit7T shall accept such lamps and the services herein specified during thel life of this contrast and pay as full compensation -therefor, at the rate and price set out in the aecpeted bid to -wit: - For underground street lighting units. 36 - 13 foot riverside Standards, complete with VjKyptian Senior Lighting Units and Yogul 1 �ltiple Sockets and each equipped with I - 5000 lumen street lighting lamp, for Chapin Street. 43.00 per unit per annum. 28 - 12 foot Sheridan Hollow Spun, Concrete Bighting Standards complete with Octagonal Junior Lighting Tops with --'pikes and Medium Tfogul Muttiple Sockets, each e1qu.ipped with I - 1000 Lauren Street lighting lamp, for Miami Street. $32.50 per unit per annum. 13 - 12 foot Sheridan Hollow Spfln, Concrete .Lighting Standards complete with Octagonal Junior Lighting Tops with Spikes and Medium Mogul Multiple Sockets, each equipped with I - 2500 lame, street lighting lamp, for Miami Street. The Contractor shall have the right with the consent of the Board of Public forks of the City; at any time during the life of this contract to install operate and maintain in the place of the lamps herein provided for, and under the same terms and conditions, other and more improved lamps 'in keeping with such advanceI fA6,tt as may be made in the art of lighting, which lamps shall -be equivalent or great- er illuminating power. 7. In authorizing or granting a -hermit to any person, firm or corpor- ation to rexoair or cut into any street, alley nr sidewalk in which said street light- ing units and lines and cables supplying current thereto are located, the Eity shall 1 require, as a cohdition to the granting of Tach permit, an agreement on the part of the applicant that such lines and cables and street lighting units will not be interferred with irr any manner wlikout notice to the Contractor. 8. All the covenants, expressions, terms, conditions, provisions and I agreements her6in shall extend to and be binding upon; 6r- enure to the benefit of, as' the case may be, each and every one of the successors or assigns of each of the parties hereto as if in every case so expressed. 9. This contract shall be in force and effect from and after its approval by ordinance for a period terminating with the termination of the General Contract for Street Lighting, which termination date is January Ist., 1935, at noon.
